HomeMy WebLinkAbout02-27-15 Bateson, Murphy, Public CommentDear Bozeman City Commissioners and Staff, Please do not allow Mr. Tom Murphy to gain Eminent Domain for access via Boylan Drive to property adjacent to the Bridger Creek Golf Course and public trail system. I use the trail from Boylan Drive to the Bridger Creek trail system on a weekly basis, in the spring, summer and fall to hike, and in the winter to ski. I would be quite upset if access to the trail were prevented by this developer's plans. I live close to the center of downtown, and this is one of the closest trails to my home. I strongly agree with the reasons not to allow Eminent Domain, that the Bridger Creek Subdivision Community Association outlines below: 1. Access and utilities are already available to the property from Commerical Drive. He can annex to the City and obtain utilities. 2. There is no public benefit if the property is taken through eminent domain, and the City should not incur that expense on behalf of the taxpayers. 3. Keeping the park and public trail intact, and keeping Murphy’s property as open space and wetlands provides a greater public benefit. 4. This section of land is sensitive to development; we learned that first hand with the significant ground water issues with the Village Green Townhomes and Links Condo developments. Significant cost was incurred by Village Greens, BCSCA, and Golf Course Partners to address the ground water. Who knows what will be affected if more ground in that area is developed. In addition, Murphy's property contains a mitigation wetlands, which was created for wetlands previously destroyed. Any development on that property would affect those wetlands.
