Commissioner - Cynthia Andrus: Motion Commissioner - Chris Mehl: 2nd 06:35:47 PM Commission discussion on Motion Cr. Andrus supports this project and likes the idea that there is a resolution for parking and appreciates the hours being addressed. She likes the idea of walking and biking and this is a great addition. Mayor Krauss thanked the applicant for their investment. He spoke regarding prior economy hardships but added that we are climbing out of it. 06:43:57 PM Commission questions for Applicant The Commission and the Applicant discussed the reason for the extension, the price of building ,the price of real estate and the fact that it is market driven. 06:46:01 PM Public Comment Mayor Krauss opened public comment. Mayor Krauss closed public comment. 06:46:08 PM Motion that based on the staff recommendation and finding that the request is consistent with the Unified Development Code, and that no changes to the code or other circumstances have occurred that would result in a material change to the approved site plan, I hereby move that the Commission approve the request for a five (5)year extension to the Village Downtown Lofts PUD Final Site Plan, extending the approval until May 3, 2020. Commissioner- Chris Mehl: Motion Commissioner - I-Ho Pomeroy: 2nd 06:46:50 PM Commission discussion Cr. Mehl stated that he will support the motion because existing folks will not be impacted. There are no code changes and the infrastructure is in place. No changes to the approved plan. Mayor Krauss stated that he will support the extension and spoke regarding height, density, stop lights and ended by stating that this is accomplishing some of the things we want to see. Mayor Krauss declared a break. 07:04:12 PM Meeting called back to order Mayor Krauss called the meeting back to order at 7:04 p.m. 4. 07:04:20 PM Affordable Housing Study Report and Recommendation (Sutton) Alt= 07:04:35 PM Staff Presentation Associate Planner Valerie Sutton began the Staff Presentation for the Affordable Housing Study Report and Recommendation. Ms. Sutton stated that dramatic changes have occurred in development. She spoke regarding the Community meetings that took place at prior meetings that were held. 07:09:22 PM Daniel Werwath, Consultant from Werwath Associates Mr. Werwath spoke regarding the community survey and that it had a great response. He spoke regarding the summary of recommendations, the evaluation process including reviewing the City's Workforce Housing Ordinance, regulations, demographics, home sales, building permits, subdivision date etc. He then showed the housing prices and how they have rebounded, the fact that the supply of affordable homes is declining and that $250,000 is the average for a median income (detached homes). He then went through the recommended target market for affordable homes, home ownership for folks below 65% of AMI and that those are persons below $42, 600 per year. He then went over the Goals for Low-Moderate income target populations, and who would benefit according to income levels. He spoke regarding the recommendation of reinstating the Workforce Housing Ordinance and applying to a broader range of developments and give developers a choice of two simplified options. He then spoke regarding simplifying the requirement for income restrictions, focus on providing finished homes, simplify standards for providing homes of a different types and sizes, strengthen incentives for building low and moderate prices, homes vary by housing types,making incentives more widely available, Page 7 of 19 February 9,2015 Bozeman Cite Commission Aliuules the recommendation of a separate ordinance for dealing with incentives,the suggestion to increase capitalization of affordable housing fund, and other actions that the City could consider including supporting new affordable rental development, promoting employer sponsored affordable housing developments, investigate new ways to encourage preservation of existing mobile home parks, evaluate options for new rental subdivisions and mobile homes, reassess restriction on accessory dwelling units and encourage private sector innovation in design and construction of smaller very livable homes. He then went over the next steps including drafting a revised ordinance. 07:32:29 PM Commission questions for staff The Commission and staff discussed inclusionary zoning and how it works across the country, the fact that all communities were challenged during the down turn in development, higher tier incomes, the question of what could go wrong including shutting down development and shoving development out into the County, passing costs onto other market rate homes, the question of if the program works well those buying in other surrounding towns will come to Bozeman, the fact that increased affordable housing will ease rentals creating a more diverse community, long term investments, how to quantify incentives, spreading costs, investments, the goal of closing gaps, passing something that will work no matter how the market is and the difficulty with that, prediction if this all came together how it would impact affordable housing, what will happen if a home is built and not sold and the fact that is not anticipated, how town homes fit into this, encouraging smaller sizes through an ordinance, the idea of design competitions, what may be driving this, supply and demand, external influences, the uniqueness of Bozeman because it has a student population, any success when there is no inclusionary zoning, the fact that this would take significant investment, optional free market models,the main differences from the original ordinance, the possibility of stand- alone incentivizes,how flipping would work in regards to low income to low income etc., a deed restriction as an option and the fact that the Commission would need to manage what that would look like, payback mechanisms, the consultant's recommendation of the method of straight payback, the fact that lending is easier in the County, loan to value ratios, instruments such as rights of first refusal, the use of re-capture or re-sale methods, vacancy rates, low income tax credits, unemployment rates, incremental investments, community willingness, population breakdowns, current options, how people can buy a subsidized unit including a first come and first serve waiting list, creation of value, already approved properties not being able to take part in this, reaching out to the County in some way to get it in the community, density bonuses which are taking place across the country, housing development and how the structure associated works, student housing and approaching MSU and large entity institutions and creating incentives. 