3. Boulevard Apartments COA Z-9645 (Strahn)

- A Certificate of Appropriateness Application to allow the replacement
of the windows on the Boulevard Apartments.
Mr. John DeHaas moved that items 1,3, & 4 be approved as presented. Kenneth Snyder
rose in the audience and asked to be allowed to speak from the floor. He noted that he
interpreted the posted notice to read that if there were any concerns, he was to be here at
3:30 today.
Chairperson Chisholm asked Mr. Snyder with which project did he have concerns. Mr.
Snyder stated he was concerned with the Boulevard Apartments COA. He stated there were
several other tenants present also. Chairperson Chisholm stated that the item would be taken
off the consent agenda and discussed at this time. He requested Planner Derek Strahn to
present the project.
Planner Strahn explained the project. He summarized the Staff Report. The Historic
Preservation Officer's comments noted that this is a proposal for the replacement and
upgrading of all windows at the Boulevard Apartments, which is generally appropriate and
acceptable within this Conservation Overlay District neighborhood. The comments continued
that according to the applicant, the windows in the three-story, forty-one unit apartment
building are non-original and in deteriorated and/or lack energy efficiency. The applicant
has proposed to replace the existing non-original single pane windows and aluminum storms
with new double pane windows that have essentially the same appearance as the existing
windows. At the time the Staff Report was written, there had been no public concern
expressed. Staff's condition is that the applicant obtain a building permit within one (1) year
of Certificate of Appropriateness approval. (Complete text of Staff Report on file at the

Chairperson Chisholm inquired if all of the windows are not original windows. Planner

Strahn noted they are not. Chairperson Chisholm asked what single hung windows are.
Planner Strahn noted that only the bottom pane will operate, not both as in double hung
windows. Mr. McCrone inquired if the new windows will be double paned. Planner Strahn
noted that they are.
Chairperson Chisholm asked Mr. Snyder to voice his concerns. Mr. Snyder stated that there
were no complaints about the windows being replaced. He noted that the problems are with
parking. Planning Director Epple explained the procedure for DRB. Mr. Snyder noted that
there are problems with the interior of the building also. Planning Director Epple explained
that those problems need to go to the Building Department. He continued that if Mr. Snyder
would come into the Planning Office, he will help him contact the departments which can
help him. Mr. Snyder agreed to come in.
A lady in the rear of the room rose and spoke to the effect that the owners weren't present,
which she felt was illegal as they couldn't speak for themselves. Chairperson Chisholm
asked if she had any concerns about the windows. She stated that she'd like new windows.
Mr. DeHaas moved, Mr. Cruwys seconded, that DRC approve item #3 as presented.
Motion carried unanimously by voice vote.
