PUBLIC ACCESS EASEMENT AND AGREEMENT
John Rosa and Scott V. Johnson, with a mailing address of85 West Clara Court, Bozeman, MT. 59718,
and Christopher A. Johnson, with a mailing address of11415 West Coal Mine Drive, Littleton, CO.
80127, the GRANTORS, in consideration of One Dollar ($1.00) and other good and valuable
consideration, receipt of which is acknowledged, grant(s) to the City of Bozeman, a municipal corporation
ofthe State of Montana, 411 East Main, P.O. Box 1230, Bozeman, MT 59771-1230, the GRANTEE,
its successors and assigns, a perpetual access easement for the use of the public, in, through, and across
a strip ofland of variable width situated in Gallatin County, Montana, to be located on the following
described real property:
Lots 2,3,4 & 6, Block 17, Cattail Creek Subdivision, Phases 2A and 2B, according to the plat
thereof, on file and ofrccord in the office of the Clerk and Recorder, Gallatin County, Montana,
and located in the Northwest Quarter of Section 35, T, 1 S., R. 5 E. of P.M.M..
The Easement is more particularly described and shown on the attached EXHffilT A, which by this
reference is made a part hereof.
RECITALS:
Whereas, John Rosa is the owner of Lots 2 & 4, Block 17, Cattail Creek Subdivision, Phase 2B,
according to the plat thereof, on file and of record in the office of the Clerk and Recorder, Gallatin County,
Montana,
Whereas, John Rosa and Scott V. Johnson are the co-owners of Lot 6, Block 17, Cattail Creek
S ubdi vision, Phase 2A, according to the plat thereof, on file and of record in the office ofthe Clerk and
Recorder, Gallatin County, Montana,
Whereas, Christopher A. Johnson is the owner of Lot 3, Block 17, Cattail Creek Subdivision, Phase 2B,
according to the plat thereof, on file and of record in the office of the Clerk and Recorder, Gallatin County,
Montana,
The GRANTORS state thatthey possess the real property described above and that they have a lawful
right to grant an casement thereon.
The GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the rights and privileges
herein granted without any interruption by the GRANTORS.
The terms, covenants and provisions ofthis easement and agreement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.