08:38:12 PM Break Mayor Krauss called for a break. 08:47:00 PM Meeting called back to order Mayor Krauss called the meeting back to order. 08:47:20 PM Public Comment Page 8 of 19 Februwy 9,2015 Bozeman Go,Coninihsion Minutes Mayor Krauss opened public comment. 08:47:34 PM Jerry Pape,Public Comment Mr. Pape spoke regarding the cost of a current building lot, and stated that there is an increase of land costs. He spoke regarding density, more profit, salability, time, value, money. He continued by discussing the cost of improvements and affordability and the need to bring in jobs with good incomes. Create a solution involving all parties. 08:52:23 PM Georze Thompson, Public Comment Mr. Thompson feels the recommendations are premature. He spoke regarding market conditions, number of responses received for survey and the fact that he feels it was a thin response compared to the population and incentives. There is intellectual horsepower needed. He spoke regarding financing. He recommended that the Commission defer the decision making for 3-6 months because of economic changes. Wait and see what happens. 08:56:13 PM Doug Chandler, Public Comment Mr. Chandler spoke regarding inclusionary zoning, and urged the Commission to not burden the rest of the market. He spoke regarding impact fee deferrals. The City should look at changes to park requirements. He spoke regarding other options. In the end, reduced lot sizes would help. He urged the Commission to look at attached housing. 08:59:32 PM David Gram, Public Comment Mr. Gram stated that the study is a good look at Bozeman, it is a snapshot. The Commission can't make an informed decision. He likes the incentives. He spoke regarding supply and demand. He gave homes in the Norton Development as an example that are being built but not absorbed. 09:02:56 PM Mark Debrinski, Public Comment Mr. Debrinksi urged the Commission to relax on Accessory Dwelling Units, this would increase the rental pool, speed up the approval process, GAR is opposed to inclusionary zoning, this puts undue hardships onto developers. 09:04:25 PM Brett Potter, Public Comment Mr. Potter stated that he is on the Planning Board but is unhappy with the idea of inclusionary zoning. Urban sprawl is a concern and there is a need to look at connectivity. He personally does not support it. Free up some of the rules and regulations for designers. 09:07:11 PM Mareen Hulk, Public Comment Ms. Hulk spoke regarding moving to this area from Kirkland Washington. There was no affordable housing there. She recommended reducing the lot sizes. Also, there are not enough rentals. There is a need for rentals and smaller lot sizes. Page 9 of 19 February 9,2015 Bozeman Cite Commission Minutes 09:09,42 PM Brian Morrison, Public Comment Mr. Morrison is against inclusionary zoning. It increases housing costs. He has concerns of the salary rates used. All his research has shown that inclusionary zoning will not increase affordable housing. 09:12:17 PM Leif Sundeen, Public Comment Mr. Sundeen stated that he just bought a house in Bozeman; research has indicated that inclusionary zoning impacts new housing units and market prices of housing increases. It has hazards and only targets new home buyers and there are no benefits for the existing. Let's make this a community solution. He suggested that town homes be considered and urged that the City consider a mill levy for the affordable housing fund. Are we considering impacts on urban sprawl and the Bozeman Climate action plan? There is a need of how to manage the supply and demand equation. 09:15:55 PM Andy Rowl, Public Comment Mr. Rowl reiterated that Bozeman is full of talented people who can address this problem to meet Bozeman's needs. Put it out to the community and see what kind of results we can get. He feels this is the best way to go. He is opposed to inclusionary zoning. By tying to a revenue string, there will be a problem with infrastructure. It will take significant work to do inclusionary zoning. 09:18:13 PM Kevin Thane,Public Comment Mr. Thane stated that there is a chink in the amour. He likes that rental housing was addressed. Inclusionary zoning is just a slice of the problem with affordable housing. He spoke regarding the hourly wage rate. Need to address the very low of the spectrum and look at housing all of the way up. He supports the idea of row housing and likes the idea of incentives for builders. This may be premature on asking staff to put together an ordinance at this time. 09:21:41 PM Rob Evans, Public Comment Mr. Evans from SWMBIA stated he is hopeful about shareholders involved. They have some ideas to try out and he feels that we can come up with a solution. 09:23:11 PM Lucy Pope,Public Comment Ms. Pope stated that her company works with future home buyers to build stepping stones for home buyers. She spoke regarding mobile home ownership and is pleased to see a task force proposed. They will serve on it. They are interested in homeownership for Bozeman's every day worker. She likes the recommendations of having more conversations. Look at recommendations for mobile homes. If rentals are key component, may be time to step forward with rental options. 09:26:28 PM Don Cape,Public Comment Mr. Cape is an employer and it is difficult to get people to stay in Bozeman. Developers tend to overbuild. Credits possibly could be earned by the Developers and then sell them in the event that they can't do what they need. He spoke of the mobile home inventory and the need for standards. Make it meaningful. Page 10 of 19 Februag 9,2015 Bozeman Chr Commission Minutes 09:30:08 PM Fredrick Richards, Public Comment Mr. Richards stated that he is a fan of affordable housing. He spoke regarding the Norton ranch development ant that there are several lots to go. He is not sure if the $250,000 is really correct, and that an average house payment is $1150. You can't rent at a rate of $1200. There is a need to reassess and tier down. 09:32:10 PM Justin Ailport, Public Comment Mr. Ailport spoke regarding students, marketing MSU and smaller lot units. 