Consider the motion… Re: Consider input/amend Condition 24 – Public Bathroom requirement for Legends II Phase III Dear Honorable Mayor and Bozeman City Commission: Briefly, Legends II Phase III subdivision was approved in August 2014. Condition of Approval No. 24 to “install adequate restroom facilities… within Public Park 1” was added by the City Commission after Public Comment was closed, without opportunity for rebuttal or commentary. “Commission found providing public bathroom facilities would further the parks plan and public health and safety.” (see bottom of pg. 43 of 55 pages attached to 4-13-2015 item link / motion.) However, Legends II HOA feels and has communicated to City staff they do NOT want public restrooms/bathroom raising concerns for public safety, nuisance issues, and security/police. Note: Legends II Public Park 1 is dedicated to the public and maintained by Legends II HOA. As a Legends II owner, who pays fees into the HOA for maintenance, I also note the following: -Bathrooms are located at much larger public parks where the City is in charge of maintenance. [For example, Story Mill Park is being planned and a bathroom there seems more appropriate?!] -Community-oriented amenities are better alternatives for neighborhood residents and public citizens. Thus, Bozeman public might use and better benefit from a pavilion or picnic shelter, or expanded playground, or community gardens, or fitness trail stations, etc. as options/examples. Legends II HOA has been talking with the developer who may deed Lot #1 of 1.219 AC which lies adjacent to Pubic Park 1 on the North side of Boylan Road plus up to $30,000 for park improvements towards beneficial amenities for home owners, neighbors, and public use with lessor/more controllable liability factors and maintenance costs than the Bathroom Condition. These negotiations can only proceed if the City Commission is willing to allow an alternative. As a Legends II Phase 1 owner of Lot 8 directly across from the Public Park 1, I ask that you please consider HOA input and pass today’s motion for Condition 24 to add it to 27-April-2015 City Commission meeting agenda.
