QUIT CLAIM DEED
FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged,
the undersigned, Steven L, Wenzel and Susan }, Smiley, Grantors, residing at 2502 West
Babcock Street, Bozeman, Montana 59718 do hereby remise, convey, release and forever quit
claim unto the City of Bozeman, a political subdivision of the State of Montana, P.O. Box 1230,
Bozeman, Montana 59771-1230, the Grantee, all of their right, title and interest including all
future interests, if any, in and to the real property situated in the County of Gallatin, State of
Montana and which is described as follows:
A tract of land located in the Southeast Quarter of Section 11, Township 2 South,
Range 5 East, P.M.M., Gallatin County, Montana, being more particularly
described as follows:
A strip of land being 32.50 feet wide, lying on the north side of a line that is
lengthened or shortened, as required, to terminate on the east and west lines of
that parcel of land conveyed from Unity Church of Christianity to Steven L.
Wenzel and Susan J. Smiley, by deed dated April 27, 1990, recorded on Film 110,
page 2885, with the Gallatin County Clerk and Recorder, said line being parallel
to and 32.50 feet distant, southerly, when measured at right angles from the
following described line:
Beginning at a point on the north line of the said Southeast Quarter, being the
northerly project of the said west line of that parcel from Unity Church of
Christianity to Steven L. Wenzel and Susan J. Smiley, said point bearing South
890 11' 19" East a distance of 3,056.18 feet, more or less, from the west quarter
corner of said Section 11; thence continuing along the north line of the said
Southeast Quarter, South 890 11' 19" East a distance of 85.11 feet, more or less,
to a point being the northerly projection of the said east line of that parcel from
Unity Church of Christianity to Steven L. Wenzel and Susan J. Smiley, and the
end of the line herein described.
Said strip of land containing 2,768 square feet, more or less.
THE PARTIES hereto acknowledge that this deed is executed under the threat of
condemnation and, therefore under ~76-3-201(1)(a), is exempt from all subdivision
