RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby release and
reconvey the following described casement unto Owenhouse Hardware Company ("GRANTEE")
as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a utility easement situated
across a vacated portion of Ida A venue, City of Bozeman, Gallatin County, Montana.
WHEREAS the Grantee is the legal record title holder of Lot 22A of Amended Plat C-23-
A13, Block 32, Northern Pacific Addition to the City of Bozeman, Montana.
WHEREAS the above utility easement was reserved with the vacation of Ida A venue
that was ordained by Ordinance No. 1301 of the City Commission of the City of Bozeman,
Montana.
WHEREAS said Lot 22A is adjacent to the vacated portion of Ida Avenue that was
vacated by said Ordinance No. 1301.
WHEREAS there are no known utilities occupying said vacated Ida Avenue, and there is
no known need for occupancy of said Ida A venue in the future, the release of any of the utility
easement reserved via said Ordinance No. 1301 will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Owenhouse Hardware
Company those portions of the utilitv easement located on the east 12 of the right~of-way of
Ida Avenue that was vacated via said Ordinance No. 1301.
