SUBJECT: Amendment No. 4 to Professional Services Agreement for the North 7th
Avenue Lighting Design and Construction

RECOMMENDATION: Approve and authorize City Manager to sign Amendment No. 4 to
the Professional Services Agreement for the North 7th Avenue Lighting Design and Construction.
BACKGROUND: On July 11, 2010 the Bozeman City Commission approved a professional services agreement with Morrison Maierle for the North 7th Avenue Lighting Design and
Construction. This contract was for $115,861.86 and included provisions for preliminary design,
final design, picture renderings of the proposed lights within the corridor, bidding, and
construction management services for phase one of the project. The original contract included
contingencies to allow the agreement to be modified to include future design work as the lighting project was phased to the south towards Main Street.
Since the original there have been three previous amendments to the original contract. These
amendments included services for right of way investigation, easement drafting, change in
lighting designs, design and construction administration for phase two, and other miscellaneous services that have been requested by the North 7th Urban Renewal Board (NSURB). To date, the
original contract and the previous three amendments total approximately $260,400.00.
This proposed amendment no. 4 is for the preparation of easement documents for the remainder
of the North 7th Avenue corridor (Durston to Main). This will allow for the Board to adequately plan for phase three of the lighting project. The proposed amendment would require an
additional $17,542.00 of NSURB funding.
At their January 8, 2015 meeting, NSURB was informed about the proposed amendment and the
affiliated cost of $17,542.00. The Board found the amendment work to fall under the parameters

of the already approved engineering work for the street light project a part of their FY2015
approved budget. Engineering staff has reviewed the amendment and found it to be acceptable.
FISCAL EFFECTS: The NSURB Work Plan and Budget has set aside funds for engineering design services and construction for the second phase of the North 7th Avenue
lighting project their FY 2015 budget and can cover the proposed price of amendment no. 4.
ALTERNATIVES: As suggested by the City Commission.
