HomeMy WebLinkAbout01-06-1998 DRC Minutes DEVELOPMENT REVIEW COMMITTEE JANUARY 6, 1998 MINUTES Members Present: Mike Certalic, Craig Brawner, Chuck Winn, Dave Skelton, Roger Sicz, Phill Forbes Staff Present: Jody Olsen, Rick Hixson, Kirsten Emborg, Chris Saunders, Karen Finke, Carol Schott Visitors Present: Gene Cook, Jerry Taylor, Mark Chandler, Tim Howard Chairperson Dave Skelton called the meeting to order at 10:00 a.m. A. FINAL WEEK OF THREE WEEK REVIEW 1. Bridger Industrial Park, Ph. 2 MaSP Preliminary Plat#Z-97167- (Olsen) 2304 North 7th Avenue - A Major Site Plan Application to allow the construction of a second warehouse/office structure and related site improvements. Gene Cook joined the DRC. Planner Jody Olsen reviewed her comments. (All staff conditions are on file in the Planning Office.) Mr. Cook agreed with looping the driveway in condition#3. City Engineer Craig Brawner asked about the shared access easement. Mr. Cook agreed to the shared access. Planner Olsen explained further. Chairperson Skelton suggested checking with Mr. Forbes on the option of waiving the side yard setback. Mr. Cook noted he'd rather put up a fence, sprinklering, and landscaping. He noted a larger setback on the east side would be fine. Project Engineer Rick Hixson reviewed his conditions, noting that most are standard, except #6, which addresses driveway width. Fire Marshal Chuck Winn noted that Planner Olsen covered his concerns in her comments. Interim Water/Sewer Superintendent Mike Certalic noted comments 1-7 are standard; comment #8 addresses water service sizing and installation, and comment #9 addresses the sewer connection and installation. Mr. Brawner suggested individual service stubs for each lot. Mr. Certalic noted that individual stubs would be best for water, also. Mr. Winn moved, Mr. Sicz seconded, to recommend conditional approval to the Planning Board. The motion carried 5-0. Development Review Committee Minutes-January 6,1998 1 2. Skyview Professional Building CUPNar#Z-97168 - (Olsen) 1825 South 1 lth Avenue - A Conditional Use Permit Application with variances to allow the construction of a 2'/2 story professional office building and related site improvements. Jerry Taylor, Phil Rotherham, and Mark Chandler joined the DRC. Planner Jody Olsen presented her final comments. (AU staff comments are on file in the Planning Office.) Mr. Taylor asked where in the code it states that the accessible spaces cannot be shared. He was referred to Roy Beall. Chairperson Skelton noted that on comment #11, that boulevard trees are to be installed at a rate of one per 50'. Streets/Sanitation Superintendent Roger Sicz noted that no parking will be allowed along Kagy from 1 lth to the access to the property and that Kagy shall be signed accordingly, to Montanta Public Works Standards. He noted the City will paint the curb. Project Engineer Rick Hixson reviewed his comments. City Engineer Craig Brawner noted that a fair share proration should include traffic contribution. Mr. Hixson continued. Mr. Brawner asked about detention rather than retention ponds. He suggested detention would would work rather well in this instance, as there are good discharge possibilities. Mr. Sicz asked about the types of offices to be located there. Mr. Taylor noted there will be dentists' offices. Mr. Sicz noted that there may be a need for a turn lane on Kagy. Mr. Taylor noted that traffic is sporatic on 11th. He doesn't feel this development will impact the traffic at 11th and Kagy. Discussion ensued on traffic controls. Mr. Brawner noted that the other two developments are subdivisions, this is a development of lots. When this was subdivided, the improvements to streets, water and sewer weren't included; therefore, sidewalks, sewer, water, curbs and gutter need to be installed or upgraded with this project. Fire Marshal Chuck Winn reviewed his one comment on the water supply and the fire sprinklering system. Mr. Brawner asked if this size building would require sprinklering if there was a looped water system. Mr. Winn noted it would not, the sprinklering requirement is due to the low level of water flows. Mr. Brawner asked if the looped water line is to be installed soon, could the sprinklering be stricken. Mr. Winn noted that if the water is looped prior to occupancy of the building, he would agree that the building would not need to be sprinklered. Interim Water/Sewer Superintendent Mike Certalic reviewed his comments, noting that comment #3 addresses the angle of the water service line. He discussed the location of the sewer stub and the City's responsibility to lay the stub to the property line. Mr. Taylor asked for clarification of the minimum water flow into the building. Mr. Winn noted that 1500 gallons per minute is the bare minimum. Discussion followed on the calculation of peak flows to meet the 1500 gallons per minute flow required. Mr. Taylor asked if they sprinkler the building, would they be able to proceed with construction of the building. Mr. Brawner noted that some limited development would be allowed. Development Review Committee Minutes-January 6,1998 2 Mr. Taylor noted that his client is a small player in the looping of the water; this is a large investment for them. Mr. Brawner noted that this is a dead end water line. If there is a break, there is no backup water supply. Mr. Taylor noted that the applicant bought the lot with the understanding that services were available. Chairperson Skelton interjected that the applicant and DRC each have concerns with the water supply. Mr. Taylor noted he needs to be able to go to his client with the options. Mr. Winn asked if the applicants don't install a sprinkler system, can they cut Kagy? Mr. Sicz noted that he would have to check to see when it was paved. Chairperson Skelton noted that an addition will be added to the staff report noting that DRC recommended cutting Kagy for the water service stub. Mr. Taylor was concerned with the development of Kagy, especially with the timing of the work rather than the cost. He thinks it is a serious problem with the 10 foot jog in Kagy with this development. He explained the location of the curb and gutter and sidewalks. Discussion of the options