RELEASE AND RECONVEYANCE OF EASEMENT(S)
COMES NOW the City of Bozeman, 121 North Rouse Avenue, P.O. Box 1230, Bozeman, MT
59771, a Municipal Corporation of the State of Montana, GRANTOR, and does hereby release
and reconvey the following described easement(s) unto Keith P. O'Reilly and Deborah L.
O'Reilly, with a mailing address of P.O. Box 11145, Bozeman, MT 59719, described as follows:
A portion of a 30 foot wide sewer and water pipeline access easement and agreement that runs
east-west across a portion of Lotl, Block 2, Meadow Creek Subdivision, Phase 1, [Plat J-453],
as shown on Exhibit A, Sewer and Water Pipeline Easement, Document No. 2307996, on file
and of record in the office of the Clerk and Recorder, Gallatin County, Montana.
WITNESSETH
WHEREAS the Grantor is the legal record title holder of the portion of the 30 foot wide
sewer and water pipeline access easement and agreement easement that runs east-west in the
north part of said Lott, Block 2, as shown on as shown on Exhibit A, Sewer and Water Pipeline
Easement, Document No. 2307996.
WHEREAS approximately 170 feet of water main was abandoned and moved
approximately 22 feet south, no longer occupying a portion of said easement recorded in
Document No. 2307996, and making that portion of said easement unnecessary, and the vacation
of said easement will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Keith P. O'Reilly and
Deborah L. O'Reilly, those portions of the easement(s) located on the above described real
property as set forth on the attached Exhibit A, incorporated herein by reference, together with
any right, title, or interest that the Grantor may have in said easements as set forth on said
Exhibit A.
