(minutes located below video screen in attachments area) RECOMMENDATION: Approve the Regular City Commission Minutes from January 26th as submitted. SUGGESTED MOTION: I move to approve the Regular City Commission Minutes from January 26th, 2015 as submitted. BACKGROUND: In 2013, The Clerk’s Office identified goals related to the Commission’s priority of Improving Technology Utilization and Proficiency. Improvement of: • Live streaming broadcast of the City Commission Meeting • Meeting efficiency • Better access of meeting information for Staff and the Public • Time savings • Streamlined approach to Citizen involvement and Public comment AV Capture was chosen as the Vendor to perform these services and was implemented. Since August of 2013, the City Commission Minutes have been linked with audio and video. Along with the City Commission, other City Advisory Boards are beginning to utilize the system as well. LOCATION: The AV Capture Archives and Live Streaming of City Commission Minutes and Meetings can be found at www.bozeman.net by choosing the City Commission Icon, with links located on the left hand side of the page under Watch Online! VIEWING: For first time users of the system, they will be prompted to install Shockwave and Silverlight to get the best viewing experience. The user will then find the meeting that they would like to view in the archives, click to view and then choose view session. The Draft Minutes from the meeting are located under the video in the Attached Documents area. The user will double click on the Word Document and the minutes will then appear. The user then can click on each hyperlink to find the section that they wish to view from the meeting. If the video does not automatically start at that point, the user may need to press play on the video itself. The City Commission Minutes are archived in a variety of ways due to State records retention guidelines. They are part of the Commission’s Meeting Packets as a DRAFT and are finally scanned with a wet signature and archived as a permanent record in electronic format. Both have separate retention times. Public Comment Mayor Krauss opened general public comment. Jerry Pape, Public Comment Mr. Pape spoke regarding salaries in Bozeman, growth rates, building permits being issued on property in Bozeman and student housing, self sufficiency and contributions to the tax base. Chris Naumann, Public Comment Mr. Naumann from the Downtown Bozeman Partnership spoke regarding new infill projects going on downtown. He also spoke regarding momentum and opportunity related to the new residential units being constructed downtown. He spoke regarding some inefficiencies with the City’s regulatory processes with the Neighborhood Conservation Overlay Districts. He has been working with Community Development on new NCOD design guidelines and would like something added for transitions of Commercial and Industrial uses. Bill Blackford, Public Comment Mr. Blackford stated that he is with Century Link. He has been working with the City of Bozeman with this proposed plan (Broadband). He spoke regarding the open source fiber network proposed which is like Century links proposal. He spoke regarding negotiations on fiber costs. He then discussed DSL and what they can offer. Special Presentation – Distinguished Budget Award (Krauss/Kukulski) Mayor Krauss presented Administrative Services Director, Anna Rosenberry with the City’s 24th Distinguished Budget Award from the GFOA. H. Action Items Consent 4. (Moved to Action) Resolution 4577, placing the Administrative and Supervisory Responsibilities for the Bozeman Parking Division within the Authority of the City Manager (Winn) Staff Presentation Assistant City Manager Chuck Winn gave the staff presentation for Resolution 4577, placing the Administrative and Supervisory Responsibilities for the Bozeman Parking Division within the Authority of the City Manager. Commission Questions for Staff The Commission and Staff discussed prior action of authority, anything else that may change the operations, specific statutes related to granting the Parking Commission authority, the current amount of employees, the question of the Parking Commission January 26, 2015 Bozeman City Commission Minutes Page 4 of 13 being self supporting, possible impacts on Human Resources, the employees being subject to the City purchasing rules, and entering contracts by the Parking Commission. Resolution 4576, Adopting the Bozeman Fiber Master Plan and Feasibility Study and Provide Policy Direction to Staff on Incorporating Elements of the Bozeman Fiber Master Plan and Feasibility Study into the Downtown and North 7th Avenue Tax Increment Finance Districts' Urban Renewal Plans and the City's Growth Policy (Fontenot) Staff Presentation Economic Director, Brit Fontenot opened the Staff presentation for Resolution 4576, Adopting the Bozeman Fiber Master Plan and Feasibility Study and Provide Policy Direction to Staff on Incorporating Elements of the Bozeman Fiber Master Plan and Feasibility Study into the Downtown and North 7th Avenue Tax Increment Finance Districts' Urban Renewal Plans and the City's Growth Policy. The Consultant then went through each detail of the Plan. 06:08:30 PM Commission questions for Staff The Commission and Staff discussed location in regards to residential loops, photonics, redundancy, reliability, new entity Bozeman Fiber as a non-profit and how it would work. Tax Increment Financing Districts support, fiber service encouraging entrepreneurs, attracting private companies, private funding, the question of over-building, the fact that the proposed services are broader based, the fact that services can be acquired now but for a high cost, overlap, fiber pathways, County interest, phasing, deadlines, anchor tenants, feasibility, timing of when Staff will be coming back to the City Commission, how other municipalities and the many ways to set this up, the many parts that go into this, community partners involvement, marketing the network, the reason for non-profit grants, the tax benefits with going as a Non-profit, advantages for grant funding, a conservative business plan, cash-in-lieu, early donors of capital (TIFs) and what they get, investing in infrastructure, the purpose of a TIF and the creation, capital interest, having a TIF seat at the table, TIF sun-setting, and the fact that networks like this allow businesses to grow and attract companies. January 26, 2015 Bozeman City Commission Minutes Page 5 of 13 06:32:19 PM Public Comment Mayor Krauss opened public comment. 