QUIT CLAIM DEED
FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged,
the undersigned, Double S. Holdings, LLC, doing business as MacKenzie River Pizza, at 145
Rawhide Ridge Road, Bozeman, Montana 59718, do hereby remise, convey, release and forever
quit claim unto the City of Bozeman, a political subdivision of the State of Montana, P.O. Box
1230, Bozeman, Montana 59771-1230, the Grantee, all of its right, title and interest including all
future interests, ifany, including all future interests in and to a strip of land located in, through
and across Lot 1, Tract 5 of the Gardener-Simmental Plaza Subdivision located in the Southeast
Quarter of Section 35, Township 1 South, Range 5 East, P.M.M. City of Bozeman, Gallatin
County, Montana, and as shown on the Right of Way Plan for Montana State Highway Project
No. RS 235-1(2)7 on file with the office of the Gallatin County Clerk and Recorder being more
particularly described as follows:
Beginning at a point, said point being at the intersection of the south line of said
Lot 1 and the East right-of-way line of North 19th Avenue,; thence North 0019'23"
East along said line, a distance of 49.38 feet; thence South 2909'37" East, a
distance of32.63 feet; thence South 60c53'55" East, a distance of 42.30 feet to the
South line of said Lot 1; thence South 89039'51" West along said line, a distance
of 5 3 .14 feet to the point of beginning.
Said strip of land containing 949 square feet, more or less.
THE PARTIES hereto acknowledge that this deed is executed under the threat of
condemnation and, therefore under ~76-3-201(1)(a), is exempt from all subdivision
requirements.
