Chairperson Dave Skelton called the meeting to order at 10:00 a.m.
A. FINAL WEEK REVIEW
1. Comstock II CUP/Var#Z-9891 - (Olsen)
777 Haggerty Lane
- A Conditional Use Permit with a Variance Application to allow a 34 unit low
income apartment complex with a variance for parking requirements.
Dab Dabney, Jerry Taylor, Mark Chandler joined the DRC. Planner Jody Olsen reviewed her
conditions. She noted that the rural fire district commented that the property should be annexed
as they didn't want to service the property.
Project Engineer Rick Hixson reviewed his comments. Mr. Chandler asked when the side slope
for stormwater ponds had changed from 3:1 to 4:1. Mr. Hixson noted that the Engineering
Department has always preferred the 4:1 slope unless it just won't fit on the lot, then 3:1 is
acceptable. He noted it is more difficult to maintain and mow a 3:1 slope. Mr. Chandler asked if
condition#7 hadn't been done when the line was installed. Mr. Hixson noted it wasn't and needs
to be done with this development. Mr. Chandler asked if the easement in condition#9 hadn't
already been granted. Mr. Hixson noted he sent the easement document to the applicant a year
ago and it hasn't been returned as of yet.
Fire Marshal Winn noted two on-site fire hydrants will be required. He will work with Mr.
Chandler to place them in the best locations.
Water/Sewer Interim Superintendent Mike Certalic noted he has no further comments from last
week
Mr. Hixson moved to recommend approval as per conditions of the DRC. The motion was
seconded by Mr. Certalic and carried 4-0.
2. Grum's Deli Expansion MiSP/COA#Z-9897 - (Skelton)
2107 North 7"Avenue
- A Minor Site Plan Application with a Certificate of Appropriateness to allow
a 750 sq. ft. expansion and related site improvements to an existing restaurant.
Jerry Taylor and Will Thompson joined the DRC. Chairperson/Senior Planner Dave Skelton
reviewed his recommended conditions.
Project Engineer Rick Hixson reviewed his conditions, noting condition#4 is not needed as it has
been completed.
Water/Sewer Interim Superintendent Mike Certalic noted he gave his comments last week.
Mr. Hixson moved, Mr. Certalic seconded, to conditionally approve this application along with
ADR Staffs approval. The motion carried 4-0.
B. ONE WEEK REVIEW
Madison Place Apartments MaSP Modifications#Z-9809 - (Olsen)
415 and 427 Michael.Grove Avenue
- A review of modifications proposed to an as yet unapproved major site plan.
Lowell Springer joined the DRC. Planner Jody Olsen presented the changes to the approved Final
Site Plan, and reviewed the one additional comment.
There were no comments from the Engineering, Fire, or Water/Sewer Departments.
Mr. Springer noted the reason for the reconfiguration was to create more green space and to
make the development safer for children.
C. SECOND WEEK REVIEW
1. Castlebar Apartments Concept PUD #Z-98105 - (Skelton)
Oak Street and North 25"
A Concept Planned Unit Development Application to allow the construction
of 12 6-apartment buildings in two phases.
Lowell Springer, Kim Just, and Tom Mannachreck joined the DRC. Chairperson/Senior Planner
Dave Skelton reviewed comments from last week, noting the applicant prefers not to loop the
water in the first phase. He noted that Concept PUD's are not presented to the City Commission.
Project Engineer Rick Hixson reviewed his concerns. Water/Sewer Interim Superintendent Mike
Certalic and Mr. Mannachreck discussed the location of and looping of the water. Mr.
Mannachreck noted he is willing to install a looped system through the whole property. He
suggested laying the service line down a hallway of the senior center. Mr. Certalic noted the City
would prefer not to have the service lines under any structures. Discussion followed on
developing North 27th Avenue. Mr. Springer noted they are looking for a favorable
recommendation for not extending Oak Street the full distance in Phase 1. He and Mr.
Mannachreck noted they are willing, as a compromise, to build out Phase 2 first so they only build
one street with each phase.
Discussion followed on the wording of the notation on the plat for the access. Mr. Springer
questioned if they ask for leniency on constructing Oak Street and North 27th Avenue at the
same time as the initial Phase, could Staff support it. Mr. Hixson noted that Staff could, but it is
important to note that the City Engineer and the Public Service Director are the ones to make the
decision. Chairperson/Planner Skelton noted that if Phase 2 were developed first, it would help
Staff support the application. Discussion followed on a required secondary access.
Chairperson/Planner Skelton noted that written comments are due next week. He asked Mr.
Springer if he knows where Morrison-Maierle is on the design for North 27th Street. Mr.
Springer noted he would be able to bring an update next week.
2. Connell Motor Service Bays MiSP/COA #Z-98103 - (Skelton)
1735 West Main Street
- A Minor Site Plan Application with a Certificate of Appropriateness to allow
a 2,669 sq. ft. addition on the west elevation for service bays.
Dan Kamp joined the DRC. Chairperson/Senior Planner Dave Skelton reviewed comments from
last week. Fire Marshal Chuck Winn noted his department has two issues: 1-is the existing
sprinklering connected as proposed. Dan noted it is all installed, however,the City hasn't
connected it to the service line. Water/Sewer Interim Superintendent Mike Certalic noted that if a
larger line is required, then the owner has to install the larger line. Mr. Winn noted that the
existing fire sprinklers need to be serviceable before any further work is done. His second issue is
with several items not being in compliance with the building code.
