TUESDAY,MARCH 9, 1999, 10:00 A.M.

Members Present: Greg Megaard, Dave Skelton, Neil Poulsen, Craig Brawner,

Chairperson Dave Skelton called the meeting to order at 10:.
A. ONE WEEK OF A ONE WEEK REVIEW- (Olsen)
Taco John's Restaurant Revised Site Plan
303 North 7"'Avenue
- A review of proposed modifications to a previously approved Site Plan.
Associate Planner Jody Olsen presented the modifications proposed to the approved Site Plan.
She noted the landscaping plan will need revision prior to doing the work.
City Engineer Craig Brawner noted the modifications don't address the stacking in the parking lot
problem. Discussion followed on the issues of stacking and landscaping.
Project Engineer Karen Finke reviewed conditions of the Engineering Office. (All conditions are
on file in the Planning Office.)
Mr. Brawner noted the City is requesting a financial Guarantee for the street improvments even
though they have temporary occupancy.
Discussion followed on the relocation of the driveway requiring a new variance, if to be done.
Chief Building Official Neil Poulsen noted that the street improvements can be required for the
extension of the temporary occupancy when the Permit Coordinator sends around the extension
request sheet.
Mr. Brawner added "West Beal Street shall be improved including concrete curb and gutter, (see
Craig's notes) paving, sidewalks and signing prior to final occupancy"
Karen moved, seconded by Mr. Certalic, to approve the modifications with conditions per the
DRC. Carried 5-0.
B. SECOND WEEK REVIEW
Sukut Annexation#A-9901 -(Killebrew)
1367 Thomas Lane
- An Annexation Application to annex 2.3639 acres into the City of Bozeman.
Justin Buchanan joined the DRC. Assistant Planner Joni Killebrew reviewed the application,
noting the plan is to subdivide the lot into two or three lots. Mr. Buchanan noted the subdivision
would be several years down the road and they are working on a CUP for the church at this time.
Water/Sewer Superintendent Mike Certalic presented his conditions.
Project Engineer James Nickelson reviewed the conditions the Engineering Office will be
imposing. Mr.Buchanan note there is an existing well on the property that they plan to use.
Discussion followed on the water supply, seating capacity, the possible need for a variance for a
water supply for fire protection, which wouldn't be supported by the DRC.
C. INITIAL WEEK REVIEW
1. Cashman CUP#Z-9916 - (Killebrew)
2055 Springhill Road
- A Conditional Use Permit Application to allow the expansion of a non-
conforming use, being the portion of the plant nursery on RS zoned land.
Assistant Planner Joni Killebrew presented the application, noting the variances received thus far
for parking in the side yard, gravel drive aisles, timbered curbing. She noted there are two phases
and explained them. She noted that Sam gianfrancisco has approved the continued encroachment
onto Moss Bridge Road of the parking.
Greg asked if the Belgrade Fire Department has been notified. Joni noted she will send for
comments.
Discussion followed on the encroachment onto Moss Bridge Road, the deepening of the culvert
to provide better drainage from the parking lot.
1. Aspen Meadows Apartments MaSP/COA#Z-9921 - (Berger)
1062 Oak Street
A Major Site Plan Application with a Certificate of Appropriateness to allow the
construction of twelve 4-plex apartment buildings and related site improvements.
Assistant Planner Therese Berger presented the application and an aerial of the property.
Discussion followed on the length of the driveways, the private drive, peripheral infrastructure
including the completion of North 11th Avenue, SD)Waivers needed, parking on both sides of
the private drive, the need for sidewalks,.
Mike reviewed his comments.
Craig noted the Sewer works as shown, however it is very tight. He noted there could be
problems. He noted the utility plans need to show connections to other water sources. (All
conditions on file at the Planning Office.)
Greg noted he needs to see hydrant locations.
Dave noted that private driveways tend to lead to extreme densities. He noted there may be a
need for a secondary access through Castlebar.
Assistant Planning Director Debbie Arkell noted that sidewalks will be required on the inside of
the development. Dave noted there needs to be sidewalks along the peripheral streets also.
(Public Service Director Phill Forbes joined the DRC.) Craig noted he'd rather have them do a
two-way street. Dave noted due to the problems and unknowns, the applicant may need to
redraw the plans. therese suggested having the applicant come next week as an informal.
2. Grand Teton Plaza(2°d Submittal) MiSP/COA#Z-9919 - (Arkell)
810 North 7`h Avenue
- A Minor Site Plan Application with a Certificate of Appropriateness to allow
the partial demolition of the Sunset Motel and building an addition for conversion to
retail space.
Assistant Planning Director Debbie Arkell presented the application, noting the modifications
made since the first submittal, and noted the problems and unknowns. She reviewed the
conditions of the approval of the first submittal and whether they had been met with this
submittal or not.
Mike submitted his conditions. (All conditions are on file in the Planning Office.)
Veon MiSP/COA#Z-9922- (Skelton)
851 Bridger Drive
- A Minor Site Plan Application with a Certificate of Appropriateness to
allow the construction of a new 11,400 square foot building to accommodate 6
commercial tenants.
Senior Planner/Chairperson Dave Skelton presented the application, noting it is not clear what
the applicant wants to do. Mike Certalic, Water/Sewer Superintendent, noted he received word
that they want to do one building now and the other structure one later. He noted the proposed
water service doesn't work. Planner Skelton noted the shared access should be continued through
to Birdie Drive to provide a drive through. Discussion followed on the need for main extensions
from Birdie Drive.
1. Genesis MaSub Preliminary Plat#P-9905 - (Skelton)
On the southside of Stucky Road, west of Grace Bible Church
A Major Subdivision Preliminary Plat Application to divide a 32 acre tract into
27 R-O zoned lots.
Senior Planner/Chairperson Dave Skelton presented the application. Terry Threlkeld joined the
DRC. Planner Skelton noted the applicant should look at extending water/sewer mains and the
installation of other infrastructure. He reviewed the request from Sam Gianfrancisco for waivers
for signalization for both Stucky Roadand Kagy Boulevard on South 19`h Avenue. Mr.Threlkeld
noted that a requirement to annex would result in higher impact fees and the applicant's goal was
to avoid them. He noted the applicant would not agree to a waiver of right to protest annexation.
Planner Skelton noted they should be required to annex.
Mr. Threlkeld and the DRC discussed the feasibility of a central water system and a sewer
system, the sprinklering of the buildings, the uses proposed for the ponds, the phasing of the
development, the variances requested for pipe size and utility easement width, the estimated
amount of waste produced per lot being that of a single family home, lot coverage percentages,
and the possibility of the lots being aggregated.
D. INFORMAL REVIEW
City Parking Lot Informal#Z-98110 - (Skelton)
108 & 110 South Bozeman Avenue
- An Informal Review for advice and comment on a proposed parking lot.
James Goehrung and Ryon Stover joined the DRC. Senior Planner/Chairperson Dave Skelton
presented the application, Mr. Goehrung reviewed the history of the lots and the proposed
designs for them. He noted the redesign is for parking on three lots rather than the original two
lots. He prefers the first diagram. Mr. Stover noted he'd rather see a parking garage located
somewhere else. He noted the trees aren't cottonwood trees but rare American Elms. He stated
he sees no way to save the tree in the back of the lot.
Discussion followed on the depth of the excavation for the parking lot and the root damage that
would occur, the possibility of porous paving to save the tree, landscaping, the next step of
review, and the size of an island required to save the rear tree being a drip line of a 25'or 30'
radius.
Mr. Certalic moved,Ms.Finke seconded to adjourn. There being no further business to come
before the Committee, the meeting was adjourned at 11:45 a.m.
