MINUTES Members Present: Neil Poulsen, Dave Skelton, Craig Brawner, Phill Forbes, Greg Megaard, Mike Certalic Staff Present: Debbie Arkell, Carol Schott, Chris Saunders, Rick Hixson, James Nickelson, Visitors Present: Mike Delaney, Jeff Ball, Lowell Springer, Jim Cannata, Stephanie Volz, Bill Clinton Chairperson Dave Skelton called the meeting to order at 10:05 a.m. A. FINAL WEEK REVIEW 1. Bogert Park COA #Z-98145 - (Arkell) A Certificate of Appropriateness Application to allow modifications to level the surface under the pavilion, add a cooling system under the floor to freeze the ice, and remove and replace the existing structure at the south end of the pavilion to provide new restrooms, a storage area, and a mechanical room. Jeff Ball and Jim Cannata joined the DRC. Assistant Planning Director Debbie Arkell reviewed her comments and comments from Ron Dingman, Parks Department. She read the action taken by the Parks Board. She read a letter from the Crawfords and noted three other letters were distributed today. She noted that most of Crawford's comments were engineering oriented and that she had spoken with Ron Brey about the parking comments. She reviewed her conditions, noting that a phone call had also been received with the caller being concerned about the noise to be generated. She noted the lighting inside the pavilion are to be motion activated. Project Engineer Rick Hixson reviewed the conditions from engineering. Mr. Ball asked if Mr. Hixson and Mr. Epple had done an elevation shot across the sidewalk. He noted that their advisors are suggesting that the floor be installed first, then add the donut around the floor. Discussion followed on the elevations, the condition of the donut, floodplain issues. Mr. Cannata noted that the ammonia doesn't go through the pipes, it is calcium chloride that goes through the pipes. Mr. Hixson amended condition #6 to include "the coolant piping be isolated from the existing floor drains". Mr. Cannata noted the ammonia would be contained within the mechanical room, and if it escapes, it will escape as a gas. Public Service Director Phill Forbes asked if there will be any discharge from the system. Mr. Ball noted that the manufacturers indicated there isn't. Chief Building Official Neil Poulsen noted it would be similar to a water softener process. Mr. Ball noted that a State of Montana official had assured him it would take a tremendous flood or an earthquake to cause any kind of discharge. Development Review Conunittee Minutes-September 8. 1998 1 Mr. Poulsen noted that the Parks Department covered most of the Building Department issues. He also noted that Bozeman is in a level 3 earthquake zone. Mr. Ball noted that if the floor could be designed completely level, there would be less chance for drainage into an existing drain. Mr. Cannata noted that the difference would be that only 2 inches of water are needed rather than 8 inches. Mr. Ball asked if the conditions from the Parks Dept. are negotiable. Planner Arkell noted she could add "or as amended by the Parks Department," to allow for Parks Dept. conditions. Mr. Hixson moved, seconded by Mr. Poulsen, to recommend approval as per the conditions of the DRC. The motion carried 5-0. It was noted the project will go to DRB tomorrow and the letters received will be forwarded to the City Commission. B. ONE WEEK OF ONE WEEK REVIEW Bozeman Athletic Club West CUP- Final Conditions #P-9643 - (Saunders) West Huffine Lane A review for a determination of the final conditions for the Conditional Use Permit. Mike Delaney joined the DRC. Associate Planner Chris Saunders noted this review is to add conditions due the annexation of the property and he reviewed the conditions to be added by the Planning Department. The Building and Fire Departments had no additional comments. Planner Saunders reviewed the requirement for the easement for water. Project engineer Rick Hixson noted that all infrastructure will be required for the whole site rather than just for the athletic club to eliminate the need for street cuts for future installation. Discussion followed on looping water mains, adequacy of future looping possibilities, the need for a temporary cul-de-sac, and access to any manholes or water mains. City Engineer Craig Brawner asked if the infrastructure would be installed to a certain point. Mr. Delaney noted it would be, however, there will be no sewer flowing at this time. Mr. Hixson noted a concern about the design of the intersection. Planner Saunders noted changes in condition #17 to allow water and sewer use, and condition #14 (regarding the traffic signal) to include the cost share as the bid for it has been let. Mr. Delaney asked for the approval of this Site Plan contingent upon the annexation. Planner Saunders noted the condition is basically the same - the City needs the annexation agreement prior to Final Site Plan approval. Mr. Delaney noted that for banking purposes, he needs the site plan approved or at least conditional approval. Chairperson Skelton asked if there is any action to be taken today. Mr. Brawner noted that with the move and the office being closed, he'd like at least one more week and preferably two more weeks to write the conditions. He requested two more weeks for review. Planner Saunders asked if they would like the next review to be in two weeks. Chairperson Skelton Development Review Conunittee Minutes-September 8.1998 2 