CALL TO ORDER AND ATTENDANCE Chairperson Kim Walker called the meeting to order at 3:40 p.m. She directed the secretary to record the attendance, noting there is not a quorum of members present. She noted that the members present will forward a recommendation to the Planning Board. ITEM 2. MINUTES OF DECEMBER 8, 1998 Mr. McCrone moved, Mr. Willett seconded, the minutes be approved as submitted. The motion carried 3-0. ITEM 3. CONSENT AGENDA Indy Lube CUP/COA#Z-98208 - (Killebrew) 1310 North 7t'Avenue - A Conditional Use Permit Application with a Certificate of Appropriateness to allow the construction of an auto service facility. MOTION: Mr. Willett moved, Mr. McCrone seconded, to approve consent item#Z-98208 as presented. The motion carried 3-0. ITEM 4. PROJECT REVIEWS A. Machinery Power&Equipment Co., CAT Rental Store CUP/COA#Z-98188 - (Sherman) 30 Deadman's Gulch - A Conditional Use Permit Application with a Certificate of Appropriateness to allow the construction of a 12,000 sq. ft, rental and service facility and site improvements on 4.07 +/- acres. (Continued from 11/24/98) Robert Bushing and Wally Bell joined the DRB. Urban Designer/Planner John Sherman presented the application, noting he had included the original plans, the original staff report, the new plans, and his current memo in today's packets. He noted the changes made in the new submittal, and that Planning Staffs primary concern is the area of outdoor storage. He reviewed the conditions imposed by the DRC, noting the 101 parking spaces seems excessive, however, without a variance, it is required. He discussed the landscaping area. He added "the applicant Design Review Board Nlinutes-December 22,1998 1 shall submit to the Planning Department revised landscaping plan." to condition# I. Mr. Willett asked if the landscaping initially submitted will be extended in a similar manner. Mr. Bushing noted that is the intention. Mr. Willett asked if there is a provision for landscaping between the formal display area and informal storage area. Mr. Bushing noted there is a T wide landscaping area. Mr. McCrone noted the parking requirements seem excessive. Planner Sherman explained the calculation. Mr. McCrone asked if there is any latitude in the greenway corridor to reduce the number of trees. Planner Sherman noted there is little latitude as per Senior Planner Dave Skelton. He reviewed Planner Skelton's conditions from the DRC. Mr. McCrone noted the spacing of the trees may screen the display areas. He argued the concerns of the DRC and DRB, was concerned that DRC is involved with the aesthetic values of an application. Mr. McCrone asked for discussion of condition#3. Planner Sherman explained and Mr. Bushing clarified it. Chairperson Walker asked what the display area will look like. Mr. Bushing noted it will be mostly gravel surfaced. She asked Planner Sherman about the screening required by the DRC. He noted the conditions from DRC requires 8'high fencing with poly slats. Mr. Bushing disagreed with Planner Skelton on the height on the fence and the screening slats. He noted his clients do not want opaque screening. Chairperson Walker noted she considers the display area as storage area. She described the effort made by previous owners to make an attractive entryway. Mr. Bushing noted that the dumpsters in the front yard across the street are not attractive. Planner Sherman noted that project was in place prior to the North 19th Guidelines. Chairperson Walker suggested alternatives for the landscaping other than using slat screening. She expressed concern with the trees and suggested clumping of the trees. She is in agreement with the height of the fence, however, not with the slats. She noted it does need to be opaque especially in the front area. She noted she is not as concerned with the south facade and would rather have more money spent on the facade and landscaping along North 19th. She is in support of the variance on the parking requirement. Mr. Bushing noted the number and location of parking spaces he would like. Further discussion followed on the parking spaces and the reality of parking equipment in the parking spaces. Planner Sherman asked, if the variance is approved, if the landscaping be continued or will the parking spaces become display area. Discussion followed on the aesthetics of the display/storage areas. Mr. Bushing and Mr. Bell asked for suggestions for the opaque fencing. Mr. Willett noted that the short fence between the display and storage areas could be slatted. He suggested the landscaping that meets the requirements for parking would be suitable for the display area. He suggested continuing the hedge and wrapping it around to the drive on the one side and extending it the same distance on the other side. He suggested paving the proposed parking area even if the variance is granted as it breaks up the large lot area. For screening,he suggested looking at berming again as berms would serve several purposes - screening,North 19th wouldn't be looking down on it. Chairperson Walker noted that would be effective with plantings on the top of the berms. Mr. Willett suggested installing two berms. Discussion continued on berming, connecting and the berms with the fencing. Mr. McCrone concurred with the fencing and berming,noting he Design Review Board Minutes-December 22,1998 2 doesn't favor the slats in the chain link fence. Mr. Willett noted he is satisfied with the building as proposed. Mr. McCrone noted he concurs with chairperson Walker's interpretation of the grouping of the landscaping elements. Mr. Bushing noted the owner has changed the monument sign to using signage only on the building. He noted the main concern is with the fencing - he'd like open chain link fence for security purposes, with berming. Chairperson Walker noted the berming will have to be at least 4' high with landscaping. Mr. Willett noted he didnt envision landscaping on the berms, but a pad on each one for display area. Mr. Willett noted the applicant has the hedge proposed, which he has suggested be returned to the drive and a similar distance on the other side. He continued if the screening continued from the berms back along the parking, display, and storage areas would be okay with him. Chairperson Walker suggested a second berming with 5 gallon buckets-plants as suggested on the landscape plan because the area isn't screened by the bare berm in front. Mr. Bushing noted that the berms in Billings are landscaped with groupings of bushes. He noted if he adds the boulevard and the greenway requirements, he should have adequate screening. Chairperson Walker moved, Mr. McCrone seconded, to approve application#Z-98188 with Staff conditions #1, 2, 3, 4, 5, adding, " the revised landscape plans contain berms of at least 4' with a second row of berming, the hedge proposed along the front be returned the distance of approx. 50'to the driveway and the same distance on the other side". She noted the DRB is in favor of the deviation, if required, to increase the signage. Chairperson Walker amended the motion with an eighth condition"The proposed storage area shall have an 8' high fence with slatted material, with the remaining fencing to be unslatted and 6'high. Mr. McCrone seconded the amendment. The amendment carried 3-0. Mr. Willett asked why the chain link fence (6) was going to have 4X4 wood posts and what it will look like. Mr. Bushing noted the differences in the 8' and 6' fences. Mr. McCrone clarified that the DRC condition refers to the area in the front of the lot. Mr. Willett suggested that whatever landscaping is required for the parking area be required in the storage area. Discussion followed on removing condition#1. Mr. McCrone moved to amend the motion to delete condition#1 as it is covered by condition#7. Mr. Willett seconded the amendment which carried 3-0. The motion carried 3-0. Mr. Willett suggested a recommendation to the Planning Board and the City Commission that the variance be allowed to leave the area paved to give access all around the lot. B. Me &Jan's Minimart COA/DEV#Z-98198 (Sherman) 919 West College Street - A Certificate of Appropriateness Application with Deviations to allow the construction of a 24' X 24' canopy over the west pump island, as well as a change of signage. This application was postponed until January 12 by request of the applicant. Design Review Board Minutes-December 22, 1998 3 ITEM 5.
