QUIT CLAIM DEED
FOR V ALUABLE CONSIDERATION, the receipt of which is hereby acknowledged,
the undersigned, Stephens Enterprises Limited Partnership, Grantor, does hereby remise,
convey, release and forcver quit claim unto the City of Bozeman, a political subdivision of the
State of Montana, P.O. Box 1230, Bozeman, Montana 59771-1230, the Grantee, all of its right,
title and interest including all future interests, if any, in and to the real property situated in the
County of Gallatin, State of Montana and which is described as follows:
A tract of land located in the Southeast Quarter of Section 11, Township 2 South,
Range 5 East, P.M.M., Gallatin County, Montana, being more particularly
described as follows:
A strip of land being 32.50 feet wide, lying on the north side of a line that is
lengthened or shortened, as required, to terminate on the east line of that parcel of
land conveyed from the James W. Stephens and Mabel L. Stephens to Stephens
Enterprises Limited Partnership, described as Parcel I by deed dated March 13,
1997, recorded on Film 172, Page 389, as filed with the Gallatin County Clerk
and Recorder, and the west line of that parcel of land conveyed from James W.
Stephens and Mabel L. Stephens to the Stephens Enterprises Limited Partnership,
described as Parcel II by said deed, said line being parallel to and 32.50 feet
distant, southerly, when measured at right angles from the following described
line:
Beginning at a point on the north line of the said Southeast Quarter, being the
northerly projection of thc said west line of Parcel II from Stephens to Stephens
Enterprises Limited Partnership, said point bearing South 890 II' 19" East, a
distance of 3,246.22 feet, more or less, from the west quarter corner of said
Section 11; thence continuing along the north line of the Southeast Quarter, South
890 II' 19" east a distance of 389.83 feet, more or less, to a point being the
northerly projection of the said east line of Parcel I from Stephens to Stephens
Enterprises Limited Partnership, and the end ofthe line herein described.
Said strip ofland containing 12,672 square feet, more or less.
THE PARTIES hereto acknowledge that this deed is executed under the threat of
condemnation and, therefore under ~76-3-201(1)(a), is exempt from all subdivision
