HomeMy WebLinkAbout01-06-15 Zakovi Public Comment Zak H Zakovi's cover letter for the City Commissioners and Mayor In the matter of my CUP hearing before you Jan 12 2015. 1.A background of my property use sense 1975 2. Also signed letters of support and ballots asking you to make exception for my Sculpture Garden. ❖ In 1975 a building permit to expand my woodshop at 514 N Montana was denied due to the residential zoning of that neighborhood. I was asked to find an M-1 property to build my shop on. ❖ In 1975 I began building my woodshop / studio / construction headquarters at 417 N Plum Ave. Opened for business 1976! ❖ In 1992 the City changed the zoning of 2 blocks from M-1 to R-3, my property was included. I requested that my property be `grandfathered' as M-1 to protect my investment of buildings and equipment. It was granted by Andy Epple, then head of planning in Boze.Epple's letter is on file ❖ Also on 1992 I was granted a minor site plan petition #Z-9110 to build and operate a bronze foundry on my property. Debbie Arkell's memorandum is on file ❖ In 1993 1 complete construction of the foundry and received a signed certificate of occupancy by Bud Toss, then head of the building Dept. At that time I ask Bud Toss if I could install the expensive foundry equipment at a later time due to expense and other commitments. Bud told me it was permitted and built `I could do that at any time in the future. ' ❖ In 1997 I began creating large stone and steel sculptures. On completion I placed them out in front of my studio to observer them in open urban space. The sculptures rest on temporary concrete pads not attached to the ground The display changes frequently and the sculptures are covered by liability insurance ❖ In 2014 a neighbor complained that my sculptures where placed on the City right of way and on the 15 foot setback portion of my property. The City Planning Dept. determined that I need to reapply for my existing nonconforming use permit by applying for a CUP. That is why we are at my hearing ... to reestablish my previously granted property uses. As a property owner,Zak Zakovi has been victimized by the freewheeling attitude the City has with regard to re-zoning areas. The City must honor the zoning conditions under which Mr. Zakovi purchased his property and has used his property. Forcing him to remove his sculptures will set a dangerous precedent. While I do not know the history of the "complainer," I wonder if he, she or they purchased the property fairly recently. Did the complainer not tour the neighborhood?Did the complainer or the realtor or the attorney not do his or her due diligence in researching the history and prior zoning of the area? Why should this negligence or arrogance fall on Mr. Zakovi's shoulders? As I drive through the "Historic Conservation District" in Bozeman, I am appalled at what has been allowed to be built in that part of the city (for some, the pride and joy of Bozeman): Ego houses that exceed height limits, that squeeze their ill-proportioned envelopes onto sites that cannot hold them, and that boast materials that do not cohere with the historic aesthetic of the district. Conditional use permits and variances have become the rule,rather than the exception. Why is the City so concerned about a sculpture garden in the mixed-use Northeast District? Those of us who have lived and worked in Bozeman for our adult lives grow more disgusted everyday over the irrationality of the City's development. It is the City's responsibility to retain some semblance of Bozeman's sense of place. Zak Zakovi's sculpture yard is one of those cultural gems that gives Bozeman its unique sense of place. Do not destroy one of the last best things in Bozeman. I would advise the iconoclast complainer to take an art appreciation course and learn of the enjoyment that art can bring--learn to appreciate the uniqueness that the Northeast neighbor brings to Bozeman; or move. The complaint was that Zak has placed his sculptures on the City right of way and on his property known as the 15-foot setback, which is the area 15 feet from his property line back toward his house. I keep wondering about a petition and if that could be useful in swaying the Commission to support you. I started one some years back to save city trash pick up so that we would have choice rather than a private monopoly on that service, and we pretty easily collected well over 1000 signatures and won on the issue...So, I do think they can have a strong effect. It's also election season, and the Commissioners should want to look like reasonable people to the community. It is wonderful, a bright light of creativity. I saw it while wandering with the Parade of Sheds, more than once. I once taught planners and citizens about Montana land use regulations. I may be out of date but I suspect that the Bozeman Planner erred in citing you. As for a conditional use permit, it would be inferior to a simple recognition that your work is legally grandfathered. A conditional use permit is a permission, and a permission could be withdrawn by some authority, city administrators or court. Perhaps that is true of grandfather status, too. Regardless, I believe the City Planning Office should straight-forward recognize that it has overstepped its authority. You certainly should not have to move any of your works. The notice of violation should be withdrawn. Let any detractors sue the City to determine if their complaint is justified.
