QUIT CLAIM DEED
FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged,
the undersigned, Timothy H, and Naomi Rigby, Grantors, residing at 2521 West Babcock Street,
Bozeman, Montana 59718 do hereby remise, convey, release and forever quit claim unto the
City of Bozeman, a political subdivision of the State of Montana, P.O. Box 1230, Bozeman,
Montana 59771-1230, the Grantee, all of their right, title and interest including all future
interests, if any, in and to the real property situated in the County of Gallatin, State of Montana
and which is described as follows:
A tract of land located in the Northeast Quarter of Section 11, Township 2 South,
Range 5 East, P.M.M., Gallatin County, Montana, being more particularly
described as follows:
A strip of land being 32.50 feet wide, lying on the south side of a line that is
lengthened or shortened, as required, to terminate on the east and west lines of
Lot 1, Block 2 of the Farwestem Subdivision, as filed with the Gallatin County
Clerk and Recorder, said line being parallel to and 32.50 distant, northerly, when
measured at right angles from the following described line:
Beginning at a point on the south line of the said Northeast Quarter, being the
southerly projection of the said east line of Lot 1, Block 2 of the Farwestem
Subdivision, said point bearing North 890 11' 19" West a distance of 2,309.42
feet, more or less, from the east quarter corner of said Section 11; thence
continuing along the south line of the Northeast Quarter, North 890 11' 19" West
a distance of 135.00 feet, more or less, to a point being the southerly projection of
the said west line of Lot 1, Block 2 of the Farwestern Subdivision, and the end of
the line herein described.
Said strip of land containing 4,388 square feet, more or less.
THE PARTIES hereto acknowledge that this deed is executed under the threat of
condemnation and, therefore under ~76~3-201(1)(a), is exempt from all subdivision
requirements,
