PUBLIC ALLEY EASEMENT
Owen house Hardware Company, GRANTOR, in consideration of$ 1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana 59715,
GRANl'EE, its successors and assigns, a perpetual alley and utility easement for the usc of the
public, in, through, and across a strip ofland situated in Gallatin County, Montana, 20.29 to 22.42
fect wide to be located on the following described real property:
Lot 22A ofAmcnded Plat C-23-A13, Block 32, Northern Pacific Addition to the City of Bozeman,
Montana.
The casement is more particularly described as follows:
Beginning at the northwest corner of said Lot 22A; thence N 87012' 53" E a distance
of 51.43 feet; thence S 000 20' 18" W a distance of 22.42 feet; thence S 89 () 35' 15"
W a distance of50.87 feet to a point on the west line of said Lot 22A; thence N 01 0
02' 33" W along said west line of Lot 22A a distance of 20.29 feet to the point of
beginning. Said eascment being 1092 square feet more or less, as depicted in the
attached Exhibit A which by this reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRAN'fOR further agrees that the GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors, and assigns ofthc parties
hereto.
