PUBLIC STREET EASEMENT AND EASEMENT RELEASE

SANDAN, L.L.C., GRANTOR, in consideration of $ 1.00 and for other and valuable considerations, receipt of
which is acknowledged, grants to The Citv of Bozeman, a municipal corporation of the State of Montana, with
offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its successors and assigns, a perpetual street and
utility easement for the use of the public, a parcel of land situated in Gallatin County, Montana, to be located on the
following described real property: Lot lA of Minor Subdivision No. 145A, located in the Northwest Quarter and
the Southwest Quarter of Section 35, Township 1 South, Range 5 East, P.M.M., Gallatin County, Montana.
The easement is more particularly described on the attached Exhibit(s) Band C, which by this reference is
made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has a lawful right to
grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges
herein granted without any interruption by the GRANTOR.

The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives, successors, and assigns of the parties hereto.
The City of Bozeman hereby releases all of its interest in a portion of the Public Street and utility easement
recorded in Document #2034527, the released area being more particularly described in the attached Exhibits A and
C, by which reference is made a part hereof.

lot being located in the Northwest Quarter and Southwest Quarter of Section 35, Township 1
South, Range 5 East, P.M.M., Gallatin County, Montana:
Commencing at the west ~ comer of said Section 35, thence North 89044'48" East, a distance of
50.00 feet to a point on the east line of the easement described in Document #2034526 of Gallatin
County records; thence North 00009'17" East, along the said east line, a distance of53.45 feet, to
the Point of Beginning; thence North 89044'48" East,.a distance of398.52 feet to the point of
curvature ofa curve to the left, having: a radius of267.50 feet, a central angle of30007'07", a
chord bearing of North 74041' 14" East, and a chord length of 139.00 feet; thence along the arc of
