SUBJECT: Continue the public hearing on application Z14346, Zakovi Conditional
Use Permit from January 12, 2015 to February 23, 2015.

RECOMMENDATION: Staff recommends that the Commission continue the public hearing
to February 23, 2015.
RECOMMENDED MOTION: I hereby continue the public hearing on application Z14346,
Zakovi Conditional Use Permit, from January 12, 2015 to February 23, 2015.
BACKGROUND:
This is an application for a conditional use permit to allow the expansion of existing non-
conforming uses and modify previously approved site conditions to allow industrial uses within
an R-2 (Residential Two-Household Density District) area located at 417 Plum Avenue.
After final review of the application it was determined that the Certified Adjoiner List created
and provided by the Applicant was incorrect. Therefore, the public hearing must be re-noticed to
meet the requirements of Section 38.40.030, BMC.
As required by Section 38.40.030, BMC preliminary CUP applications require that all property
owners within a distance of 200 feet from the exterior property boundary of the site to all or part
of another parcel of land whose owners must be notified of a governmental action. This distance
includes the width of a right-of-way or other public ownership.
Staff will re-notice pursuant to Section 38.40.030 once the Applicant provides a corrected
property owners list with addressed and stamped envelopes for first class mail notification.
UNRESOLVED ISSUES: None.
ALTERNATIVES: The City Commission has the following alternative actions available:
1. Set an alternate date for the public hearing.
