MINUTES Members Present: Dave Skelton, Mike Certalic, Craig Brawner, Chuck Winn, Neil Poulsen, Phill Forbes Staff Present: Debbie Arkell, Jody Olsen, Chris Saunders, Carol Schott, Visitors Present: Bayliss Ward, Dab Dabney, Scott Smith, Wayne Frederickson, Mark Chandler, Bill Hanson, Will Thompson,Lowell Springer, Thomas Mannachurik, Carroll Henderson Chairperson Dave Skelton called the meeting to order at 10:00 a.m. A. FINAL WEEK REVIEW Smith Nursery/Unit MiSP#Z-9884- (Arkell) 6851 Patterson Road - A Minor Site Plan Application to allow the development of a plant nursery stock farm and the construction of a caretaker's dwelling unit. Scott Smith joined the DRC. Assistant Planning Director Debbie Arkell presented the conditions from her office, noting the applicant has approval from Department of Health and Environmental Sciences. City Engineer Craig Brawner noted an approval from the County Road Office will be required. Planner Arkell noted it has already been obtained. Chairperson Skelton moved to approve as per conditions of the DRC. Mr. Brawner seconded the motion, which carried 4-0. B. ONE WEEK REVIEW Big Sky RV Further Development#Z-9407A- (Skelton) 8466 Huffine Lane - A Further Development Application to allow the addition of 2 new service bays on the south elevation of the existing building. Bayliss Ward and Wayne Frederickson joined the DRC. Chairperson/Senior Planner Dave Skelton presented the application. Discussion followed on the depth of the culvert. Mr. Frederickson noted it is about two feet deep and a 36" culvert, and the direction of the flow. Chairperson/Planner Skelton noted there will be a hold harmless condition put on any approval given; he will check with the rural fire department and the Building Department for their comments. Discussion followed on the hold harmless agreement, storm drainage, and the status of the bays as dry shops with work pits. Development Review Committee Minutes-June 30,1998 1 C. SECOND WEEK REVIEW 1. Comstock II CUP/Var#Z-9891 - (Olsen) 777 Haggerty Lane - A Conditional Use Permit with a Variance Application to allow a 34 unit low income apartment complex with a variance for parking requirements. Dab Dabney, Mark Chandler, and Bill Hanson joined the DRC. Planner Jody Olsen reviewed the application and the comments from last week. She noted that annexation was discussed by DRC and that she will be recommending annexation of both existing-phases and any future phases. City Engineer Craig Brawner noted that at the least, the City needs a waiver of right to protest annexation and an application for annexation before FSP approval. Mr. Dabney noted he needs to be under construction by the end of September and spend a certain amount of money or he will lose his tax credits. Mr. Hanson noted that the major issues are the improvements to Ellis Street. Mr. Brawner asked about the ingress/egress ability off Haggerty and noted it appears that curb and gutter are shown over a utility easement. (Chief Building Official Neil Poulsen arrived.) Discussion followed on the location of fire hydrants, drive access, fire access, existing water service, drive aisle widths, and the variance for providing less parking than is required. Water/Sewer Interim Superintendent Mike Certalic reviewed his comments. 2. Grum's Deli Expansion MiSP/COA#Z-9897 - (Skelton) 2107 North 7" Avenue A Minor Site Plan Application with a Certificate of Appropriateness to allow a 750 sq. ft. expansion and related site improvements to an existing restaurant. Will Thompson and Bill Hanson joined the DRC. Chairperson/Senior Planner Dave Skelton reviewed the comments from last week and presented the application. Mr. Thompson explained the drainage plan. City Engineer Craig Brawner suggested laying concrete all the way to the detention area as the grassy area will dam the water and cause problems. Water/Sewer Interim Superintendent Mike Certalic reviewed his comments. (Public Service Director Phill Forbes joined the DRC.) Mr. Thompson and Mr. Certalic discussed the location of existing water and sewer services. Chairperson/Planner Skelton noted that a sidewalk wasn't installed with the redevelopment of the radio station as there wasn't any connection to another sidewalk due to no other development in the area at that time. Discussion followed on requiring the extension of the east/west sidewalk, the need or not of a sidewalk at this time, and the possible widening of Highway 10 and its effect on this project, Development Review Committee Minutes-June 30,1998 2 D. INITIAL WEEK REVIEW 1. Bozeman Athletic Club West CUP FSP #Z-9643 - (Saunders) 8601 Huffine Lane - A Re-review of the Final Site Plan for the Conditional Use Permit for conformance with City infrastructure standards. Planner Chris Saunders presented the application. He asked if the information and materials presented are enough to continue the review or if Mr. Delaney needs to start over and submit new drawings. City Engineer Craig Brawner noted he would have an issue with the review of a Site Plan and the installation of roads and infrastructure without public comment on the subdivision. Planner Saunders asked if a