G. 06:08:22 PM Action Items 1. 06:08:29 PM Goldsmith request for Sewer and Water Service Outside City Limits, 2521 West Babcock Street (Woolard) K� a 06:08:31 PM Staff Presentation Public Works Director Craig Woolard gave the staff presentation for the Goldsmith request for Sewer and Water Service outside City Limits, 2521 West Babcock Street. 06:09:49 PM Commission questions for Staff The Commission and Staff discussed the possibility of the applicant deciding not to annex and how it will be monitored, the reason for the timeframe of a year, the amount of time that an annexation request takes, the amount of the fees to be paid for the connection, the timing of the payment of the impact fees and impacts to the streets in the future with development. 06:19:24 PM Applicant Presentation Mr. Goldsmith gave the applicant presentation for a request for Sewer and Water Service outside City Limits, 2521 West Babcock Street. 06:20:39 PM Public Comment Mayor Krauss opened public comment. Mayor Krauss closed public comment. 06:20:48 PM Motion to approve the request to allow the residence at 2521 West Babcock to connect to the city water and sewer system prior to annexation subject to conditions recommended in this report. Commissioner - Cynthia Andrus: Motion Deputy Mayor - Carson Taylor: 2nd Page 3of10 Jan"aty 5,2015 Bozeman City'Commission Ifin"tes 06:21:13 PM Commission discussion on the Motion Cr. Andrus stated that this is not ordinary but in this case, it is a matter of public health. She will support the motion. Deputy Mayor Taylor stated that he is glad we are doing this now and spoke about adding the hookup to water in the language. Cr. Pomeroy stated that the City County Health Department will most likely not issue a permit and she supports this project. Mayor Krauss stated that we have done this 3 to 4 times in the past with these types of emergencies. Mayor Krauss closed public comment. 06:31:19 PM Motion that having reviewed and considered the application materials, public comment, and all the information presented, I hereby adopt the findings presented in the staff report for application Z14321 and move to recommend approval of the zone map amendment with contingencies. Deputy Mayor- Carson Taylor: Motion Commissioner- Chris Mehl: 2nd 06:31:42 PM Commission Discussion Deputy Mayor Taylor stated the area is surrounded by R-4 already and he saw this at the Wetlands Review board. Nice project; let them do it. Cr. Mehl stated that he agrees with the staff analysis and this complies with the criteria for City and State rules. This is density and close to high employment area. He supports. Cr. Pomeroy stated that high density is good for shopping area. She supports. Mayor Krauss urged the developer to be sensitive to the park to the west. R-3 is default and this is a little higher density but makes sense and is in close proximity to retailers. 06:34:23 PM Vote on the Motion that having reviewed and considered the application materials, public comment, and all the information presented, I hereby adopt the findings presented in the staff report for application Z14321 and move to recommend approval of the zone map amendment with contingencies. Commissioner- Chris Mehl: Motion Deputy Mayor - Carson Taylor: 2nd 07:01.09 PM Commission discussion on the Motion Cr. MehI has concerns about the fee when staff was going to do this anyways. City already has this, why have the applicant pay? The City plays by own rules and we ask others to as well. He had the indication that the staff was going ahead. Mayor Krauss doesn't see it that way. We impose standards and this is an issue of timing and if we split this part, split the other part as well. Symbolism is important. He gave the sand building and cemetery as examples. Deputy Mayor Taylor troubled that they had to go through the variance process and do this, seems like double duty. Wondered if there was another project proposed in order to do this? Applicant stated no. Commissioner - Chris Mehl: Motion Commissioner- 1-Ho Pomeroy: 2nd 07:14:23 PM Commission discussion on the Motion Cr. Mehl stated that he supports this. He did have concerns about parking of larger vehicles. He is convinced that others have adopted these same standards. He is more impressed with the infill. This is viability for downtown. Cr. Pomeroy supports the infill and creation of an environment for more density. Cr. Andrus stated that she supports and that text amendments continue to go through this body. Mayor Krauss stated that he supports, but he can't park in the little tiny spots anymore. We are cutting 6ft out of maneuver. We need to be careful about not sending a message about tighter standards that states we only want small vehicles downtown.
