HomeMy WebLinkAbout01-05-1999 DRC Minutes DEVELOPMENT REVIEW COMMITTEE TUESDAY, JANUARY 5, 1999 MINUTES Members Present: Neil Poulsen, Mike Certalic, Dave Skelton, Greg Megaard, Craig Brawner, Phill Forbes Staff Present: Kristen Emborg, Debbie Arkell, John Sherman, James Nickelson, Joni Killebrew, Therese Berger, Rick Hixson, Karen Finke, Carol Schott Visitors Present: Bayliss Ward, Joe Schwem, Chris Passano, Jack Sauther, Yanong Han A. FINAL WEEK REVIEW 1. Indy Lube CUP/COA #Z-98208 - (Killebrew) 1310 North 7"' Avenue - A Conditional Use Permit Application with a Certificate of Appropriateness to allow the construction of an auto service facility. Bayliss Ward and Jack Sauther joined the DRC. Planner Joni Killebrew reviewed the conditions from the Planning Department. Project Engineer James Nickelson reviewed the conditions from the Engineering Department, including an alternative parking configuration. Mr. Ward asked about the yard setbacks along Oak Street and if the trash enclosure could be placed in the sideyard setback. Chairperson Skelton noted the Planning Office has jurisdiction over the placement of trash enclosures. He suggested Mr. Ward discuss the placement of it with Planner Killebrew. Water/Sewer Superintendent Mike Certalic noted there are two cleanouts for the sewer system on the property. Mr. Certalic moved, Mr. Poulsen seconded, to recommend approval with conditions per the DRC. The motion carried 5-0. B. SECOND WEEK REVIEW 1. Grand Teton Plaza MiSP/COA - (Arkell) 810 North 71h Avenue - A Minor Site Plan/COA Application to remodel and add on 1 Development Review Committee Minutes-January 5, 1999 to the Sunset Motel, and convert it to retail uses Yanong Han joined the DRC. Assistant Planning Director Debbie Arkell presented the application, noting she has checked the legal description, and will check if there is a possible encroachment, make be sure the proposed signage complies with code. James Nickelson, Project Engineer, noted there may be an issue with parking and with the trailer park, depending on the circulation of traffic through the trailer park. He asked that a triangular piece of property that is part of this lot, as well as the vacated alley with a sewer easement, be shown on the Final Site Plan. Chairperson Skelton noted there is a need for more information to be included on the FSP pertaining to the whole southeast corner. Mr. Certalic, Water/Sewer Superintendent, noted there are two water services to the lot, with one that services the existing house and continues on to the existing trailer court, and the other to the motel. The applicant would need to modify the water services so there aren't two services entering one unit. Planner Arkell asked if the closure of the street access on the north would pose a problem for servicing the trailers. She noted the circular access would be closed off. Greg Megaard, Fire Inspector, noted the closure would not be a problem as there is adequate turn-around space. Planner Arkell noted she will research the property boundary question and let Mr. Han's brother know if there is a problem. Mr. Megaard noted he will visit the site to see how traffic circulation will work. 2. Firebird Apartments MiSP - (Sherman) 3125 South 15"i Avenue - A Minor Site Plan Application to construct two tri-plex and one four-plex apartment buildings Chris Passano and Joe Schwem joined the DRC. Urban Designer/Planner John Sherman presented the application, noting several issues, including the access drive on the northern end of the property which encroaches onto two neighboring lots. He noted there will be full access agreements required to be filed with the Clerk and Recorder. He noted the Planning Director has determined there are two 20'rear yard setbacks. He noted the spacing of the access drives is only 43', there is a shortage of two parking spaces, and the applicant will be required to submit a complete landscape plan. 2 Development Review Committee Minutes-January 5, 1999 James Nickelson, Project Engineer, noted the width of the access on the shared approach doesn't meet requirements. Planner Sherman noted the Planning Office will require the parking to alignment with the Zimmer property's parking and curbing will probably be required. He stated that if Henkey's are willing to part with 7 feet of property, then the site, on Henkey's side, may work. Mr. Schwem asked how the 20' second rear yard was determined. Chairperson Skelton explained the policy of the Planning Office on determining rear yards. He noted the project may require a redesign. He summarized Chuck Winn's comments that sprinklering