MOU MDT Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Heather Davis, Associate Planner Brian Krueger, Development Review Manager Wendy Thomas, Director of Community Development SUBJECT: Authorize the City Manager to sign the Memorandum of Understanding (MOU) between Montana Department of Transportation and the City of Bozeman, an agreement that MDT will either participate in their pro rata share of the cost of the construction of a shared use or directly construct their portion of the shared use pathway when there is an available connection of the pathway system to the site located at the northeast corner of Frontage and Nelson Road, fulfilling a condition for Site Plan Application Z14138. MEETING DATE: April 6, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the City Commission authorizes the City Manager to sign the attached Memorandum of Understanding document. BACKGROUND: The Montana Department of Transportation (MDT) made application to allow the construction of a new administration office, shop, and storage buildings with associated parking and related site improvements, on the northeast corner of Frontage Road and Nelson Road, and within the Frontage Road Class I, Entryway Corridor. As part of the preliminary approval of Application Z14138, the project is conditioned to require that MDT enter into an agreement with the City that states that MDT will either participate in their pro rata share of the cost of the construction of the shared use pathway along the Frontage Road or directly construct their portion of the shared use pathway when there is an available connection of the pathway system to the site. MDT has submitted the required documentation to satisfy the condition. Planning staff have reviewed the document and have found it to be acceptable. UNRESOLVED ISSUE(S): None at this time. ALTERNATIVES: 1) Authorize the City Manager to sign the MOU as recommended. 2) Recommend changes to the MOU prior to City Manger signature. 3) Do not authorize City Manger signature on the MOU. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development.
