McNee Assistant Planning Director Debbie Arkell called the meeting to order at 10:00 and was named Chairperson, Pro Tem. A. FINAL WEEK REVIEW 1. Montana Meadows Annexation #A-9707- (Arkell) North of Durston, West of Cottonwood An Annexation Application to annex 159 acres. 2. Montana Meadows MPA#P-9740 - (Arkell) North of Durston, West of Cottonwood A Master Plan Amendment Application to amend the Master Plan from Rural Residential to Urban Residential. 3. Montana Meadows ZMA#Z-97132 - (Arkell) North of Durston, West of Cottonwood A Zone Map Amendment Application to change the zoning from A-S "Agricultural Suburban"to R-3 "Residential, Medium Density" and B-1 "Neighborhood Service District". Rhonda Rose, Alan Drecksler, Jack Schunke, and Glenn Wood joined the DRC. Chairperson/ Planner Arkell reviewed the location, size, and conditions for the annexation. (All staff reports are on file in the Planning Office.) Project Engineer Rick Hixson reviewed his comments,noting they are still a work in progress. Chairperson/Planner Arkell clarified the widths needed for various future streets. Mr. Hixson noted that a floodplain survey will be required prior to subdivision. (Public Service Director Phill Forbes arrived.) Water/Sewer Superintendent Mike Certalic reviewed his comments. Deputy Fire Chief Al Scholes reviewed the comments from the Fire Department. Development Review Committee Minutes-July 28,1998 1 City Engineer Craig Brawner noted that, over-all, the City is concerned about the master plan for the infrastructure. He noted there may be a need for a regional lift station for sewer service in that area. He is concerned about the installation of a private, permanent lift station as, when other properties in that area develop, they will want to make connection to the private lift station, which may not be adequate in size. Mr. Schunke noted the solutions they have explored. Discussion followed on the requirements for a subdivision pre-application. Mr. Schunke asked about the possibility of a shared response with the Rural Fire Departments for fire protection. Mr. Scholes explained how the shared response works. He also noted that if a third station were installed, it wouldn't be installed there. Discussion continued on fire protection needs. Mr. Schunke asked if there are a lot of areas that have a response time beyond what is desirable. Mr. Scholes noted there are several subdivisions that are beyond the recommended response time, and, those subdivisions have been required to installed sprinklered units. He noted that the holdup for a new building location is funding for staffing. There probably are funds available for a building, however, a new building may require the moving of one of the present stations. He noted, in response to Mr. Schunke's question,the third station is probably to be located somewhere west of the Mall. He continued that the second station would need to be moved further south on 19"Avenue South. Ms. Drecksler asked about Planner Arkell's condition#9 regarding affordable housing. Planner Arkell noted the condition is similar to one placed on the Deaconess Hospital Annexation by the City Commission. Discussion continued on the condition and its meaning. Mr. Schunke asked about the sewer/water facilities plan that will be required. He asked if the developer or the City would do the update. Mr. Hixson noted that the developer would probably be required to do the update as the City had just completed a facilities plan. Mr. Brawner further elaborated on Mr. Hixson's explanation. Chairperson/Planner Arkell noted that the Planning Office feels that the changing of the Master Plan is appropriate, and the zoning designations requested are appropriate only if the property is first annexed. Chairperson/Planner Arkell noted that DRC doesn't vote on these applications,however, recommended conditions are forwarded to the City Commission. Mr. Schunke commented that the intent is to get a commitment from the City on the Annexation so the infrastructure can be installed properly. It will help the developer plan for the future uses. Parking Commission Parking Lot MiSP/COA/Dev#Z-98110- (Skelton) 108-110 South Black Avenue A Minor Site Plan Application with a Certificate of Appropriateness to allow the removal and relocation of two existing residential units and the installation of a parking lot. James Goehrung and Mark Chandler joined the DRC. Chairperson/Assistant Planning Director Debbie Arkell reviewed the conditions in Senior Planner Dave Skelton's absence. Mr. Goehrung he is doing the application on behalf of the Parking Commission, and the bank is willing to entertain an access to the parking lot from their parking lot. He reviewed some of the options that have been considered. Chairperson/Planner Arkell noted that attempting to save the two trees