HomeMy WebLinkAboutC4 Block M Final Plat P14056 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Wendy Thomas, Director of Community Development SUBJECT: Authorize the Block M Phase 2 Major Subdivision Final Plat, Application P14056 MEETING DATE: March 2, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: Upon the Director of Public Work’s review and concurrence, the City Commission approves the Final Plat of the Block M Phase 2 Major Subdivision and authorizes the Director of Public Works to execute the same on behalf of the City of Bozeman. BACKGROUND: This is a request for approval of the Final Plat for the Block M Phase 2 Subdivision. On June 10, 2013 the City Commission granted preliminary plat approval by a vote of 5-0 to subdivide 1.01 acres and create 20 residential lots for B-3 (Community District) residential development, in a block bound by North Tracy and North Black Avenues and East Lamme and East Beall Streets. Phase I was filed on November 26, 2013. Phase 2 will be the final phase of the plat filed. State law provides that the governing body shall approve the plat only if: a) The plat conforms to the conditions of approval set forth on the preliminary plat and to the terms of the state subdivision law and regulations and the regulations adopted by the Bozeman City Commission; and b) The County Treasurer has certified that all real property taxes and special assessments assessed and levied on the land to subdivide have been paid. The County Treasurer has certified that the taxes and special assessments have been paid. Attached is a staff memorandum from Brian Krueger, Development Review Manager, delineating how the conditions have been satisfied. UNRESOLVED ISSUES: None identified ALTERNATIVES: None identified. As directed by the City Commission. FISCAL EFFECTS: The applicant has submitted the required fees for this action. Cash in lieu of parkland has been paid with this subdivision. Box 1230 Bozeman, Montana 59771-1230 phone 406-582-2260 fax 406-582-2263 planning@bozeman.net www.bozeman.net MEMORANDUM TO: CITY ATTORNEY’S OFFICE FROM: BRIAN KRUEGER, DEVELOPMENT REVIEW MANAGER SUBJECT: FINAL SUBDIVISION PLAT REVIEW BLOCK M PHASE 2 MAJOR SUBDIVISION, APPLICATION P14056 DATE: FEBRUARY 9, 2015 TD&H Engineering, on behalf of Block M, LLC have submitted an application to the City of Bozeman Department of Community Development for Final Plat review and approval for the Block M Phase 2 Subdivision to subdivide the 10.96 acres into 8 residential lots and one common open space lot. The City Commission granted preliminary plat approval on June 10, 2013. Attached is a copy of the signed Findings of Fact and Order. An Improvements Agreement is required for this subdivision for the installation of required infrastructure improvements. Based on the summary review provided below the Development Review Committee, the City Engineering Division, and Department of Community Development have reviewed the application against the conditions of preliminary plat approval; and as a result, find that the final plat application may be approved by the City Commission. Three (3) original mylars of the Final Plat, original Platting Certificate, copy of the property owners’association documents and a copy of the Findings of Fact and Order are attached for your review. The property owners’ association documents and other applicable documents will be recorded and filed with the final plat at the Clerk and Recorder’s Office. The Community Development staff respectfully requests that you prepare a City Attorney's Certificate using the attached original Platting Certificate; approve the Certificates of Director of Public Works and Certificate of Completion "as to form". The final City signatures will be obtained once the City Commission has approved the final plat. A complete application was submitted to the Community Development Department on February 2, 2015. Based on the applicant having submitted an application on February 2, 2015 for final plat review and approval, the 45-day (working days) review period for this final plat would expire on April 7, 2015. The conditions of preliminary plat approval, which are pertinent to this major subdivision, and how they have been met are described in the submittal materials. A subdivision improvements agreement was required for deferred infrastructure improvements. Staff has approved the agreements, the applicant has 17 Page 2 executed the guarantees and a financial guarantee that meets City requirements is pending and will be provided prior to final Commission approval. Note: The Community Development Department and Engineering Departments have also reviewed the final plat application against the preliminary plat cited code provisions and found compliance with these code requirements. The Engineering Department has also reviewed and approved the “closure” of the final plat.