noted it will be rescheduled for two weeks, September 22. C. INITIAL WEEK REVIEW 1. Rose Park MaSub Preliminary Plat #P-9843 - (Arkell) West Oak Street A Major Subdivision Preliminary Plat Application to subdivide 9.64 acres into 24 multi-family, residential lots. Lowell Springer joined the DRC. Assistant Planning Director Debbie Arkell noted the changes required of Mr. Springer to complete the original submittal. She reviewed comments from Mr. Springer. She noted Ron Dingman, Parks Dept., does not want the two proposed parks and suggested they become common open areas. Planner Arkell noted she recommends the lots be made larger to accommodate easier building sites. Mr. Springer noted he has already laid out 4 plexes and the lots are plenty large. City Engineer Craig Brawner noted that the storm detention areas may not be large enough and are located very close to the sidewalks. Mr. Springer noted there are retention areas on each lot. The detention area is for the run off from the common areas and streets. Planner Arkell read the comments from Police Captain Bill Kayser. Project Engineer Rick Hixson asked if Morrison-Maierle had done the traffic study. Mr. Springer noted his office had done it with numbers from Morrison-Maierle and the City Engineer's office. He noted that Scott Bell is preparing it now. Mr. Brawner noted that Oak Street will likely become an arterial. The roadway dedications done at this time will be inadequate sometime in the future. Discussion followed on the right- of-way requirements and the need for an additional 13 feet of right-of-way for an arterial. (Water/Sewer Superintendent Mike Certalic joined the DRC.) 2. Reach CUP/Var #Z-98141 - (Arkell) 1127 North Cedarview - A Conditional Use Permit Application with Variances to allow the construction of a 3 bedroom residential group home for developmentally disabled residents. Assistant Planning Director Debbie Arkell reviewed the application, the variances, the use of the existing garage as an office. She noted the key questions will probably be the variances. Discussion followed on setbacks, Water/Sewer Superintendent Mike Certalic distributed his comments. City Engineer Craig Brawner discussed landscaping the boulevard. 3. Holiday Stores MiSP #Z-98152 - (Skelton) Development Review Committee\linutes-September 8.1998 3 Northwest corner of Durston Road and North 19'h Avenue A Minor Site Plan Application to allow the construction of a one-story convenience store, car wash, and fuel dispensing station. Chairperson/Planner Dave Skelton presented the application. Lowell Springer joined the DRC. Chairperson/Planner Skelton noted this will be an artificial lot, then asked Mr. Springer when the final plat will be completed. Mr. Springer noted he plans to have all improvements except paving done this fall for this site and the Chamber of Commerce site. Chairperson/Planner Skelton asked if the signalization will have to be financially guaranteed. Project Engineer James Nickelson noted that would be possible. Discussion followed on the variance granted for a 15 foot front yard setback, the boulevards, and the distance for the first access from an arterial intersection. Chairperson/Planner Skelton noted that the exact location of the street will have to be determined. City Engineer Craig Brawner discussed the need for a raised boulevard. Project Engineer James Nickelson noted that the traffic signal will be required prior to occupancy. Discussion followed on the distance from an arterial street intersection to a private drive, the width required for the private drive, and the effect of narrowing the driveway on tankers and other Iarge vehicles. Water/Sewer Superintendent Mike Certalic asked about the location of the water sewer lines in one area. Mr. Springer noted he would ask Morrison-Maierle to provide the information. 4. Castlebar PUD ##Z-98144 - (Skelton) 1200 North 25" Avenue - A Planned Unit Development to allow the development of a 72 unit apartment complex and related site improvements on a 6.748 acre tract of land Lowell Springer Chairperson/Planner Dave Skelton presented the application. He noted the phases have been flip flopped, phase 1 is now phase 2, etc. Mr. Springer explained the changes made in the plans since the informal. City Engineer Craig Brawner noted that North 22"d Avenue will be a collector in the future and there is a possibility for a signal at North 22"d Avenue and Durston Road. Chairperson/Planner Skelton noted idea of the developers of Castlebar is to complete North 25`h Avenue, but do nothing to North 22nd Avenue or Oak Street. City Engineer Craig Brawner noted that there a couple items that are problematic - streets and infrastructure prior to beginning construction. He noted that if the SID for Oak Street, North 25`h Avenue, and North 27' Avenue is created, there might be some leeway on the street paving. Mr. Springer noted that there would be separate SID's for each street. Mr. Brawner noted there would be provisions for phasing the improvements. Chairperson/Planner Skelton noted the design for the North 27d' Avenue/Oak Street intersection is needed. Public Service Director Phill Forbes explained there is no such thing as a "fast track' as far as this Committee is concerned. Mr. Brawner noted there will be no plats for the rights-of-way to be shown. Chairperson/Planner Skelton will check to see if they can be required as part of the PUD.
