My name is Mary Taylor, and I live at 1045 Boylan Rd, in Phase 1 of the Bridger Creek Subdivision. I am
writing to indicate my opposition to the city of Bozeman using Eminent Domain to allow Tom Murphy
access through our property, for the purpose of developing his land.
When Mr. Murphy purchased his property, he knew he had no access from Boylan Rd., but did and still
does have access from Commercial Drive. That allows him access and access to city utilities and will
also allow his land to to be annexed to the city. There is no public benefit to the commission taking
land from our homeowners association, and giving it to a private citizen so he can enrich himself.
The city made a requirement, as a condition of development of the Bridger Creek Subdivision Phase 1,
that the pieces of land that Mr. Murphy wants to take, although owned by the Bridger Creek
Subdivision, be set aside as open space for the public to use. Through the use of Eminent Domain, that
land would no longer be for the public benefit, but go to benefit a private developer.
I don’t see any public benefit here, only benefit to one property owner at the expense of many
Bozeman residents. The city already has to rectify one incorrect decision made at the expense of the
Bridger Creek Subdivision - please do not make another.
I ask that you deny any request to use Eminent Domain to take property from Bridger Creek Subdivision
homeowners.
