Vice-Chairperson Chuck Winn called the meeting to order at 10:05 a.m.
A. FINAL WEEK REVIEW
1. Adam Bronken Sports Complex MaSP #Z-98121 - (Olsen)
Extension of Cottonwood and Durston
A Major Site Plan Application to develop a sports complex.
Neither the applicant nor the representative were in attendance. Planner Jody Olsen presented her
recommended conditions.
Project Engineer Rick Hixson reviewed recommended conditions, noting they are mostly standard
conditions.
Discussion followed on water main extensions. Glen Wood joined DRC. He noted the water
main will be extended farther west and will go through this area. Vice-Chairperson Winn noted
there is a need for one fire hydrant within 300 feet of the concessions stand.
City Engineer Craig Brawner asked if there will be local access drives installed over the water
mains inside the park. Mr. Wood noted that eventually the local access drives would be installed.
Public Service Director Phill Forbes moved to recommend approval with conditions outlined by
DRC, seconded by Mr. Hixson. Carried 5-'0.
2. Ranch:and Home Expansion MaSP/COA#Z-98120 - (Skelton)
2275 North 7"'Avenue
- A Major Site Plan Application to allow an approximately 20,000 sq. ft.
addition to the existing retail structure.
Jerry Gaston and Nick Salmon joined the DRC. In Planner Skelton's absence, Planner Jody Olsen
presented the recommended conditions of the Planning Staff. Mr. Gaston asked if the 1 in 4 slope
for the retention/detention ponds is a code requirement. Project Engineer Rick Hixson noted it is
easier to maintain, however, in some cases, 3 to 1 slopes could be installed if there isn't room for
4 to 1 slope. Mr. Gaston asked to change the condition to read a slope that the owner can

maintain. City Engineer Craig Brawner suggested changing the condition to read 4 to 1, or as
otherwise approved, and as maintainable. Public Service Director Phill Forbes noted the DRC
wouldn't want to approve something that is too deep or too steep for public safety.
Project Engineer Rick Hixson reviewed his recommended conditions. Mr. Salmon noted that the
short segment of sidewalk noted in condition#6 is installed. Mr. Hixson asked that it be properly
depicted on the FSP.
Mr. Forbes asked Planner Olsen to confirm that there is a waiver of right to protest signalization
at Griffin and North 7th. Mr. Salmon noted that Mr. Murdock has signed waivers on
signalization for the last two lots, and Will Thompson may have signed one for the whole
property
Mr. Hixson moved to recommend conditional approval, based on conditions of the DRC. The
motion was seconded by Mr. Certalic, and carried 5-0.
B. THIRD WEEK OF A FOUR WEEK REVIEW
1. Montana Meadows Annexation #A-9707 - (Arkell)
North of Durston, West of Cottonwood
- An Annexation Application to annex 159 acres.
2. Montana Meadows MPA#P-9740 - (Arkell)
North of Durston, West of Cottonwood
A Master Plan Amendment Application to amend the Master Plan from Rural
Residential to Urban Residential.
3. Montana Meadows ZMA#Z•-97132 - (Arkell)
North of Durston, West of Cottonwood
A Zone Map Amendment Application to change the zoning from A-S
"Agricultural Suburban"to R-3 "Residential, Medium Density" and B-1
"Neighborhood Service District".
Glenn Wood, Rhonda Rose-Drecksler, and Allen Drecksler joined the DRC. Assistant Planning
Director Debbie Arkell noted that comments for the annexation report to City Commission are
due next week. The staff report for the MPA and ZMA are due later. She reviewed her
preliminary conditions.
Public Service Director Phill Forbes asked for the difference between Urban Residential Infill and
Urban Residential designations. Planner Arkell explained.
City Engineer Craig Brawner noted that the sewer and water facilities plan do not include this
area. He noted it may be difficult to get sewer service to this site gravity-wise. He noted this
property could become a part of a future interceptor line in a future service area. He noted the
City may require a water and sewer facility plan update to be done at the applicant's expense. Mr.
