C4 Backcheck Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Brian Heaston, Project Engineer SUBJECT: Authorize the City Manager to sign a Release and Reconveyance of Easement unto Backcheck LLC removing an existing public access easement from Lot 12, Gallatin Park Subdivision, and to also sign a new public access easement as Grantee with Backcheck LLC as Grantor providing for a shared access and fire turnaround for and between Lot 12 and Lot 13 of Gallatin Park Subdivision. MEETING DATE: February 2, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign a Release and Reconveyance of Easement unto Backcheck LLC removing an existing public access easement from Lot 12, Gallatin Park Subdivision, and to also sign a new public access easement as Grantee with Backcheck LLC as Grantor providing for a shared access and fire turnaround for and between Lot 12 and Lot 13 of Gallatin Park Subdivision. BACKGROUND: An existing public access easement is situated upon Lot 12 of Gallatin Park Subdivision. Lot 12 is currently vacant, but recently received final site plan approval from the City and will be developed. Upon review and approval of the final site plan it was determined that the existing public access easement on the property is no longer necessary. The Release and Reconveyance of Easement document removes the easement encrumbance from the title record of the parcel. Furthermore, upon review and approval of the final site plan, it was determined that a new public access easement is necessary to provide for a shared access and fire turnaround with the neighboring Lot 13 of Gallatin Park Subdivision. Both Lot 12 and Lot 13 are currently owned by Backcheck LLC. UNRESOLVED ISSUES: None. ALTERNATIVES: As suggested by the City Commission.
