MINUTES Members Present: Greg Megaard, Roger Sicz, Neil Poulsen, Dave Skelton, Mike Certalic, Craig Brawner, Phill Forbes Staff Present: Derek Strahn, Joni Killebrew, Therese Berger, Carol Schott, Robert Murray, James Nickelson Visitors Present: Chris Passano, Robert and Brenda Longcake, Lowell Springer, Allison Totten Chairperson Dave Skelton called the meeting to order at 10:10 a.m. A. FINAL WEEK REVIEW Longcake ADU CUP #Z-98222 - (Strahn) 1806 South Willson Avenue - A Conditional Use Permit Application to allow the addition of an accessory dwelling unit to an existing single-family dwelling unit. Brad Longcake joined the DRC. Historic Preservation Officer/Planner Derek Strahn reviewed his memo, noting that Planning Staff is recommending denial of the application due to the reasons given in the memo and 5 letters in opposition and 2 letters of support of the application. Chairperson Skelton reviewed his memo which listed the intent and purpose of a Conditional Use Permit. He noted that the merits of a proposal are to compensate for the conditional use in zoning district. Mr. Longcake noted he has three or four other people who will be mailing in letters of support and the businesses to the rear of the property are not against the proposal. Chairperson Skelton noted that any letters of support can be submitted at anytime, including at the Planning Board hearing. Mr. Longcake noted that if his name needs to be placed on the deed, he will notify his parents tonight. He noted the parking requirements can be met by him leaving his vehicle in Shelby and renting the fifth parking space from a business behind them. Chairperson Skelton noted that the CUP goes with the land and the next owner may not be willing to do the same. Mr. Longcake noted that the area of the ADU is not very much over the allowable amount. He noted they want to keep the two units to house 5 people. Discussion followed on Building Code requirements, parking requirements, and front yard setback requirements. Mr. Sicz moved to recommend approval of the application. The motion died for lack of a second. Mr. Brawner moved to recommend denial of the application. The motion was seconded by Mr. Poulsen and carried 6-0. Development Review Committee Minutes-February 9,1999 1 B. ONE WEEK REVIEW Holiday Convenience Store Modifications - (Skelton) Northwest corner of North 19" Avenue and Durston Road A review of proposed modifications to the approved Final Site Plan. Chairperson/Planner Skelton presented the modification to allow for an RV dump station. He noted the DRC can deny the function or place additional conditions on the original application. Discussion followed on car wash water draining down the trap, further stacking of traffic on the site, the width of the one-way drive aisle for RV traffic, the conflict in use, the use being available for only three months of the year, the ability of the City to charge for a commercial sewage use, and the design not providing that type of movement. Mr. Nickelson moved to deny the modification request, seconded by Mr. Certalic. The motion carried 6-0. C. SECOND WEEK REVIEW Passano MiSP #Z-9906 - (Killebrew) 1415 West Koch Street - A Minor Site Plan Application to allow the conversion of an existing garage into a single family dwelling unit and construct a new 2-car garage. Chris Passano joined the DRC. Assistant Planner Joni Killebrew presented the application, noting the need for a Minor Site Plan is due to placement of this unit on a three lot parcel that already has a housing structure on it. She inquired of the applicant if he has submitted the boundary line relocation for the apartments proposed for the back lots. She noted the City would require a deed restriction that would require the property to be sold as one large parcel of three lots with the City as a party to the deed. Discussion followed on the location of the property lines, the extent of the existing concrete pad, drive aisle width for a private drive, the construction of the garage being on a different lot than the house, the backup maneuverability from the garage, and the possibility of a joint use driveway with the neighbor. Mr. Certalic asked if the lots would have the same owners to which Mr. Passano noted they would. Mr. Certalic noted the lots/structures will be required to have separate water and sewer connections. Mr. Passano asked if he could hook into his private well and septic system. Mr. Certalic noted he is required to hook up to City services. Mr. Brawner noted there is no problem adding a sewer service line for the new unit. Mr. Certalic noted each building has to have separate sewer services, however, water services can be connected between the two units. Mr. Passano asked for permission to continue work on his structure. Mr. Poulsen noted he issued the Stop Work Order and he is not willing to lift it until the Planning Office approves the site plan. Chairperson Skelton noted that conditions will be written next week on the plan as submitted. DRC members reviewed the requirements to be met prior to the Stop Work Order being lifted. Chairperson Skelton noted a decision will be made next week. Development Review Committee Minutes-February 9,1999 2 D. FIRST WEEK REVIEW A TWO WEEK REVIEW Sweet Pea Cafe & Bakery CUP #Z-9908 - (Berger) 19 South Willson Avenue (Downtowner Mall) - A Conditional Use Permit Application to allow a restaurant to serve beer and wine. (Formerly the Wild Flower Bakery) Allison Totten joined the DRC. Assistant Planner Therese Berger presented the application, noting it is an application for a cabaret license to serve beer and wine. She noted she will check the parking requirements, handicapped spaces, and garbage enclosure by next week. Mr. Certalic reviewed his one comment which is to bring the water service into compliance by installing a double check on it. Mr. Poulsen noted he will have added conditions for the bathrooms. Ms. Totten noted she is working with Locati Architects, who did the remodel last year. She noted she sees no need to add a urinal to the single bathroom. Mr. Poulsen noted that in a restaurant, there can be a unisex bathroom, however, when adding beer and wine sales, separate bathrooms are required. E. INFORMAL REVIEW 1. Jacobi Informal - (Arkell) 1803 North Rouse Avenue - An Informal Review for the further development of Tracy Kroon's Truck & Equipment property. Assistant Planning Director Debbie Arkell noted Mr. Jacobi asked for the informal to be continued to next week. 2. Stoneridge Congregate Living Informal - (Skelton) West Oak Street An Informal Review for the potential development of a congregate living project. Lowell Springer joined the DRC. Chairperson/Planner Skelton presented the application. He reviewed the needed additional easement for West Oak and noted the absence of the retention/detention pond in Brentwood Subdivision. Mr. Certalic asked where the sewer will be connected as there are no stubs along Nineteenth Avenue, Mr. Springer noted the sewer will be installed in Stoneridge Drive as will the water. Discussion followed on the moratorium on the cutting of Oak Street, the possibility of getting a street cut, the possibility of connecting to the Oak Street Water Main west of the end of pavement, the type of care to be given by the facility, the locations of the entrances, the requirements for curb and sidewalk, the need for separation walls for that amount of sq. footage, the progress of the Final Site Plan for StoneRidge PUD, fire protection during construction, and the location of the second Development Review Committee Minutes-February 9,1999 3 connection to sewer.