06:32:32 PM Jerry Pape, Public Comment Mr. Pape spoke regarding creating another non-profit in Bozeman. Mr. Pape stated that he asked for bids from other providers and those returned were only $50 apart. He supports the initiative. He urged the Commission to avoid unintended consequence, find better connectivity, redundancy is importance, but to make sure everyone has a chance at the table. 06:36:04 PM Chris Naumann, Public Comment Mr. Naumann from the Downtown Partnership asked Commission to support and move forward. Mr. Naumann spoke regarding the downtown TIF and plans if this moves forward. The TIF district does look at this as a public piece of infrastructure. Encourages revisiting the plan. 06:37:47 PM Mike Hedgard, Public Comment Mr. Hedgard spoke in support and urged participation in the movement. He has been part of the steering committee for this proposal and the initiative is a good idea. He spoke regarding demands including a need for additional capacity and he encouraged adoption of the plan. 06:39:09 PM Jerry Sheehan, Public Comment Mr. Sheehan spoke regarding the railroad and economic development. MSU feels that redundancy is important and that there is a need to coordinate with the Campus. This keeps fiber traffic local and opens up working within the City. He spoke regarding the impact and what this means for the Schools and the importance of moving into phase 2. 06:41:47 PM Ken Stickler, Public Comment Mr. Stickler stated that the has a local business that would benefit from this and spoke regarding current speeds and current internet providers. His company is in strong support. 06:43:46 PM Richard Wardell, Public Comment Mr. Wardell stated that his company is looking at opportunities if this moves forward. All internet connections are not the same. He spoke regarding bandwidth and supports fiber networks. 06:46:08 PM Matt Fulton, Public Comment Mr. Fulton spoke regarding his business here in Bozeman and stated that a fast reliable network is promising, he is optimistic, there is talent here. 06:48:13 PM Joe Sawyer, Public Comment Mr. Sawyer spoke in regards to the Photonic companies in Bozeman. These companies rely on internet access, more and more bandwidth will be needed. There is a mission to grow this. He spoke in support and added that most big companies will be in phase 1. January 26, 2015 Bozeman City Commission Minutes Page 6 of 13 06:50:55 PM Cheryl Ridgley, Public Comment Ms. Ridgley from the hospital stated that they average 1 million medical procedures per year and strive to be a high reliable organization. This is important to our health care growth. She supports this effort. 06:52:26 PM Daryl Schliem, Public Comment Mr. Schliem from the Chamber stated that businesses here are requiring more services. We do recognize that we do not want this to be competitive but the City will not own it. This will allow us to be a better Bozeman and he strongly urges to move forward with this plan. 06:53:42 PM Stuart Leidner, Public Comment Mr. Leidner stated that he is one of the funding partners. There is a plethora of information in the plan. From an economic development perspective, something of this nature give us an advantage, this will help people grow their business. 06:55:25 PM Matt Johnson, Public Comment Mr. Johnson stated that 9 area leaders from banks in Bozeman met to discuss this. They spoke regarding investments by the banking industry. Many will support this initiative. 06:56:14 PM Dan Lee, Public Comment Mr. Lee encouraged the Commission to support this project. Some of his customers that are having issues with uploads. It is a big problem. The TIF districts, would encourage helping the blight. 06:58:08 PM Anthony Copenhaur, Public Comment Mr. Copenhaur reiterated the need for open access and from and economic standpoint, the benefits of the internet today is the most important public partnership. He supports good competitive practices. 06:59:45 PM Brad Summers, Public Comment Mr. Summers spoke regarding the Erate process and that is is a tough process to go through. 07:01:00 PM Jim Dolan, Public Comment Mr. Dolan thanked the City and stated that he likes the way this is being implemented. He does feel that there is a competitive issue. His company provides fiber. He believes that this is a good idea but has concerns that we are going at this the wrong way. He also has some concerns with the engineering. He urged the City to spend a little more time on this. Make sure something hasn’t been missed. 