HomeMy WebLinkAbout02-24-15 Rounds Murphy Eminent Domain Public CommentFrom: Rolland Rounds To: Agenda Subject: Bridger Center Annexation file A13002 Date: Monday, February 23, 2015 4:46:17 PM February 23, 2015 To: Bozeman City Commissioners RE: Bridger Center Annexation file A13002 My wife and I are adamantly against providing Mr. Murphy access across property owned by the Bridger Creek Subdivision Community Association (BCSCA) for the following reasons: 1) It is our understanding that the use of eminent domain is to provide benefit to the public. If the request for access to Mr. Murphy’s property were granted the only person(s) to benefit would be Mr. Murphy and his project. If it was Mr. Murphy’s objective when he purchased the property to develop and build several homes he should have done due diligence before purchasing the property and realized that he would not have proper access for the type of development he was planning. 2) Is his objective simply to annex to the city so that he can access and obtain utilities? If so this can be accomplished via Commercial Drive. 3) The section of land in question has sensitive wetlands. Previous developments adjacent to this land had to address the issue of significant ground water. Additional development could exacerbate the ground water situation and cause a negative impact to the wetlands. With the ongoing issue of storm water drainage that the city is addressing would this area be useful in mitigating storm water? 4) Lastly, the additional traffic on Commercial Drive will have a negative impact on the commercial enterprises on that street and create additional difficulties for ingress and egress onto a very busy Bridger Canyon Drive, Thank you for reading our concerns.
