RELEASE AND RECONVEYANCE OF EASEMENT :)

COMES NOW the City of Bozeman, 411 E. Main Street, Bozeman, MT 59715, a Municipal
Corporation of the State of Montana, hereinafter referred to as "GRANTOR", does hereby release
and reconvey the following described easement into SBA Partnership of Bozeman, Montana,
described as follows:
The 60-foot wide public access easement located along the east line of Lot 2,
Minor Subdivision No. 135, City of Bozeman, Gallatin County, Montana
WITNESSETH:
WHEREAS, the Grantor is the legal record title holder of the above-described Public Access
Easement situated across Lot 2 of Minor Subdivision No. 135, situated in the SWl/4 of Section 11,
T2S, R5E, PMM, City of Bozeman, Gallatin County, Montana.
WHEREAS, the above-described Public Access Easement was granted to the City of
Bozeman in conjunction with Annexation of the Fish, Wildlife and Parks Tract, and recorded on
May 21, 1990, in Film 112, beginning on page 4036, Clerk and Recorder's Office of Gallatin
County, Montana, and was further shown on the final plat of Minor Subdivision No. 135 and
recorded on September 8, 1994 at the Clerk and Recorder's Office of Gallatin County, Montana.
WHEREFORE, GRANTOR does hereby release and reconvey to SBA Partnership those
portions of the Public Access Easement located on the above described real property as set forth on
Exhibit A attached hereto together with any right, title, or interest that the Grantor may have in said
Public Access Easement as set forth on Exhibit A attached hereto and incorporated herein by
reference as though fully set forth and described.
