TUESDAY, JUNE 23, 1998, 10:00 A.M.
MINUTES
Members Present: Neil Poulsen, Dave Skelton, Chuck Winn,

Chairperson Dave Skelton called the meeting to order at 10:05 a.m.
A. FINAL WEEK REVIEW
1. Keller Supply Company MaSP/COA#Z-9888 - (Sherman)
75 Rawhide Ridge
- A Major Site Plan Application with a Certificate of Appropriateness to
construct a 19,770 sq. ft. office, showroom, warehouse structure in the North 19t11
Entryway Overlay District.
Lowell Springer and Doug Morley joined the DRC. Urban Designer/Planner John Sherman
reviewed his conditions. He added "The handicapped space indicated is one foot short and shall
be labeled 'van accessible"' to condition#l.h. (All Staff Reports and memos are on file in the
Planning Office.)
Project Engineer James Nickelson reviewed his conditions.
Mr. Springer noted that if there is a problem with the well, they will provide an irrigation system,
by hand if necessary. Mr. Morley asked if the water main can be dead ended. Mr. Nickelson
noted that would be satisfactorily. Discussion ensued on the sprinklering of the building and
which department has the authority over it. Fire Marshal Chuck Winn noted that the Chief
Building Official has authority and can delegate authority to the RAE fire district. Further
discussion followed on the operation of the sprinkler heads, some or all, at the same time.
Mr. Poulsen asked Mr. Springer to give his department a proposal and they will look at it.
Mr. Nickelson, moved, Mr. Winn seconded, to recommend conditional approval to the Planning
Board. The motion carried 4-0.

2. BIH2, "Pond Row Apartments", Phase 2,MaSP #Z-9882 - (Saunders)
114, 118, 122 Pond Row
A Major Site Plan Application to allow the construction of three structures
for 10 units and laundry facilities as a second phase of a 20-unit apartment complex.
Doug Morley joined the DRC. Planner Chris Saunders reviewed his conditions, noting the first is
specific and the second is standard. He asked that all the landscaping and all infrastructure on one
plan. Mr. Moreley asked if the Planning Office wants one site plan for the phase 2 and one for the
overall project, or just one covering both phases. Planner Saunders noted he'd like just one
overall site plan. (All Staff Reports and Memos are on file in the Planning Office.)
Project Engineer James Nickelson reviewed his conditions.
Mr. Nickelson moved, Mr. Winn seconded, to recommend conditional approval. The motion
carried unanimously.
3. Fuddruckers MiSP/COA#Z-9887 - (Skelton)
2905 West Main Street
- A Minor Site Plan Application with a Certificate of Appropriateness to
allow the construction of a 5,651 sq. ft. structure for restaurant use.
Jim Ullman and Morris Klare joined the DRC. Chairperson/Senior Planner Skelton reviewed his
conditions. He noted the 8 foot side yard landscape has to be maintained. He and Mr. Ullman
discussed different options. Discussion followed on the signage. (All Staff reports and memos are
on file in the Planning Office.)
Project Engineer James Nickelson reviewed his conditions.
Mr. Ullman noted the sq. footage is under 5,000 sq. ft., so sprinkling should not be needed. Mr.
Poulsen noted that the patio area has to be included in the total sq. footage. A full separation wall
will be required as the total sq. footage is over 5,000 sq. ft. Fire Marshall Chuck Winn noted that
a 1 hour fire wall separation has to be installed if sprinkling is to be avoided.
Mr. Nickelson moved, Mr. Winn seconded, to conditionally approve the application. The motion
carried unanimously.
Mr. Winn asked for the materials of which the walls will be constructed. Mr. Klare described the
walls and the screening to be installed.
B. ONE WEEK REVIEW
1. Bozeman Athletic Club Cupolas COA/DEV#Z-9896 - (Saunders)
8601 Huffine Lane
- A Certificate of Appropriateness Application with Deviations to allow the
cupolas to exceed the maximum height permitted.
Mike Delaney joined the DRC. Associate Planner Chris Saunders presented the application.

Chief Building Official Neil Poulsen asked for the reason for the additional height. Mr. Delaney
noted it is required for the tennis court.
Planner Saunders noted that the first of a three week review will begin next week. There is time
for a fourth week of review, if needed, before the City Commission hearing.
The DRC noted there are no problems with the deviation.
C. INITIAL WEEK REVIEW
1. Comstock II CUP/Var#Z-9891 - (Olsen)
777 Haggerty Lane
- A Conditional Use Permit with a Variance Application to allow a 34 unit
low income apartment complex with a variance for parking requirements.
Planner Jody Olsen presented the application and explained the reasons for the requested variance
on parking. Discussion followed on the possibility of requiring the annexation of the property.
Project Engineer Rick Hixson noted that the applicant has been made aware of the capacity
problem of the sewer main. He will be required to show the City that the sewer capacity is there.
He noted he has sent Mr. Dabney a letter stating the requirements. He continued, the
water/sewer services need to be shown to the existing building, and there is a need for a sliver of
an easement for City sewer and water from the Klondike building.
Discussion followed on the number of units, number of lots, and the handicapped accessibility
requirement for apartment units.
Planner Olsen presented Water/Sewer Interim Superintendent Mike Certalic's comments.
2. Grum's Deli Expansion MiSP/COA/Dev#Z-9897 - (Skelton)
2107 North 7t"Avenue
- A Minor Site Plan Application with a Certificate of Appropriateness with
Deviations to allow a 750 sq. ft. expansion and related site improvements to an
existing restaurant
Jerry Gaston and Nick Salmon joined the DRC as this project is next door to the next project,
Ranch and Home, which is theirs.
Chairperson/Senior Planner Dave Skelton presented the project. He noted that the access and
utility easement to the property needs to be confirmed on the site plan. Mr. Salmon asked if Will
Thompson will be required to install a sidewalk. Discussion followed on sidewalks, access, and
drainage.

D. INFORMAL REVIEW
Ranch & Horne Addition - (Skelton)
2275 North 71'Avenue
- An Informal review for advice and comment on a proposed expansion.
Nick Salmon and Gerry Gaston joined the DRC. Mr. Salmon presented the proposal.
Project Engineer Rick Hixson noted that the retention pond should not flush immediately into the
groundwater. Fire Marshal Chuck Winn noted he'd want to see sprinkler calcs and plans on the
formal submittal.
Mr. Winn moved, Mr. Hixson, seconded to adjourn the meeting.
