EILEEN TORGERSON, of 1103 S. Willson, Bozeman, Montana 59715, herein referred to as
GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable consideration, receipt of
which is acknowledged, grants to the City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman Montana 59715, GRANTEE, its successors and assigns, an
easement for public drainage purposes, in, through and across the following described real property
situated in Gallatin County, Montana, more particularly described as follows and on the attached Exhibit
"A":
Lot II of Grafs 2nd Subdivision, City of Bozeman, Gallatin County, Montana
The easement is more particularly described as follows:
Beginning at the eastern most comer of Lot 11, Grafs Second Subdivision, situated in the SE 1/4 of Section 18,
Township 2 South, Range 5 East, M.P.M, City of Bozeman, Gallatin County, Montana, said comer also being
located on the right-of-way line of O'Connell Drive; thence southerly along said right-of-way line along a curve to
the left with a radius of 173.2 feet, a central angle of21 020' 52", an arc distance of64.5 feet; thence N 41031' W a
distance of 40.1 feet; thence along a curve to the right with a tangent bearing ofN 90 45' 53" E, a radius of 202.66
feet, a central angle of 1706' 47", an arc distance of 60.5 feet more or less to a point on the easterly property line of
said Lot 11; thence along said easterly property line a distance of33.8 feet more or less to the point of beginning,
said easement containing an approximate area of 1,914.7 square feet.
The GRANTOR warrants that she is lawfully seized and possessed of the real property described above,
that she has a lawful right to convey the property, or any part of it, and that she will forever defend the
title of the property against the claims of all persons. The GRANTOR further agrees that the GRANTEE
may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the
GRANTOR.
The terms, covenants and provisions ofthe easement and agreement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors and assigns ofthe parties hereto.