09:33:21 PM Arles Nelson,Public Comment Ms. Nelson has some concerns and that priorities need to be changed a bit. She spoke regarding her neighboring mobile home park. It is a great area for some affordable housing. It looks like we are going to have another park there. Should look harder at affordable housing. 09:35:14 PM Jeff Rupp, Public Comment Mr. Rupp spoke in support of the City's continuing effort in Affordable Housing. The mills are important. He spoke regarding the City's support of legislative efforts, the West Edge project, the home buyers education program and down payment assistance. Bozeman should be proud. He asked that the report be accepted. The answer is all of the above. This is a proven tool that has been successful in other towns. This needs to be a community issue and needs to be supported. He spoke regarding adding 3 mills to the budget and analyze for 3 years and see if it is successful. Help folks with land and infrastructure costs; that has been problematic. 09:39:58 PM Carol Stallin,Public Comment. Ms. Stallin studied affordable housing issues from all over. The middle class wages are low. We have had this problem the entire 10 years that she has been in Bozeman. 15 years has been enough time. 77% of Bozeman voted for the trail bond. She spoke regarding impacts to environment, using older cars because they can't afford a Prius. She urged private industry to work with local governments. 09:44:09 PM Brian Propel, Public Comment Mr. Propel from SWMBIA urged that all sit down and look at the information. Inclusionary zoning increases the costs of doing business and those costs will be passed along. They are concerned professionals. They have been advocates in affordable housing. They do a lot of work on affordable housing . SWIMBIA is willing to work with City Staff. All moving parts need to work together in order to get a solution. 09:48:34 PM Christian Wilcox,Public Comment Mr. Wilcox stated the people know what to do. We need to have a good economy. Tired of the taxation etc. This is a great place we live in and this is why he hasn't left. There is another way to make affordable housing. Page 11 of 19 February 9.2015 Bozeman CRY Commission Minutes 09:51:22 PM Rules suspended until 10:30 p.m. Mayor Krauss 09:51:47 PM Commission discussion Cr. Pomeroy stated that people like to come here and live here. The Community is growing and it is a good thing. But sometimes this creates a problem. We created the problem. We all have to work together to solve this problem. She suggested that everybody contribute $143 towards an Affordable Housing fund. Businesses pay license fees, why not increase the fee. Let's make some resources together and everybody contribute and have a non-profit and government work together. Manufactured homes are better than mobile homes, and the study says that workforce housing is a community problem. Let's work together. Everybody chip in. Mayor Krauss wants to avoid old guy answers and spoke regarding accumulation of the 2 mills for affordable housing. We need to seek grants and agree to protect the affordable housing fund. He disagrees with the inclusionary zoning philosophy. We are burning up the inventory. He doesn't want the burden to be for the next people who are buying houses. It is difficult to give density bonuses. He spoke regarding the ghetto stereotyping, standards and deferred impact fees. We can come up with designs as they relate to infrastructure. He will not vote for inclusionary zoning but he would support deferrals. Mobile home parks,that's a difficult one. The issue of decent rental units there is a need to look at this. The answer does not just lie within the city limits. Find a way to find reliability or predictability for small lots. He spoke regarding side yard setbacks, the threat to mobile homes and he is not sure where to go with rentals. That is one thing we should target with HRDC and other partners. Cr. Andrus stated that she is choked up about the conversations this evening. This is a conversation about finding a solution together. We have heard great ideas tonight. She is very moved. Idea of exploring a broader plan is something that she is in favor of. It is a good study. She doesn't feel that it is the ending place though. There is a need to look at inclusionary zoning. There are other ideas that haven't been explored. She is willing to talk about the ideas. She spoke regarding pocket neighborhoods. She agrees with the Mayor about the County and that this is a problem beyond this community and the County needs to be involved. The idea of incentives is a great idea. We need to think out of the box on this. Try something different that other communities haven't tried. Urban Sprawl and Climate Action plan are part of location and we need to look at those together. You want people to buy into it, work in the community and stay here and to do this is by allowing and buying houses to live here. Get them to live in the City and work in the City. He sees the inclusionary zoning ordinance as a piece of this. Free market does not solve the problem. Smaller houses on smaller lots. By getting people in the home ownership allows them to generate equity and allows them to move on. There are a lot of potential solutions. He is wary about putting this all off. As far as the Story Mill property, the property is owned privately. The City just bought a portion. We have had a rental housing policy for a couple of years, lowered impact fees, we have 4 figures of properties coming online, and have had efforts in rental but more needs to be done. Overall what he is hearing is about incentives, capacity and supply. He is in favor of staff coming back. As far as capacity, the City is going to have to do this in the budget. The City should reach out to the Hospital and approach them along with the University. He would include accessory dwelling units. As far as inclusionary zoning, it got a lot of people here tonight and there are a lot of good intentions.