Mr. Kamp noted that Jerry Taylor did the building code review and that is why there is the
separation of the new bays from the existing ones by a fire door. Mr. Winn noted he would have
a problem supporting the new bays until the non-conforming building and sprinklering system are
addressed.
Discussion followed on the service line needed for the sprinkler system. Mr. Certalic distributed
his comments. Further discussion followed on the conditions and the locations of existing sewer
and water mains.
Chairperson/Planner Skelton noted that a decision will be made next week. He noted he wants to
verify the parking requirements before then.
D. INITIAL WEEK REVIEW
I. Wok CUP#Z-98118 - (Olsen)
319 North 7"Avenue
- A Conditional Use Permit to allow serving beer and wine. (First of a two
week review)
Planner Jody Olsen noted that the applicant is not constructing the previously approved addition.
This application is only for serving beer and wine.
2. Adam Bronkin Sports Complex MaSP#Z-98121 - (01sen)
Extension of Cottonwood and Durston
A Major Site Plan Application to develop a sports complex.
Planner Jody Olsen presented the application. Assistant Planning Director Debbie Arkell noted
the park hasn't been deeded or dedicated to the City, however, it has been annexed. Project
Engineer Rick Hixson noted there was no provision made for the development to be served by the
water extension, which stops at Cottonwood. Fire Marshal Chuck Winn noted they will be
required to provide water for fire protection.
Project Engineer Rick Hixson noted that paving of Durston Road may be required and the water
supply has to be addressed, it will require a main extension for water and sewer.
3. Ranch and Home Expansion MaSP #Z-98120 - (Skelton)
2275 North 71h Avenue
- A Major Site Plan Application to allow an approximately 20,000 sq. ft.
addition to the existing retail structure.
Chairperson/Senior Planner Dave Skelton presented the project. Water/Sewer Interim
Superintendent Mike Certalic presented his comments. He noted that since the greenhouse is
located on a separate lot, he will consider installing a service line, or the City will install a meter
pit and the owners would install the water from there. He noted there would be no service
installed unless there was a provision for heating the greenhouse to keep the water from freezing
in the winter.
4. Crocker MiSub Pre-Application Application #P-9835 - (Arkell)
328 North Church Avenue
- A Minor Subdivision Pre-Application Application to allow the creation of
two lots, one for an existing 4-plex and one for a new single family residence. First
of a two week review)
Assistant Planning Director Debbie Arkell presented the application. Water/Sewer Interim
Superintendent Mike Certalic reviewed his comments. The DRC noted that paving and curb and
gutter would be required on Fridley Street.
5. Montana Meadows Annexation #A-9707 - (Arkell)
North of Durston, West of Cottonwood
- An Annexation Application to annex 157 acres.
6. Montana Meadows MPA#P-9740 - (Arkell)
North of Durston, West of Cottonwood
A Master Plan Amendment Application to amend the Master Plan from Rural
Residential to Urban Residential.
7. Montana Meadows ZMA#Z-97132 - (Arkell)
North of Durston, West of Cottonwood
A Zone Map Amendment Application to change the zoning from A-S
"Agricultural Suburban"to R-3 "Residential, Medium Density" and 13-1
"Neighborhood Service District".
Assistant Planning Director Debbie Arkell presented the applications. Water/Sewer Interim
Superintendent Mike Certalic presented his comments. Fire Marshal Chuck Winn asked what
would happen if the DRC recommended denial of an application. Mr. Certalic noted he was
recommending denial of these applications. Discussion followed on the submission of written
comments to be forwarded to the City Commission.
Chairperson Skelton suggested Mr. Certalic expand upon his conditions to include the time
involved in flushing the mains and the amount of water wasted.
E. INFORMAL REVIEW
Mahar Subdivision Informal#I-9831 - (Arkell)
West Babcock Road
An Informal Application for advice and comment.
Jonathan Roen and Joe Mahar joined the DRC. Assistant Planning Director Debbie Arkell
presented the application.
Assistant Director Arkell reviewed her comments on the potential development of this land, and
questioned the status of the irrigation ditch. Mr. Roen noted he will investigate the ditch further
and locate the termination of the water rights. He explained the layout of the lots, then asked for
comments on the offset "T" intersection. Project Engineer Rick Hixson noted the City has always
intended to extend Mendenhall Street as a through street. He noted that this design is against
what the City intends to do. Mr. Roen noted that as the City has planned the extension of
Mendenhall,the lots adjoining the street are unbuildable.
Planner Arkell asked how they intend to handle stormwater drainage. Mr. Roen noted they plan
to use some of the capacity in the retention pond in Willows subdivision. Peg Potter,Realtor,
joined the DRC. Discussion followed on the required road width, annexation requirements, sewer
capacity, the planned improvement of West Babcock Street in two years,the fact that the
property could not be developed until West Babcock Street is improved, the use of the Willow
Subdivision pond for storm water drainage, and the annexation/subdivision process.
Mr. Roen presented an alternate site plan for a different location for Mendenhall.