would be required. Mr. Shwem asked if they could sprinkler the far building and not the rest. Mr. Megaard noted that wasn't an option. Mr. Shwem noted the parking requirement allows for on-street parking. Planner Sherman noted the required parking is 2.5 spaces per unit for a total of 23 parking spaces. Mike Certalic, Water/Sewer Superintendent, noted main extensions would be required for water and sewer. He noted that with sprinklering, the mains are too long. He stated there is too much development in too small an area. He noted he will visit with James Nickelson about it. Chairperson Skelton suggested Mr. Passano and Mr. Schwem meet with the Planning, Engineering, and Water/Sewer departments. Mr. Shwem noted that the bank requires each building be situated on its own lot. He stated he may want to realign the lot lines. Chairperson Skelton advised him to pursue the subdivision first, then pursue the MiSP. B. FIRST WEEK REVIEW 1. Big O Tire CUP/COA #Z-98215 - (Killebrew) 620 North 7th Avenue - A Conditional Use Permit Application with a Certificate of Appropriateness to allow the construction of a 4,508 sq. ft. retail/office facility relative to an automotive tire facility. Assistant Planner Joni Killebrew presented the application, noting the only issue so far is the possible shortage of two parking spaces. Discussion followed on the existence of an alley, with the consensus being that there isn't one. 2. Allison MiSub Preliminary Plat #P-9859 - (Arkell) Arnold Street A Minor Subdivision Preliminary Plat Application to create 4 lots and a remainder tract. Assistant Planning Director Debbie Arkell reviewed comments from previous reviews, noting the applicant would need an easement from the 3 Development Review Committee Minutes-January 5, 1999 school district for the turnaround. She noted the engineers did test pits on the 4 proposed lots. She noted the developer wants to get building permits for lots 3 and 4 prior to the completion of improvements to Arnold Street. Discussion followed on the possible need for a variance to allow the above building permits, and for sidewalks and other required improvements to be installed prior to the issuance of building permits. Chairperson Skelton suggested a policy from Engineering regarding sidewalk installation. 3. Comfort Inn MaSP/COA #Z-98212 - (Berger) 1370 North 71' Avenue - A Major Site Plan Application with a Certificate of Appropriateness to allow the construction of a 44 room, 22,350 sq. ft. addition to the existing Comfort Inn and related site improvements. Assistant Planner Therese Berger presented the application, noting this is the same plan as presented in 1996, with the exception of the addition of a sidewalk on the northern side of the property. Chairperson Skelton noted that the light fixtures were to be changed several years ago and it hasn't happened. Craig Brawner, City Engineer, noted a concern with the larger vehicle turning radius. He noted the City cannot afford to have the on-street parking of overnight vehicles along an arterial, therefore, large vehicle parking should be provided on site. Greg Megaard, Fire Inspector, noted there will be a condition requiring proof of fire flow adequacy of the 2" fire service line. Discussion followed on the domestic service being on a well and the possible need to require hookup to the City water system. Mr. Brawner asked Planner Berger to research the use of the private well for domestic service. He noted the City has quite a fire protection liability with no compensation from the applicant. He suggested researching the ordinances and minutes from the original project, and a condition requiring the connection to City water at this time. He noted it would be appropriate in the condition to point out the fire protection service helps support full hookup to City services. He noted the sidewalks must connect to the proposed City sidewalk along Oak Street. Mike Certalic, Water/Sewer Superintendent, noted there aren't records 4 Development Review Committee Minutes-January 5, 1999 that show that lots 3 and 4 are stubbed for water or sewer service. Discussion followed on the location of the nearest water and sewer lines. Mr. Certalic asked that his comment #1 be stricken. Planner Arkell asked for help on the soils report. Craig Brawner, City Engineer, noted the Building Division may require a more detailed soils analysis, including its load bearing capacity. Planner Arkell asked Mr. Brawner if there is an overhead power line, which he confirmed. She noted there should be an easement shown for it. 5 Development Review Cormnittee Minutes-January 5.1999
