RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 121 North Rouse Avenue, Bozeman, MT 59715, a
Municipal Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby
release and reconvey the following described easement unto BACKCHECK, LLC at PO Box
1167, Bozeman, Montana 59771, as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of the public access easement
situated across Lot 12, Block 1, of Gallatin Park Subdivision, City of Bozeman, Gallatin County,
Montana.
WHEREAS the above public access easement was granted on October 28, 2009 and
recorded on December 21, 2009 as Document 2349820 at the Clerk and Recorder's Office of
Gallatin County, Montana.
WHEREAS the construction of Lot 12 will be completed without having to occupy said
public access easement recorded as Document 2349820, and WHEREAS the vacation of the
easement recorded as Document 2349820 will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to BACKCHECK, LLC
the said easement located on the above described real property as set forth on Exhibit A attached
hereto together with any right, title, or interest that the Grantor may have in said easements as set
forth on Exhibit A attached hereto and incorporated herein by reference as though fully set forth
and described as follows: beginning at a point being N 80' 30'58" W, 114.38 feet from the
southeast corner of Lot 12 of Gallatin Park Subdivision, thence from said Point of Beginning, S
890 24'49" W, 30.00 feet; thence N 00' 35'23" W, 46.00 feet; thence N 89' 24'49" E, 30.00
feet; thence S 00' 35'23" E, 46.00 feet to the point of beginning located in the SE 1/4 of Section
36, T.1 S., R.5 E. of P.M.M, City of Bozeman, Gallatin County, Montana.
