PUBLIC STREET AND UTILITY EASEMENT
SCHOOL DISTRICT NO.7, a political subdivision of the State
of Montana, with an address of 404 West Main Street, City of
Bozeman, County of Gallatin, State of Montana, and RICHARD and
BONNIE MILLIGAN, with an address of 2195 Weaver Road, Belgrade,
Montana 59714, hereinafter referred to as GRANTORS, in
consideration of $1.00 and for other and valuable consideration,
receipt of which is acknowledged, grants to the CITY OF BOZEMAN,
a municipal corporation of the State of Montana, with offices at
411 East Main, Bozeman, Montana 59715, GRANTEE, its successors
and assigns, a perpetual street and utility easement for the use
of the public, in, through, and across a strip of land situated
in Gallatin County, Montana, thirty (30) feet wide to be located
on the following described real property:
The easement is more particularly described on the attached
Exhibit A which by this reference is made a part hereof.
The location of said easement is as set forth in Exhibit B
attached hereto and incorporated herein by reference.
The GRANTORS state that they possess the real property
described above and that they have a lawful right to grant an
easement thereon.
The GRANTORS further agree that the GRANTEE may peaceably
hold and enjoy the rights and privileges herein granted without
any interruption by the GRANTORS.

The terms, covenants, and provisions of this easement shall
extend to and be binding upon the heirs, executors,
administrators, personal representatives, successors, and assigns
of the parties hereto.

EXHIBIT A
Easement No.2:
A public access and utility eaSement across a portion of land located in the South 12 of
Section 26, Township I South, Range 5 East, Principal Meridian Montana, Gallatin
County, Montana, as shown on Exhibit B, and being more particularly described as
follows:
Commencing at a point on the north-south mid-section line of said Section 26, said point
being the intersection of said mid-section line and the extended north line of Lot 4A,
Minor Subdivision No. 221A, as filed with the Gallatin County Clerk and Recorder, said
point also being the True Point of Beginning;
A strip ofland 30.00 feet wide lying south ofthe following described line:
Thence along the said extended line, South 89044'46" West a distance of 60.01
feet, more or less, to the northeast comer of said lot; Thence along the north line
of said lot, South 89044'46" West a distance of 405.07 feet, more or less, to the
west sideline of an existing 65 foot wide public access and utility easement shown
as North 2ih Ave. on Minor Subdivision No. 221A, as filed with the Gallatin
County Clerk and Recorder, and the end of the easement being described.
The length of the south sideline of said easement being adjusted, as required, so as to
begin on said north-south mid-section line and end on the existing west sideline of the
aforementioned 65 foot wide public access and utility easement. Said easement contains
0.32 acres, more or less.