Wood noted the service areas of the new Valley West trunk. His firm has done a survey to

determine that the sewer trunk will handle the sewer needs. He reviewed the water main
extensions existing and proposed. Project Engineer Rick Hixson noted that the 12-inch line will
have to be reduced somewhere to prevent back feed. Planner Arkell asked if Morrison-Maierle,
Inc. had done the study to include the Baxter Creek Business Park. Mr. Wood noted they had.
Mr. Brawner elaborated on the needs of the water and sewer within the service area and noted it
does not include areas, such as this, outside the service area. He was concerned about the service
lines being large enough for the future needs of this property and others around it. Mr. Wood
noted his firm has taken some of those concerns into consideration with the northerly placement
of the water and sewer mains for easy connection to future trunks and mains. Mr. Forbes asked
how long the forced main is. Mr. Wood noted it is about 3,000 feet. Mr. Forbes asked who will
maintain it. Mr. Wood noted they haven't determined if it will be privately or publicly maintained.
He noted that Durston Road will be extended with a R/SID and the process has started, with
construction going through 1999 and maybe into 2000. Mr. Brawner noted that the City is
looking for collector streets at the half section lines. Planner Arkell noted which easements and
dedications for streets that have been given.
Mr. Brawner asked for the development schedule for the property. Mr. Wood noted the
subdivision of the property will begin in the near future and whether it is phased or not will be
determine at that time.
Planner Arkell noted that the Fire Marshal had expressed a concern about the distance of the fire
station from this property for fire protection. She noted she needs comments for at least the
annexation application next week.
C. SECOND WEEK REVIEW
1. Bridger Peaks Town Center MaSub & Zoning PUD #P-9834, #Z-98119 -
(Saunders)
Northeast corner of North 19"Avenue and Oak Street
A Major Subdivision Application and a Zoning Planned Unit Development
Application to allow the subdivision of 42.24 acres into 13 lots for a commercial
Planned Unit Development. (Second of four reviews)
(This item was discussed after the Gallatin Center review.)
Keith Belden and David Hutchinson joined the DRC. Planner Chris Saunders presented the
application, noting most items discussed last week were Engineering concerns.
Project Engineer James Nickelson reviewed his concerns. Mr. Brawner further elaborated on
those concerns. A discussion of the stream/ditch followed. Mr. Hutchinson noted most of the
questions will be determined by where the City wants the street to intersect with Baxter Lane.
Mr.Nickelson noted that one concern in the pre-application was with sewer service from the
proposed main. Public Service Director Phill Forbes noted he doesn't like the offset on the water
main. Discussion followed on the water main alignment and street access points.
Water/Sewer Superintendent Mike Certalie noted that if they reworked their phasing, they could

eliminate the capping of lines.
Planner Saunders asked if the State Department of Environment Quality had commented on the
water flows. Discussion followed on its comments, the easements for streets within the
development, the phasing schedule, and the Building Code requirement for a 60 foot setback.
Mr. Belden asked about their request for a building permit prior to FSP. Planner Saunders noted
it may be possible. Discussion followed on the location of fire service lines during construction
and how fire protection will be provided during construction. Planner Saunders noted that a
holdharmless agreement would be required to protect the City in the event that fire protection was
needed and not readily available.
2. The Gallatin Center MaSub and Zoning#P-9834 & #Z-98119 - (Arkell)
West of North 19"'Avenue between Baxter Lane and Valley Center Drive
A Major Subdivision Application and a Zoning Planned Unit Development
Application to allow the subdivision of 141.36 acres into 27 lots for a commercial
Planned Unit Development. (Second of four reviews)
(This application was discussed prior to the Bridger Peaks Town Center review.)