makes the parking difficult. Mr. Brawner noted the back up space just isn't there with the trees in place. Discussion continued on the two trees,parking spaces, and back up maneuverability. Mr. Brawner asked if the bank is okay with a shared access. Mr. Goehrung noted the bank is agreeable, however, they suggested leasing the spaces instead of making the lot fully open to the public. Public Service Director Phill Forbes noted that he is in favor of removing the trees, leaving the narrower driving aisle, and the shared access with the bank on the east. Mr. Brawner noted he is not in favor of creating a one way driving aisle. Discussion continued on the removal/non-removal of the trees, the continuance of the project, and the removal of the South Bozeman Avenue tree to allow for a wider driving aisle width. Project Engineer James Nickelson noted they may elect to remove the tree and not deviate on the driving aisle width. Mr. Brawner noted he would not support the deviation, however, he noted that Mr. Forbes has the authority to allow the deviation. Chairperson/Planner Arkell noted the DRC is back to the original site plan and the project will be continued until next Tuesday for final comments. B. THIRD WEEK OF A FOUR WEEK REVIEW 1. The Gallatin Center MaSub and Zoning PUD#P-9834& #Z-98119 - (Arkell) West of North 19"Avenue between Baxter Lane and Valley Center Drive A Major Subdivision Application and a Zoning Planned Unit Development Application to allow the subdivision of 141.65 acres into 27 lots for a commercial Planned Unit Development. (Third of four reviews) Gene Graf, Dave Jarrett, Chris Wasia, Scott Bell, Diane Bellgowin, and Steve Hundley joined the DRC, as did Rob Bukvich of MDOT. Chairperson/Planner Arkell reviewed her preliminary comments. (All comments are on file in the Planning Office.) Water/sewer Superintendent Mike Certalic reviewed his comments, addressing#5, #6, and#7 specifically. Project Engineering James Nickelson reviewed his preliminary comments. Mr. Bukvich noted Development Review Committee Minutes-July 28,1998 3 that the signalization at Catron Street and Valley Center Road has some legal ramifications. City Engineer Craig Brawner noted that a detailed evaluation of the intersection should be done immediately, then the light installed prior to the phase when it is needed. He continued the signal light would be installed in concurrence with MDOT. Discussion followed on not allowing occupancy of the Target Store until the traffic study is completed and a determination on the signalization need has been made. Mr. Brawner noted that the building permit will be permitted upon the filing of the FSP for the Target Store. Discussion followed on scheduling of the approvals, building permits, and the SID for water. Mr. Graf noted Target doesn't plan to open until October of 1999. Mr. Hundley asked for the radius of the cul-de-sac. Mr. Nickelson noted that 50 feet is adequate. Mr. Bukvich noted a concern with the number and location of accesses. He agreed with the terms of signalization at the intersection, and the possible need to modify the striping on North 19th to accommodate the turning capabilities. Mr. Jarrett asked if extra striping as the streets intersect N. 19`h Avenue would be adequate. Mr. Bukvich noted it would. Chairperson/Planner Arkell noted that the 4-lane street from Oak Street north would need to be continued at some time in the future. Mr. Bukvich noted that stormwater drainage may be a problem Mr. Forbes noted a concern with the process/progress of the SID holding up this project. He noted the timing of building permits, what problems might occur, bids could come in too high,the time it will take to sell the bonds, and when the bids will be let could hold up the building permit. Chairperson/Planner Arkell noted that Target needs to be advised that the SID progress could hold up the opening of the Target Store. She noted that next week the final conditions will be discussed, and a recommendation made to the Planning Board. 2. Bridger Peaks Town Center MaSub & Zoning PUD #P-9834, #Z-98119 - (Saunders) Northeast corner of North 19"Avenue and Oak Street A Major Subdivision Application and a Zoning Planned Unit Development Application to allow the subdivision of 42.24 acres into 13 lots for a commercial Planned Unit Development. (Third of four reviews) Keith Belden, David Hutchinson, Shelley Engler, Andy Stephens, and Rob Bukvich of MDOT joined the DRC. In the absence of Associate Planner Chris Saunders, Chairperson/Assistant Planning Director Debbie Arkell presented the application and reviewed the recommended conditions. Discussion followed on the conditions, the timing of the building permit, and the financial guarantee for infrastructure installation. She asked the questions that Planner Saunders wanted answered and the