TEMPORARY CUL-DE-SAC EASEMENT
H01\1E DEPOT U.S.A., INC., Owner, a Delaware corporation, GRANTOR, in
consideration of the receipt of One Do llar ($1.00) and for other valuable consideration, receipt of
which is hereby acknowledged, does hereby grant to the City of Bozeman, a municipal
corporation of the State of Montana, with offices at 411 East Main Street, P.O. Box 1230,
Bozeman, Montana 59771-1230, GRANTEE, a temporary street right-of-way for a temporary
cul-de~sac easement for use by the public in, through, and across a strip of land situated in
Gallatin County, Montana, and more particularly described on the attached Exhibit A which by
this reference is made a part hereof.
The GRANTOR states that it possesses the real property described above and that it has a
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The GRANTEE agrees that this easement shall be automatically vacated upon further
extension of the street.

Temporary Culdesac Easement
A Temporary Cul.de-sac Easement over that portion of Lot 2 of C.O.S. 2089, in the N.E. 1,4 of
Section 2, T.2S., R.5E., P.M.M., Gallatin County, Montana, lying within the following described
line:
Commencing at the most Westerly corner of said Lot 2; thence N.89045'lO"E., along the
North line of said Lot 2, 877.67 feet to an angle point in the North and West line of said
Lot 2; thence S.16c26'50"W. 6.73 feet to the Point of Beginning of this Easement
description and the beginning of a curve to the left the radius of which bears
S.08048'58"E., a distance of 50.00 feet; thence along said curve to the left, through a central
angle of 244048'14", an arc distance of213.63 feet to the Southerly right of way line of future
Tschache Lane and the beginning of a curve to the right the radius of which bears N .07054'01 "E.,
a distance of 280.00 feet; thence along said curve to the right, through a central angle of
08032'49", an arc distance of 41.77 feet; thence N.73033'10"W., 29.73 feet; thence
N.16c26'50"E., 48.27 feet to the Point of Beginning.