followed. Mr. Brawner noted the location of the curb, gutter, and sidewalks and tapering of the street on the north side. It will be built to City standards using design standards for streets and highways. Mr. Taylor asked about the route of the looped system. Mr. Brawner noted the changes in the route due to the current development and applications for development. Mr. Taylor noted that his client will have to participate in two water improvements -the looping and the up-sizing of the trunk line. Mr. Brawner noted they are one and the same. He explained how if the up sizing is installed, it will meet the water supply issue. Mr. Sicz moved, Mr. Hixson seconded, to recommend conditional approval to Planning Board. The motion carried 5-0. B. FIRST WEEK OF THREE WEEK REVIEW 1. River Run Concept PUD/Pre-Application #Z-97178/#P-9761 - (Saunders) Manley Road Concept Planned Unit Development and Major Subdivision Pre- Application Applications for a mixed-use planned unit development on roughly 89 acres and a 40 lot subdivision on 54.86+ acres, the part of the PUD that is residentially zoned, located on what has been formerly referred to as the Manley Property. Planner Chris Saunders presented the application. He noted the applicant is proposing two subdivisions, the first a minor subdivision to break off the three zoning areas. He feels they will need to do a PUD to accomplish the subdivision. He gave several reasons. He noted there are several issues. The applicants are showing a 60'rather than a 90'right-of-way. The planning staff would like to see a 30'buffer. The applicants are showing an 8" water line, the water facilities plan shows a 10" line is needed. He noted the paving standards are to county standards and we may want it built to City standards. He noted the phasing and the concept plan that called for townhomes and the requirement for adequate stubbing. He is concerned about the water supply being met with an 8" water line. He noted the streets are public. Streets/Sanitation Superintendent Roger Sicz noted that if the streets are public, the city will not allow the Development Review Committee Minutes-January 6,1998 3 hammerheads. Planner Saunders noted that the major street route is looped, however, he'd like to see a buffer. Discussion followed on sewer and water and street standards. City Engineer Craig Brawner asked about the transportation system in that area. Discussion ensued on the State owned land to the west and the Gallatin River to the east. It was suggested that a transportation plan be submitted with the Preliminary Plat for the whole subdivision. Discussion followed on the water service size to serve the whole development. 2. Harvest Creek MaSub Preliminary Plat Application #P-9762 - (Skelton) 5461 Durston Road - A Major Subdivision Preliminary Plat Application to allow a phased subdivision of 148 acres, with phases 1-3 and a remainder the subject of this application. 235 lots will be created on 48.44 net acres for single family residential development. Formerly referred to as the Gateway Limited Partners Annexation. Chairperson/Senior Planner Dave Skelton presented the application. Keith Belden, Bruce Foley, and Tim Howard joined the DRC. Mr. Howard and Mr. Belden addressed how the issues from the pre-application were dealt with. ( Public Services Director Phill Forbes joined the DRC.) Planner Skelton noted that the property owners have some concerns with the extension of 27th in conjunction with the power line location to the north. Mr. Belden explained the first attempt at the intersection of Oak and North 27th. He continued that the option was chosen to avoid conflicts with the power lines. He will bring in his depiction of the intersection by tomorrow. He'd like comments and suggestions on it. Planner Skelton asked if there would be any consideration for using the power lines as a median with North 27th going on each side. Mr. Belden noted he had talked to Montana Power Company about it. Mr. Brawner noted that Mr. Vander Molen wanted the street to be installed there so land on either side of the street can be developed. It was noted that other property owners will have to be involved. Planner Skelton suggested that Mr. Brawner, Mr. Forbes, Mr. Hixson,himself, and other interested staff look at this project on Friday to iron out some questions. He asked if curb, gutter, and sidewalk should be required. Mr. Brawner noted sidewalks for sure; Mr. Sicz noted curb and gutter needs to be installed also. Discussion followed on the curb and gutter and drainage problems and options. Discussion continued on using the Durston improvements plan to plan their streets. Mr. Brawner noted that this applicant will be required to make the improvements on Oak and 19th by installing a light and turn bays. Mr. Belden wants to know what needs to be done at the Oak/19th intersection to make it work. Mr. Brawner noted he will asked HKM to provide the information. Discussion followed on impact fee credits and how to qualify for them. Mr. Brawner noted the pressing questions for him are when will the peripheral streets be required and installed and when will the secondary streets be installed. Mr. Belden noted they plan two phases so they aren't locked in to building all the infrastructure Development Review Committee Minutes-January 6,1998 4 for the whole subdivision. The plan to build the south phase first. Discussion ensued on the water/sewer to be installed before the streets/intersections are installed. Discussion followed on existing and proposed sewer/water main locations. Planner Skelton noted another big issue, with 27th being a collector, is that there are several lots fronting 27th street, which is generally not allowed on collectors. He feels this needs to be addressed and wants to discuss it with Mr. Brawner before next Tuesday. Mr. Forbes noted that he has no problem with the lots fronting on a collector. Mr. Brawner concurred; however he noted that complaints will come in, with requests for traffic circles or other traffic control for vehicles. Mr. Belden noted that the sewer interceptor line needs discussing. Mr. Brawner noted there should be no problem as it is up to the developer to get from point A to point B.