temporary gravel access road be acceptable. Fire Marshal Chuck Winn noted he is not in favor of gravel accesses, however, if it were temporary, he could live with it. Discussion followed on the proposed streets and accesses. Mr. Brawner noted that the only sewer main that should be allowed is the one to this development and not for the rest of the site. Mr. Winn asked if they are still planning on sprinklering the whole building. He noted that on-site hydrants and fire lines have to be shown on the Final Site Plan. Planner Saunders noted that a list of requirements can be sent to the applicant to allow them time to resubmit. The review will continue when the new information is received. Mr. Winn noted , if Fallon street will be extended for access, his department needs fire hydrant locations and fire line locations. Planner Saunders clarified the requirements from Water/Sewer and Engineering Departments. 2. Castlebar Apartments Concept PUD #Z-98105 - (Skelton) Oak Street and North 251h A Concept Planned Unit Development Application to allow the construction of 12 6-apartment buildings in two phases Lowell Springer and Tom Mannachek joined the DRC. Chairperson/Planner Dave Skelton noted there will be no subdivision review. Mr. Springer presented a review of the issues presented in the informal and how he has addressed them. Water/Sewer Interim Superintendent Mike Certahe asked for the timing of phase 2. Mr. Mannachek described the phasing and the concept. Discussion followed on the width of dedicated right-of-way, the looping of the water, and the need to extend 27th street or not. Mr. Mannachek asked why the City Commission advised them to pursue this through the PUD process rather than a ZMA. Discussion on his question followed. Chairperson/Planner Skelton noted that the applicants cannot get a decision on the installation of North 27th Avenue until it Development Review Committee Minutes-June 30, 1998 3 can be based upon the merits of the proposal as part of a formal submittal during the P.U.D. Preliminary Plan Review. Discussion followed on the further scheduling of this application. Chairperson/Planner Skelton noted that the only way to get public input is to submit the PUD Preliminary Plan and get it scheduled. Mr. Mannachek reiterated his understanding of his and Mr. Springer's discussion in early May with Planning Director Epple. 3. Connell Motor Service Bays MiSP/COA#Z-98103 - (Skelton) 1735 West Main Street - A Minor Site Plan Application with a Certificate of Appropriateness to allow a 2,669 sq. ft. addition on the west elevation for service bays. Chairperson/Planner Dave Skelton presented the application. Fire Marshal Chuck Winn raised the issue of the sprinkling of the existing building, which was required with the last approved submittal, it hasn't been connected yet. He is not in favor of adding to an existing non-conforming structure. He noted there are some specific building code issues. E. INFORMAL REVIEW Henderson Inquiry #I-9830 - (Skelton) 1005 & 1011 East Griffin Drive - An Inquiry for advice and comment. Carroll Henderson joined the DRC. Chairperson/Planner Dave Skelton presented the application. Mr. Henderson asked if Rocky Creek would be a source of water for fire protection. The DRC noted that would not be an adequate water supply for fire protection. Mr. Henderson asked for the setbacks for a mobile home park. Chairperson/Planner Skelton noted he would need a variance to the yard setbacks. Mr. Henderson asked how sewer would be connected if he installed mobile homes. Water/Sewer Interim Superintendent Mike Certalic noted the portion of the sewer that is private. City Engineer Craig Brawner noted that the closest sewer line is in Story Mill Road near Bridger Golf Course. He noted that there isn't much development in that area due to the lack of sewer service. Chairperson/Planner Skelton noted that a zone change from R-S to M-1 would be difficult to support based on the current mix of land use patterns. He suggested Mr. Henderson meet with him on Thursday to discuss the matter further. Development Review Committee Minutes-June 30,1998 4 Added item.... Sundance Springs PUD Final Site Plan - (Arkell) Assistant Planning Director Debbie Arkell presented the Final Site Plan(FSP) for Sundance Springs Major Subdivision, noting this item was continued from the June 16 DRC meeting. She indicated that she and Project Engineer James Nickelson are recommending approval of the FSP. She discussed the Open Space as presented in the Preliminary Plan, which is now shown on the FSP. Chief Building Official Neil Poulsen asked if any of the lots are within the flood plain. Planner Arkell stated the Flood Plain Administrator required Flood Plain Development Permits for Lots 34-41, and that the final plat and covenants indicates this requirement.. Discussion followed on the issuance of flood plain permits and building permits. Mr. Forbes moved to approve the PUD Final Plan for Sundance Springs. The motion was seconded by Mr. Winn and carried 6-0. Planner Arkell noted that the decision of the DRC may be appealed if official notification is received by noon, Monday, July 6.