07:04:43 PM Public Comment Closed. January 26, 2015 Bozeman City Commission Minutes Page 7 of 13 07:05:28 PM Motion that having considered all materials, written and spoken public comments, and recommendations of staff, I move to approve Resolution 4576 adopting the Bozeman Fiber Master Plan and Feasibility Study and direct staff to immediately proceed with implementation planning and engineering for Phase I with a goal of constructing Phase I in summer 2015 and direct staff to continue collaborating with the Bozeman Public Schools and private financing partners to fund the construction of Phase II. Commissioner - Chris Mehl: Motion Commissioner - I-Ho Pomeroy: 2nd 07:06:17 PM Commission Discussion Cr. Mehl thanked staff and stated that this began in 2012. He spoke regarding the prior survey and public comment and that there is an overwhelming need to do this. He spoke regarding competition, he is struck with the goals and objectives, speed, functionality but we are talking about equal access to anyone that is a residence or business. He leans towards a non-profit. It is important that this be scalable and the ability to have local control. Good idea to have local financing. Many other cities are doing this and gave Butte as an example and spoke regarding Missoula. There is a demand for this. The Performa is fairly conservative. He hopes that the schools are in. Need to present ourselves as the equals of large cities such as Seattle. Cr. Pomeroy stated that in 2012 the City created a Steering committee and she agrees with Cr. Mehl. She agrees that this will create a separate entity, the County and users will cover the infrastructure and city will not take a risk, there is a need for the information infrastructure, and this will attract big paying jobs here. She supports. Mayor Krauss- spoke regarding prior involvement. He spoke regarding the use of TIF money and the TIF on North Seventh. He stated that it would be wise for them to borrow and extend the TIF and put in the fiber, sidewalks and lights. The time is right to do that. Cities exist to facilitate commerce and create wealth. Governments provide infrastructure, and he sees this in this way. He has some caveats with TIF money and non-profits. This seems to be the right thing to do. Doesn’t want to over promise, it will drive the economy in Bozeman. Cr. Andrus supports the plan. Broadband and fiber are the 21st Century and it is a good plan. The Mayor made good comments about the TIF and financing. Cr. Taylor stated he has given a lot of thought. He appreciates the time and energy that has gone into this and spoke regarding competing. There is a need to take the step forward, always concerned about unintended consequences are. Just have to rely on the people you appoint and trust. Great example of where government works and is good for a community. Commissioner - Chris Mehl: Motion Deputy Mayor - Carson Taylor: 2nd 07:33:02 PM Commission Discussion on the Amendment Mayor Krauss stated that he wants the TIF’s to weigh in with what we are changing with their policies. Cr. Mehl stated it is his assumption consultation with both TIFs will occur and is assuming TIFs will have a seat at the table to participate with the entity that runs this fiber. They will formalize when the shape of the entity comes to the commission. Cr. Andrus asked if it is possible to meet at an earlier time with the TIFs. Cr. Pomeroy stated that this plan is already approved by the TIF. Cr. Mehl added that changes in the Urban Plans can run concurrently. 07:43:44 PM Clarification on the Amendment Even though the TIFs have voted to give the money, changes to the Urban Renewal Plans should go to the TIFs first and the Commission, but it shouldn’t slow things down. These can run concurrently. Before the Ordinance comes before the Commission changing the Urban Renewal Plan for each district, notice the TIF districts beforehand so that they have input before coming to the Commission. 07:45:46 PM Vote on the Amendment to the Main Motion to add “upon the recommendation of the (Tax Increment Financing) TIF Boards, so that it goes to the TIF Boards and then comes back to the Commission” with the clarification that before an Ordinance changing the Urban Renewal Plan for each district is reviewed by the Commission, the TIF districts be noticed beforehand and have input before coming to the Commission. We are butting up against Neighborhood overlay. Temporary changes until consultant comes in. Express what is in downtown. We want B3 to fill out B3. Will be on the agenda in the future. 08:34:01 PM Cr. Andrus Cr. Andrus stated that her concern is parking Downtown and the need to look at a future parking analysis. The 911Radios are one of her concerns as well. There is a partnership that needs to occur with the County. 08:36:07 PM Deputy Mayor Taylor Deputy Mayor Taylor spoke regarding Policy decisions of what we know today, and prioritize those. He spoke regarding the Landfill, strategic planning and the Unified Development Code. 08:46:58 PM Cr. Mehl Cr. Mehl spoke regarding his list and the UDC design and the fact that the Chamber has money to assist. Push community plan back to do this. 08:54:21 PM Mayor Krauss Mayor Krauss spoke regarding the need to adopt an Urban Forestry Plan, the justice center and the need to look at how many of these things we want to stretch the tax base with. Figure a number on each of these. There are a lot of big ticket items. Need to think about those. Look at the accumulative effect. 08:59:51 PM Cr. Pomeroy Cr. Pomeroy spoke regarding the Law and Justice center and what she has heard from January 26, 2015 Bozeman City Commission Minutes Page 12 of 13 voters including that they want to see collaboration with the County. He spoke regarding cost benefits and yielded needs or wants. The question is who do I serve? That is the real issue. Salary range, it is the target, not building jobs. The mistake with the L&J is that the county used a single appraiser and they over valued the property. The offer was way under what it was worth. He would like to know if the Commission wants to add this on the agenda to take a position on it. He would like to see some kind of compromise to support this industry.
