HomeMy WebLinkAbout15- Task Order No. 3 Dowl for Professional Services Task for Aquisition of Right of Way and EasmentsExhibit A to Master Task Order Agreement for Professional Services TASK ORDER NUMBER 03 Issued under the authority of Professional Services Master Task Order Agreement between the City of Bozeman and DOWL for: Professional and technical services for the acquisition of right of way, easements and real property to allow for the construction of various sheet and utilities improvements within the Citv of Bozeman This Task Order is dated 11 20 between City of Bozeman (City) and DOWL (Contractor). The following representatives have been designated for the work performed under this Task Order: City: Brit Fontenot Contractor: Tony Becken-Gaddo, P.E. SCOPE OF WORK: The scope of work for Task Order No. 3 is detailed in the attached Project Scope of Services. COMPENSATION: Contractor shall be reimbursed on a time and materials basis with a total cost not to exceed $26,165.00. The total cost for Task Order No. 3 is detailed in the attached Project Cost Estimate. Contractor shall invoice no more often than monthly for services provided in the prior month. The provisions of the Professional Services Master Task Order Agreement and any Special Terms and Conditions and/or Exhibits or Attachments to this Task Order shall govern the Work. No. 92-0166301 January 23, 2015 Professional Services Agreement for Streets and Utilities Land Agent Services Project Scope of Services Task Order No. 3 The City of Bozeman plans to construct the North 7"' Avenue Lighting Improvements project, and requires the acquisition of private property interests, in this case easements, to facilitate construction. This Task Order No. 3 is intended to outline the Scope ,of Services that DOWL will provide to get that project to construction. The scope of this project includes acquiring public access and utility easements for the N. 7"' Avenue corridor from W. Main Street to Juniper Street. The North 7t" Avenue Lighting Improvements project plans and documents split the project into four separate phases of the project: Phase 1: I-90 to Juniper Street (completed); Phase 2: Juniper Street to Durston Road; Phase 3: Durston Road to W. Beal Street; Phase 4: W. Beal Street to W. Main Street. For this R/W acquisition project, DOWL will obtain easements for 33 properties, 5 of which are in Phase 2 and 28 in combined Phases 3 and 4. Upon acceptance of this Task, DOWL will meet with the City and the City's design consultant to review the work to date and to understand the previous attempts to acquire the required easement areas by donation from the respective property owners. Immediately following that meeting DOWL will begin the process of title research (as necessary), document preparation, and actual meetings with 33 private property owners to acquire the easements necessary for the project. Easement documents, parcel exhibits, plats, figures, property owner contact and ownership data, and construction plans will be provided by the City. DOWL will coordinate with the City staff on project progress and meetings with project team members. The intent of this scope of services and corresponding cost estimate is to provide basic title research and easement acquisition services on a time and materials, not to exceed basis. Since the acquisition of these easements is currently on a voluntary basis, DOWL cannot guarantee that all property owners will agree to donate, however DOWL will use all reasonable efforts to illustrate the inherent benefits that the North 7t" Avenue project will have for each private property. Additional costs related to engineering, surveys, property appraisals, and any costs associated with eminent domain proceedings are not included in this scope of services or cost estimate. The following activities will be conducted as outlined below. 1_0 PROJECT RESEARCH • Obtain and review available construction plans. • Obtain and review available project documentation. • Obtain and review proposed easement documents. • Obtain current ownership information. Page 1 of 2 FOWL January 23, 2015 2_0 PROPERTY OWNER CONTACT • Compile contact information. • Initiate contact with owners to inform them of this project and the process. • Work with property owners and the City to come to an agreement on the donation of the necessary easements. 3.0 TITLE COMMITMENTS • Title commitments are not included in this scope. 4_0 APPRAISALS AND REVIEW APPRAISALS • Appraisals are not included in this scope. 5.0 ACQUISITIONS • Conduct meetings with property owners to acquire donated easements. 6_0 RELOCATION SERVICES • Relocation services are not included in this scope. 7_0 CLOSING • There will be no title closings required. DOWL will submit the complete final title transfer documents to the City for recording. 8_0 FINAL SUBMITTAL AND CLOSEOUT • Deliver completed title transfer documents. • Project closeout. • QA/QC of deliverables. Deliverables: • Final signed and notarized title transfer documents to the City. 9_0 PROJECT MANAGEMENT • Project administration. • Coordination meetings. CONTINGENCY Due to the nature of property acquisition work, the time required to work with individual property owners varies significantly. The scope of services as detailed in this document includes all the necessary steps to acquire easements from private owners, but much of that work relies on good cooperation and timely responses from all parties. The contingency item serves to capture the possible additional costs incurred during the acquisition process due to challenging situations with property owners.
