PUBLIC ACCESS EASEMENT AND AGREEMENT
Hiqhqate Bozeman, LLC., John Robson Place, Suite 400,1155 Robson St., Vancouver,
B.C., Canada V6E-1 B5, the GRANTOR for good and valuable consideration, receipt of
which is acknowledged, grants to the City of Bozeman, a public corporation, P.O. Box
1230, Bozeman, MT 59771-1230, the GRANTEE, a perpetual easement through, over,
and across a strip of land situated in Gallatin County, Montana, thirtv-five (35) feet
wide to be located on the following described real property:
Lot 1 of Certificate of Survey No. 2089, accordinq to the official plat of record and on file
in the office of the Clerk and recorder of Gallatin County, Montana, under Document No.
382156.
The easement is more particularly described on the attached Exhibit "A" as "35'
PUBLIC ACCESS EASEMENT" which by this reference is made a part hereof.
The GRANTOR does hereby create this easement for the purpose of
maintaining, operating, repairing, improving, replacing and using a public access and its
necessary fixtures and appurtenances through, over, and across said real property,
together with the right of free ingress and egress by pedestrian and non-motorized
vehicular traffic at all times.
This easement is created for the benefit of the public and shall run with the real
property and be binding on all parties having any right, title or interest in the described
property or any part thereof, their heirs, executors, successors, administrators and
assignees, and shall bind each owner thereof.
