C5 Res 4578 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Chris Saunders, Policy and Planning Manager Wendy Thomas, Director of Community Development SUBJECT: Commission Resolution 4578 finding that the Bozeman Community Plan remains adequate to present community needs with Section 1 to read as recommended in Alternative 2 memorializing review of the Bozeman Community Plan (growth policy) and determining its continued adequacy to community needs. MEETING DATE: February 2, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approval BACKGROUND: The Bozeman Community Plan (BCP) was adopted by the Commission through Resolution 4196 on June 1, 2009. The BCP is the specific title for the current version of the growth policy for the City of Bozeman. State law requires that a growth policy be reviewed for adequacy every five years. City staff undertook the required review in fall of 2014. The Planning Board considered the matter at a public meeting on December 16, 2014 and recommended that the plan remain as presently adopted. The City Commission held a public meeting on January 12, 2015 and determined that the plan remained adequate to community needs. The Commission also expressed a desire to establish a time frame for when the next update to the plan should begin. The motion directing staff to return with this resolution included some specific direction regarding fiscal year 2016. Staff recommends the resolution to have more generalized language which would allow such a schedule should the Commission so choose, but would provide latitude for Commission scheduling of work priorities as well. Alternative language is provided below. UNRESOLVED ISSUES: None. ALTERNATIVES: 1) Approve resolution as written. 2) Approved resolution with alternative language in Section 1 to read “The Bozeman Community Plan is adequate to the present needs of the community and shall remain in effect. The City shall undertake an update to the Bozeman Community Plan within the next three fiscal years as scheduled and budgeted for by the City Commission.” 3) Alternative language as recommended by the City Commission. 71 FISCAL EFFECTS: No existing budget items will be affected by this ordinance. Additional costs will be incurred at the time the growth policy update is undertaken. Attachments: Resolution 4578 Report compiled on: January 22, 2015 72 Page 1 of 3 COMMISSION RESOLUTION NO. 4578 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, TO MEMORIALIZE THE REVIEW OF THE BOZEMAN COMMUNITY PLAN AND DETERMINE ITS ADEQUACY FOR CONTINUED UTILIZATION. WHEREAS, the City of Bozeman has had a comprehensive plan (growth policy) since 1958; and WHEREAS, the City of Bozeman adopted it current growth policy known as the Bozeman Community Plan (BCP) through Resolution 4163 on June 1, 2009; and WHEREAS, the authorizing statutes for growth policies require a growth policy to include a timeline for implementation and a description of conditions requiring its review; and WHEREAS, the authorizing statutes for growth policies further require a growth policy to be reviewed for adequacy at least every five years; and WHEREAS, Chapter 17 of the BCP establishes criteria for reviewing the BCP and determining whether it remains adequate to the needs of the community; and WHEREAS, the City’s staff initiated the required review of the growth policy in 2014; and WHEREAS, a public meeting was held by the Planning Board on December 16, 2014 to consider the matter and make a recommendation to the City Commission which recommendation was that the growth policy as presently constituted is adequate to the community’s needs; and 73 Resolution 4578, Review of the Bozeman Community Plan Page 2 of 3 WHEREAS, the City Commission held a public meeting on January 12, 2015 to receive the report of the Staff and Planning Board regarding the adequacy of the existing growth policy; and WHEREAS, after considering public comment, the recommendation from the Planning Board, and the staff report the City Commission found that the Bozeman Community Plan does presently meet the needs of the community. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 The Bozeman Community Plan is adequate to the present needs of the community and shall remain in effect. The City shall undertake an update to the Bozeman Community Plan beginning in Fiscal Year 2016 if so scheduled and budgeted for by the City Commission. Section 2 PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 2nd day of February 2015. ___________________________________ JEFFREY K.
