RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation ofthe State of Montana hereinafter ("GRANTOR") and does hereby release and
reconvey the following described easements unto Stockman Bank of Montana, P.O. Box 250,
Miles City, MT 59301 ("GRANTEE") as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a public utility easement
situated between Lots 4 and 5, Block 1, Kagy Crossroads Subdivision, Section 14, T. 2 S., R. 5
E., P.M.M., City of Bozeman, Gallatin County, Montana.
WHEREAS the above public utility easement was granted Oct. 29, 2001 and
recorded on Dec. 19 , 2001 , with the filing of the plat for Kagy Crossroads Subdivision, filed in
Book J of Plats, Page 328, Document Number 2056002 at the Clerk and Recorder's Office of
Gallatin County, Montana.
WHEREAS the construction of utilities has been completed without having to occupy
said easement recorded on Dec. 19 , 2001 , the vacation of all ofthe public utility easement
recorded on Dec. 19,2001 will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Stockman Bank of
Montana those portions of the public utility easement located on the above described real
property as set forth on Exhibit A "shaded area" attached hereto together with any right, title, or
interest that the Grantor may have in said public utility easement as set forth on Exhibit A
attached hereto and incorporated herein by reference as though fully set forth and described as
follows:
"Abandon -1L-foot wide public utilitv easement to the City of Bozeman as previously
recorded on Kagv Crossroads Subdivision plat , between Lots 4 and 5, Block 1, Kagy
Crossroads Subdivision, City of Bozeman, Gallatin County, Montana."
