RELEASE AND RECONVEYANCE OF EASEMENTS

COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a
Municipal Corporation of the State of Montana hereinafter ("GRANTOR") and
does hereby release and reconvey the following described easements unto Louis R.
and Charline R. Spain of 77 Centennial Trail, Bozeman. MT 59715
("GRANTEES") as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a water pipeline
right-of-way easement situated across Tract 12 and the south half of Tract 11,
Sourdough Hills Subdivision. located in the southwest quarter of Section 29.
Township 2 South. Range 6 East. M.P.M., Gallatin County, Montana.
WHEREAS the above utility easement was granted July 14, 1916 and
recorded on Page 407. Record of Deeds Volume 54, at the Clerk and Recorder's
Office of Gallatin County, Montana.
WHEREAS the construction of a water transmission main has been
completed without having to occupy said easement recorded on Page 407. Record
of Deeds Volume 54. and the water pipeline that occupies said easement has been
abandoned and is no longer in use, the vacation of all of the water pipeline right-of-
~ easement recorded on Page 407. Record of Deeds V olwne 54 will not
adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Louis R.
and Charline R. Spain those portions of the water pipeline right-of-way easement
located on the above described real property as set forth on Exhibit A "shaded area"
attached hereto together with any right, title, or interest that the Grantor may have in
said water pipeline right-of-way easement as set forth on Exhibit A attached hereto
and incorporated herein by reference as though fully set forth and described as
follows:
"Abandon water pipeline right-of-way easement to the City of Bozeman as
previously recorded on Page 407. Record of Deeds Volume 54. across Tract
12 and the south half of Tract II. Sourdough Hills Subdivision. located in
the southwest quarter of Section 29. Township 2 South, Range 6 East.
M.P,M,. Gallatin County, Montana."
