SEPTEMBER 29, 1998,
Minutes
Members present: Greg Megaard, Neil Poulsen, Dave Skelton, Phill Forbes, Mike Certalic
Staff present: John Sherman, Debbie Arkell, Roy Beall, Jan Sadlowski, Karen Finke, Rick

Visitors present: Jerry Locati, Paul Sanford, Lowell Springer, Dave Crawford
Chairperson Dave Skelton called the meeting to order at 10:06am.
A. FINAL WEEK REVIEW
1. American Bank West Expansion MiSP/COA #Z-98158 - (Sherman)
1612 West Main Street
- A Minor Site Plan Application with a Certificate of
Appropriateness to allow the renovation of the existing Petcetera building and the
construction of a 1,954 sq. ft.addition for offices, storage and indoor parking.
Planner John Sherman introduced the project and noted that there were no deviations. Planner
Sherman reviewed his conditions and he stated that the DRB met last week and approved the
project unanimously 4-0.
Planner Sherman introduced Mr.Jerry Locati from Locati Architects.
Project Engineer Rick Hickson reviewed his conditions. Mr. Locati reviewed his percentage
calculations. Planner Sherman noted that there were no public comments on this project.
Mr. Hickson moved to approve, it was seconded by Chief Building Official Neil Poulsen as
per conditions recommended by DRC. The motion was carried 4-0.
2. Harrington Pepsi MiSub Pre-application #P-9847 - (Arkell)
East Frontage Road
A Minor Subdivision Pre-application Application to allow a second minor
subdivision from a tract of land to divide Lot 2, Minor Subdivision #71, to
create 2 tracts. (Second of two week reviews.)
Assistant Planning Director Debbie Arkell introduced Mr. Dave Crawford of Thomas, Dean
& Hoskins, Inc., representing the applicant, and reviewed the conditions recommended by the
Planning office. Planner Arkell noted that Pre-application plat shows an overlap of the
common lot line between COS17land the subject property. She stated that the issue of the
location of this common line must be clarified before a final plat. Mr. Dave Crawford asked
for clarification of the Planning Staff recommended condition #7 regarding utility easement.
Planner Arkell referred Mr. Crawford to the section of the Subdivision Regulations relating to
easements.

Discussion ensued on Planning Staff condition #10, with Planner Arkell clarifying the
comment is intended to ensure that if a drainage ditch is present on the property, that it is
properly noted on the plat. Mr. Crawford stated this is a natural sway and not a drainage
ditch.
Project Engineer Karen Finke reviewed her conditions. Mr. Crawford asked for clarification
on storm water on condition #2 After discussion, Ms. Finke indicated this condition would be
applicable to this project.
Water and Sewer Superintendent Mike Certalic joined the DRC and reviewed his conditions.
Chairperson Dave Skelton noted that no formal action of the Committee at this time that this
was just to prepare written comments to assist the applicant in preparing the preliminary plat.
B. SECOND WEEK REVIEW
1. Gallatin Park MaSub Preliminary Plat #P-9844 - (Saunderv)
Manley Road
A Major Subdivision Preliminary Plat Application to allow the
subdivision of 29.686 acres into 34 commercial lots.
Planner Arkell presented this Preliminary Plat for Planner Saunders. Building Permit
Coordinator Kristen Emborg joined the DRC. Mr. Dave Crawford the applicants
representative joined the DRC. Planner Arkell stated that Planner Saunders wanted to know
if the applicant was going to request a variance from the section of the Subdivision Regulations
requiring sidewalks to be installed at the time that streets are installed. Mr. Crawford
indicated they plan to install sidewalks on the internal streets, and because Manley Road will
be improved to a county road standard with no curb or gutter, he didn't think sidewalks would
be required on Manley Road. Mr.Crawford indicated he would contact the applicant, and
advise Planner Arkell of Mr. Vosti's decision. Planner Arkell advised Mr. Crawford the
Planning Staff would not support a variance for sidewalks on Silverado Drive. Planner Arkell
reviewed Planner Saunders' comments. Mr. Crawford had questions regarding the comments,
and he was asked to contact Mr. Saunders upon his return to the office. Chairperson Skelton
noted that written comments are needed next week to consider as a recommendation to the
Planning Board.
2. Three Rivers CUP/Var. #Z-98156 - (Arkell)
8606 Huffine Lane
- A Conditional Use Permit Application with variances to allow the
construction of a new solid waste transfer station.
Richard Kountz, Paul Sandford, and Doug Chandler joined the DRC. (Public Service Director
Phill Forbes joined the DRC.) Planner Debbie Arkell introduced the project. Planner Arkell
noted they received one letter in opposition from Michael Delaney. Planner Arkell noted that
Mr. Delaney apparently is not aware the site was already used for this type of use. DRB
approved the COA with conditions. She noted a variance from the curbing and paving

