A. FINAL WEEK REVIEWS
I. Sweet Pea Cafe & Bakery CUP Z-9908 - (Berger)
19 south Willson Avenue(Downtowner Mall) -to allow a restaurant to serve beer and
wine(formerly the Wild Flower Bakery)
Applicant, Allison Totten,jointed the Development Review Committee(DRC).
Assistant Planner Berger reviewed her 02/16/99 memo outlining planning staff recommended
conditions of approval,noting the inclusion of Water/Sewer Superintendent Mike Certalic`s condition
distributed last week concerning the requirement for a backflow prevention device as wording was
slightly modified from his memo. Minor edits were made to recommended condition#1. Planner
Berger also noted the proximity of the site in relation to the Bozeman United Methodist Church and
how this relates to statute.
Chief Building Official Neil Poulsen noted that the front door at Willson Avenue opens onto a step
and does not meet requirements for exits from community buildings. Noting that a remedying the
situation would be costly inside the building, he questioned the possibility of requiring a ramp onto
the sidewalk.
Indicating that such a proposal would need to be evaluated by engineering staff, Director of Public
Service Phil Forbes suggested that a ramp onto the sidewalk would result in an increased hazard to
pedestrians and a liability for the City of Bozeman. Mr.Poulsen indicated that the accessibility issues
would be addressed during the plan check of the building permit application.

Responding to Planner Berger, Mr. Poulsen indicated that remedying the step at the front entrance
is not relative to meeting accessibility requirements, but would increase safety.
Chairman/Senior Planner Dave Skelton received further clarification concerning the issue of the site's
proximity to the church.
MOTION-Neil Poulsen moved, seconded by Mike Certalic, to recommend conditional approval of
the application with the conditions outlined by planning staff. The motion carried unanimously

1415 West Koch Street - to allow the conversion of an existing garage into a single family
dwelling unit and construct a new 2-car garage.
Joe Schwem, Lyric Architecture, and Chris Passano joined the D.R.C.
Assistant Planner Joni Killebrew reviewed the application,and noted that she received a concern from
Arnold Dood, 221 South 14", about the garage, and further uses within it. She stated she also
received a phone call from a homeowner northeast of the subject site asking questions about the
proposal, but did not receive any written comments.
Planner Killebrew then distributed and reviewed her memorandum dated 2/16/99 listing six
recommended conditions. None ofthe other DRC members had comments regarding this application
that were not addressed in Ms. Killebrew's memo.
In response to a question asked by Chairman Dave Skelton, Joe Schwem stated the existing garage
has a roof pitch of 2:12, as does the existing house. The new garage will also have a 2:12 pitch.
Chris Passano indicated he understood the reason for Condition 5,and agreed to all ofthe conditions.
He noted he would pursue the two options offered in the conditions.
MOTION - Karen Finke moved, Mike Certalic seconded, a motion to approve the minor site plan
application with the conditions provided.
Phill Forbes asked if Condition 5 mitigates condition 3b. Mike Certalic stated if the lots cannot be
sold as separate lots, which condition 5 states, then condition 3b would not be needed.
Phill Forbes advised the Planning Staff that he would like to review the covenant referred to in
Condition 5, if that option is used, before the Covenant is approved for filing.
VOTE: The motion carried by a unanimous voice vote.
Chairman Skelton advised the applicant of the appeal process, and that a notice of intent to appeal
would have to be received by noon on Friday, February 19, 1999.

B. INFORMAL REVIEW
1. Jacoby Informal#9903 -(Arkell
- 1803 North Rouse Avenue - for the further development of Tracy Kroon's Truck &
Equipment property
Steve Jacoby joined the D.R.C. and drew on the board a sketch of the property, stating the issue is
providing water to the back of the 900-foot deep lot. He stated there is a water main on the cast side
of Rouse Avenue, and that the house is served by a well and city sewer. His proposal is to remodel
the existing house and shop, building a 10,000 sq.ft.building near Rouse to the north of the house,
and add four M-1 use buildings of 5000-6000 sq.ft. each at the back of the lot.
He stated a 500 foot water main extension will not provide fire coverage to the last two buildings,
noting there is a fire hydrant in Dave Osterman's property to the north, but that Mr. Osterman was
not willing to allow a connection to it. Mike Certalic stated he had previously advised Mr. Jacoby
that he could do a meter pit for domestic water service to the last two buildings, but that fire
protection was still a problem. Mr. Certalic stated he also discussed sewer with Mr. Jacoby,and Mr.
Jacoby advised DRC that Gaston Engineering advised him sewer was do-able.
After further discussion,the DRC concluded that extending a dead end water main approximately 350
feet beyond the 500-foot maximum was not an option for this property, and that the City Codes
requires use of city water within the city limits.
