HomeMy WebLinkAbout15- Amendment No. 2 Morrison-Maierle Wastewater Collection System Facility Plan UpdateAMENDMENT NO. 2 TO PROFESSIONAL SERVICES AGREEMENT FOR WASTEWATER COLLECTION SYSTEM FACILITY PLAN UPDATE MMI. No. 417.072 THIS IS AN AGREEMENT made as of hhn ' EOL'S , 2015, between THE CITY OF BOZEMAN, a Municipal Corporation, P O ox 1230, Bozeman, Montana, 59771-1230 (OWNER) and Morrison-Maierle, Inc., P.O. Box 1113, Bozeman, Montana, 59771- 1113 (ENGINEER). WHEREAS the parties previously entered into a Professional Services Agreement dated March 17, 2014, herein referred to as the Original Agreement, for professional engineering services for the Wastewater Collection System Facility Plan Update; and WHEREAS, the scope of the Original Agreement included services for the plan update; and WHEREAS, the Original Agreement was amended with Amendment No. 1 dated October 20, 2014 to include additional services related to the City's Industrial Pre -Treatment Program and flow monitoring; and, WHEREAS, the parties desire to amend the Agreement to include more additional services related to the City's Industrial Pre -Treatment Program. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: The conditions and provisions set forth in the attached EXHIBIT C-3 — SCOPE OF SERVICES FOR INDUSTRIAL PRETREATMENT PROGRAM ASSITANCE and EXHIBIT D-3 - ENGINEERING FEE ESTIMATE FOR INDUSTRIAL PRETREATMENT PROGRAM ASSISTNAC are hereby incorporated in and made part of this Agreement. Article 1 - Enaineerine Services Section 1.5 is added to the Original Agreement as follows: 1.5 Services to assist the City with their Industrial Pretreatment Program as identified in Exhibit C-3. Article 6 - Compensation For Eneineerina Service Article 6.2.4.1 is amended as follows: 6.2.4.1 Payment. The OWNER shall for additional services performed in support of the Industrial Pretreatment Program a total not to exceed $56,464.00 under the direct labor cost basis identified in 6.2.4. Except as specifically amended herein, the Original Agreement shall remain in full force and effect and the parties shall be bound by all terms and conditions therein. BY: 7 jc'�_ (Vice -President) DATE:_ 3G-- \'S 2 0 1j_ Exhibit C-3 Additional Pretreatment Program Assistance City of Bozeman January 13, 2015 Scone of Services Based on the results of an EPA audit of the City's Pretreatment Program additional services have been requested. These include re -writing Significant Industrial User Permits, preparation of an Emergency Response Plan and assistance in updating the City Municipal Code relative to the industrial pretreatment program. Sianificant Industrial User Permits The city currently has issued permits to three SIUs. The existing permits were originally written over 20 years ago and edited over time. Since the permits were originally written, EPA has generated additional guidance and regulations. It is our recommendation that the permits be re- written starting with the EPA Model Permit. The scope of work includes preparation of a standard permit specific to the City of Bozeman and then using the standard permit to write individual permits for each of the three SIUs. The anticipated effort includes a review step for the standard permit and each of the individual permits. Enforcement Response Plan The City has prepared a draft Enforcement Response Plan that requires modifications. It is recommended that the Region 8 EPA Model Enforcement Response Plan be utilized as a base line to create an Enforcement Response Plan specific to the City of Bozeman. The scope of work includes preparation of a draft Enforcement Response Plan with input by city staff and preparing a final draft based on staff comments. Assistance in Updates to Bozeman Municipal Code — Chapter 40 Article 3 Division 4 Provide assistance and support as needed in updates to the Bozeman Municipal Code. Miscellaneous Coordination A small budget has been allocated for miscellaneous coordination with pretreatment staff. Budget has not been allocated for coordination with SIU's or formal correspondence with EPA.