Gene Graf, Dave Jarrett, Scott Bell, and Chris Wasia joined the DRC. Assistant Planning
Director Debbie Arkell presented the application, noting the applicants are requesting a
concurrent review of the Target Store site. She distributed larger plans, noting the applicants are
requesting a building permit for Target prior to the installation of water and sewer. Mr. Graf
noted the sewer is there, however, there is no water as of yet. Planner Arkelt noted that if any
City Staff feels that there are public safety issues, the City Commission needs to be aware of them.
She noted that a request to allow casinos is part of the application, and staff is not supporting that
use, in light of the recent adoption by the Commission of the Casino Overlay District. The
dedicated streets and street easements were reviewed. Discussion followed on the extension of
North 27th Avenue and whether the streets would be maintained privately or by the City. Mr.
Graf noted that all streets will be privately maintained. City Engineer Craig Brawner noted that
the collectors -North 27th Avenue and Deadman's Gulch, should be City maintained and curbed
and guttered. Discussion followed on the maintenance of the streets in the area. Mr. Graf
suggested giving the City a Waiver of Right to Protest an SID for the maintenance of North 27th
Avenue and Deadman's if they are not properly maintained privately. Phill Forbes indicated there
was no reason for these two streets to be maintained by the city when the rest of the streets in the
development are maintained by the owners association.
Mr. Graf noted that if access for each lot on the Thomas Drive were given to North 27th, that
may ease and make the construction of the street a more favorable proposition. Discussion
continued on the width of the easement/dedication of streets.
Planner Arkell asked for preliminary comments next week for the subdivision and the Target
store.
Project Engineer James Nickelson suggested installing a temporary a cul-de-sac at the end of the

service drive behind the Target store. Chairperson/Fire Marshal Winn concurred as it will allow
the fire trucks space to turn around.
3. Parking Commission Parking Lot MiSP/COA/Dev#Z-98110 - (Skelton)
108-110 South Black Avenue
A Minor Site Plan Application with a Certificate of Appropriateness to allow
the removal and relocation of two existing residential units and the installation of a
parking lot. (Open and continue until July 28)
Mark Chandler and James Goehrung joined the DRC. In Planner Skelton's absence, Assistant
Planning Director Debbie Arkell presented the application. Mr. Chandler noted the property is
owned by the Bozeman Parking Commission. Mr. Goehrung noted the City is doing the
application on behalf of the Parking Commission. Planner Arkell noted they are asking for two
deviations.
Public Service Director Phill Forbes noted that access from the back of the lot would make the
parking spaces in that area more accessible. Mr. Goehrung reviewed the comments from Ryan
Stover, City Forestry Department, on the existing trees. Discussion followed on the setback
along Bozeman, the reconfiguration of the parking spaces, and the existing fence between this
property and First Security Bank parking lot,
Project Engineer Karen Finke reviewed the comments from the Building Permit Coordinator
Kirsten Emborg.
D. INFORMAL REVIEW
1. BIockbuster Informal
11"' Avenue and West Main Street
An Informal Review for advice and comment.
Van Bryan, Apogee Architects,joined the DRC and presented his proposal, noting he's looking at
the lot on South 1 lth Avenue and Main Street where the used car lot is now. He'd like another
access from 111h Avenue. Public Service Director Phill Forbes noted that the State Department of
Transportation will have control over the accesses from Main Street and 111h Avenue. City
Engineer Craig Brawner noted that curb and gutter and sidewalk on Babcock will be required.
Planner Arkell noted that Mr. Bryan is aware that a MiSP with a COA would be required. Mr.
Forbes noted that the access on Main Street will monitor itself, however, any access from I lt"
Avenue could be a problem as the intersection at 11'Avenue and Main Street is a high accident
intersection. He would not recommend an access from I 11h Avenue. Mr. Forbes suggested
moving the building site more toward 111h Avenue, noting they could then have a shared access
with Arby's.
Mr. Bryan noted concern with accesses to the site.
Planner Arkell moved to adjourn the meeting. Mr. Forbes seconded the motion, which carried
unanimously.