applicants responded to them. Project Engineer James Nickelson reviewed his preliminary conditions. Discussion of the conditions followed. Mr. Belden noted that this particular land owner has already participated in the SID for North 19'and he anticipates that the City will construct the noted improvements for North 19th. Public Service Director Phill Forbes noted that a determination will have to be made if this project Development Review Committee Minutes-July 28,1998 4 is triggering acceleration/deceleration lanes. Mr. Bukvich noted that North I9th Avenue has rapidly outgrown the original capacity, and it is time to look at the signalization of Baxter and North 19th. He noted a concern with the location of the access from Oak Street. He discussed the storage space on 19th,the taper of the street from 4 lanes to two lanes, and storage space on the east side. Discussion continued on the turn lanes and traffic projections. Mr. Belden asked Mr. Bukvich for his thoughts on signalization at Tschache and 19'Avenue. Mr. Bukvich noted he would be surprised if the traffic sturdy would show it is warranted. Mr. Brawner discussed the possible need for signalization for the main access into the development from Oak Street. Discussion continued on the possible signalization and turning lane needs in the area including required right hand turns. Mr. Bukvich noted he'd rather not signalize the entrance into Safeway. Chairperson/Planner Arkell noted that the name of the street, Tschache, may cause problems for emergency personnel due to the spelling and pronunciation(Shocky). Water/Sewer Superintendent Mike Certalic reviewed his conditions and comments. After discussion, his condition#8 was eliminated. Chief Building Official Neil Poulsen and Mr. Stephens discussed the Plan and Check review and meeting the requirements of the Building Code. Mr. Stephens asked about the accesses from Oak Street and alignment of the entrance to the development with North 17"Avenue. He noted there is difficulty in aligning the street/access as the alignment will encroach into the Farmer's Canal, Mr. Bukvich noted that off sets in the turn lanes lead to head-on collisions and should be avoided. Discussion continued on the stacking for left turns and the need for a temporary water supply. C. FIRST WEEK REVIEW 1. Baxter Creek Business Park PUD Concept/Pre-Ap #Z-98126 - (Arkell) Huffine Lane, West of J.C. Billion - A Planned Unit Development Concept Plan and a Pre-Application Application to subdivide 17.56 acres into 7 lots for commercial development. Jack Schunke and Glenn Wood joined the DRC. Chairperson/Assistant Planning Director Debbie Arkell presented the application. Mr. Schunke noted that the purpose of the 50 foot street width is to discourage street parking with no parking allowed on the street. He noted the need for a transition of the width of the existing street to the proposed street. He noted they want to connect to the Billion water and sewer systems after they are certified and connected to the City's systems. Discussion followed on the proposed streets and intersections with existing streets. Rob Bukvich, MDOT, noted that the access was granted for a private access and the applicant may be in violation if he develops it into a public road. City Engineer Craig Brawner asked Mr. Schunke if he could avoid locating the two accesses so close together. Mr. Schunke explained the road/street system and the parcel of land to the west Development Review Conunittee Mimites-July 28,1998 5 41 feet by 1/4 mile deeded to the Nortons and a strip on the east side along 360 Ranch that belongs to the 360 Ranch. Public Service Director Phill Forbes suggested that Mr. Schunke get a copy of the list of deficiencies of the Billion water system. Mr. Schunke noted it would be in the best interest of both parties to resolve those deficiencies. Discussion followed on the location of the access from 191. 2. Allison Minor Subdivision Preliminary Plat#P-9839 - (Olsen) Arnold Street, north of Morning Star School A Minor Subdivision Preliminary Plat Application to create 5 lots with a remainder for single family development. In Associate Planner Jody Olsen's absence, Chairperson/Assistant Planning Director Debbie Arkell presented the application, noting the determination of the Planning Director that it is a minor subdivision, as the remainder parcel will not be considered a lot within the subdivisoon. Discussion on stormwater drainage followed. Water/Sewer Superintendent Mike Certalic noted that sewer is stubbed to the property, however, they will need to extend the water. Discussion followed on the possible need for a lift station, fill material, and the infrastructure to be required, For the Betterment of the DRC: The question was brought up as to why the Osterman Pre-application wasn't on the agenda.