requirements was applied for and if approved the fenced area in back would be graveled.
Doug Chandler explained the main justification for the variance is to prevent the trucks from
breaking up the asphalt. Planner Arkell asked how inside drainage would be handled. Mr. Paul
Sandford stated the inside shop will be dry.
Planner Arkell inquired how they would douse a burning load since water was not being run to
this building. Mr. Dick Kountz said they head for a dirt road and dump it and then the Fire
Department backs them up. He noted that a burning load does not happen often but when it
does its because people don't realize that hot ash can stay hot for a few days. He indicated if a
truck calve to the facility with a hot load, it would be dumped in the designated area and
treated with a chemical or water.
Project Engineer Karen Finke will have her comments on final week. Planner Arkell stated
final comments will be forwarded to the Planning Board on October 20th.
C. INITIAL WEEK REVIEW
1. Simkins Hallin MiSP/ #Z-98166 - (Arkell)
512 North Broadway Avenue
- A Minor Site Plan with a Certificate of Appropriateness to allow the
construction of a 8950 sq. ft. warehouse.
Planner Arkell introduced MiSP and stated a COA is not required as the property is not in the
Overlay District. Planner Arkell noted she saw no service lines into the building and it appears
there will be no need for sewer/water in the building as it is only a storage building.
Sewer and Water Superintendent Mike Certalic noted his comments. Building Official Neil
Poulsen asked what would be stored in building. Planner Arkell answered gypsum, drywall
and other building materials. Neil Poulsen indicated the building would not be required to be
sprinklered.
2. Story Distributing MiSP/COA #Z-98166 - (Beall)
1211 East Main Street
- A Minor Site Plan with a Certificate of Appropriateness to allow
modifications to the fuel tanks as required by the Federal Government,
the addition of a fuel island, and the replacement of the canopy over the existing
fuel island.
Code Compliance Officer Roy Beall, Jr reviewed application. He noted he is concerned the
landscaping is not per code. The pumps need to be accurately dimensioned. Mr. Beall
continued his comment that the curb extends over the property line and the applicant will need
a deviation from the Public Service Director or redesign the driveway. The signs are non-
conforming, and if variances are not approved ,the sign will have to meet code.
Water/Sewer Superintendent Mike Certalic reviewed his comments.
3. Holiday Store Var. #C-9809 - (Skelton)

- A Variance Application to allow the applicant to proceed with construction
prior to installation of a municipal infrastructure. (First of two week
reviews.)
4. Chamber of Commerce Var. #C-9810 - (Skelton)
2000 North 19`h Avenue
- A Variance Application to allow the applicant to proceed with construction
prior to installation of a municipal infrastructure. (First of two week reviews.)
(These two projects were discussed simultaneously) Chairperson Dave Skelton reviewed his
comments. He noted he received memos from Public Service Director Phil Forbes, Fire Chief
Chuck Winn, and Building Official Neil Poulsen and requested that they prepare formal
comments. Chairperson Skelton mentioned that logging trucks can maneuver but tanker trucks
may not be able.
Chairperson Dave Skelton reviewed his comments. Water and Sewer Superintendent Mike
Certalic reviewed his comments.
D. INFORMAL REVIEW
Life Link Informal #I-9841 - (Skelton)

- An Informal Application for advice and comments.
Chairperson Skelton asked Permit Coordinator Kirsten Emborg to see if Neil Poulsen had any
concerns. He also commented on the expansion. Discussion ensued on it being out of city
limits.
Chairperson Skelton asked for a motion to adjourn. Water/Sewer Superintendent Certalic
moved to close, seconded by Mr. Greg Megaard of the Fire Department . Meeting adjourned
at 10:48am.
