QUIT CLAIM DEED
FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged,
the undersigned, Conrad Yerger, Jr. and Lillian M. Yerger, Grantors, residing at 2604 West
Babcock Street, Bozeman, Montana 59718 do hereby remise, convey, release and forever quit
claim unto the City of Bozeman, a political subdivision of the State of Montana, P.O. Box 1230,
Bozeman, Montana 59771-1230, the Grantee, all of their right, title and interest including all
future interests, if any, in and to the real property situated in the County of Gallatin, State of
Montana and which is described as follows:
A tract of land located in the Southeast Quarter of Section 11, Township 2 South,
Range 5 East, P.M.M., Gallatin County, Montana being more particularly
described as follows:
A strip of land being 32.50 feet wide, lying on the north side of a line that is
lengthened or shortened, as required, to terminate on the east and west lines of
that parcel of land conveyed from VanderMolen, et.al. to Yerger, et.aL by deed
dated July 15, 1964, recorded in Book 151, Page 253 with the Gallatin County
Clerk and Recorder, said line being parallel to and 32.50 feet distant, southerly,
when measured at right angles from the following line:
Commencing at the west quarter comer of said Section 11; thence along the north
line of the said Southeast Quarter, South 890 11' 19" East, a distance of 2,645.81
feet, more or less, to the northwest comer of said parcel from VanderMolen to
Yerger, and the true point of beginning; thence continuing along the north line of
the Southeast Quarter, South 890 11' 19" East a distance of 99.00 feet, more or
less, to the northeast comer of said parcel from VanderMolen to Yerger, and the
end of the line herein described,
Said strip of land containing 3,217 square feet, more or less.
THE PARTIES hereto acknowledge that this deed is executed under the threat of
condemnation and, therefore under ~76-3-201(1)(a), is exempt from all subdivision
requirements.
