PUBLIC STREET EASEMENT
SACCOCCIA LANDS II, LLC, a Montana limited liability company, 1234 Springhill
School Road, Belgrade MT and BOZEMAN LODGING INVESTORS, LLC, a Montana limited
liability company, 2023 Commerce Way, Bozeman MT, collectively as GRANTORS, in
consideration of$ 1.00 and for other and valuable considerations, receipt of which is
acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main,Bozeman, Montana 59715, GRANTEE, its successors and
assigns, a perpetual street and utility easement for the use of the public, in,through, and across a
parcel of land situated in Gallatin County, Montana,to be located on the following described real
property in the specific locations depicted on the attached exhibits:
As depicted on Lots 1A and 2A on the Amended Plat of Lots 1 and 2 of the Saccoccia
Minor Subdivision 407, City of Bozeman, Gallatin County Montana and
that portion of Lot 57A of Minor Subdivision 272 being located in the NW 1/4 of Section
1, T2S, R5E, P.M.M., City of Bozeman, Gallatin County, Montana.
The easement is more particularly described and depicted on the attached Exhibits A and
B, which by this reference is made a part hereof.
SACCOCCIA LANDS II, LLC states that it possesses Lots 1A and 2A described above
and BOZEMAN LODGING INVESTORS, LLC states that it owns Lot 57A as described above

and that the Grantors have a lawful right to grant an easement thereon.
The GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTORS.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators,personal representatives, successors, and assigns of the
parties hereto.
