SUBJECT: Adoption of Resolution 4553 amending the future land use map, Figure 3-1 of the Bozeman Community Plan, on 3.002 acres located at 856 Loxley Drive. Laurel Glen Lot 1, Block 9 Growth Policy Amendment Application P14016.

RECOMMENDATION: Approval MOTION: I adopt Resolution 4553 amending the future land use map Figure 3-1 of the
Bozeman Community Plan on 3.002 acres located at 856 Loxley Drive.
BACKGROUND: The City Commission conducted a public hearing on July 7, 2014 for application P14016. The applicant sought to change the future land use map of the Bozeman Community Plan from Residential to Community Commercial Mixed Use on approximately
3.002 acres. The Commission approved the application subject to contingencies necessary to
complete the resolution adoption process. The necessary mapping and boundary descriptions
have been provided. Per the City’s practice, the boundary of the amended areas have been extended to the middle of the adjacent streets.
UNRESOLVED ISSUES: None.
ALTERNATIVES: Approval or denial based upon Commission determination of compliance with the original contingencies of approval.
FISCAL EFFECTS: No budget items will be affected by this ordinance.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, TO CHANGE THE BOZEMAN COMMUNITY PLAN FUTURE LAND
USE MAP DESIGNATION FROM COMMERCIAL MIXED USE TO RESIDENTIAL
FOR 3.002 ACRES OF PROPERTY ON LOT 1, BLOCK 9, LAUREL GLEN
SUBDIVISION PHASE 1 AND PORTIONS OF ADJACENT RIGHT-OF-WAY.
WHEREAS, the City of Bozeman has had a comprehensive plan (growth policy) since
1958; and
WHEREAS, the City of Bozeman adopted it current growth policy known as the
Bozeman Community Plan (BCP) through Resolution 4163 on June 1, 2009; and
WHEREAS, Section 17.4 of the BCP establishes criteria for amending the BCP; and
WHEREAS, an application was submitted by the property owner, Manhattan Bank, on
March 26, 2014, to amend Figure 3-1 of the BCP (future land use map) to change the land use
from community commercial mixed-use to residential on Lot 1, Block 9, Laurel Glen Phase 1
Subdivision; and
WHEREAS, a public hearing was held by the Planning Board on June 17, 2014; and
WHEREAS, after considering public comment, the recommendation from the
Planning Board, and the staff report the City Commission found at their public hearing on July 7,
2014 that the Criteria of Section 17.4 of the Bozeman Community Plan were met by the
application.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana:

Figure 3-1 of the Bozeman Community Plan is hereby amended to change the future land use
designation from Community Commercial Mixed Use to Residential on a portion of land located
at 856 Loxley Drive and more particularly described as:
Lot 1, Block 9 and portions of the adjacent street right-of-ways, Laurel Glen Subdivision, Phase
1, on file and of record in the office of the Clerk and Recorder, Gallatin County, Montana, and
located in the South Half of Section 4, Township 2 South, Range 5 East of P.M.M., City of
Bozeman, Gallatin County, Montana and further described as follows:
Commencing at the southwest corner of Lot 1, Block 9, Laurel Glen Subdivision, Phase 1, the
point of beginning; thence due WEST 30.00 feet, assumed bearing; thence due NORTH 421.78
feet to a point on a curve with the center of circle lying North 06°20'29" East 500.00 feet from
said point; thence easterly 100.66 feet on said curve, radius 500.00 feet and central angle
011°32'07"; thence North 84°48'22" East 186.98 feet; thence South 05°11'38" East 414.44 feet;
thence southerly 23.59 feet on a tangential curve concave to the west, radius 400.00 feet and
central angle 003°22'45"; thence South 88°11'06" West 45.00 feet; thence due WEST 250.69
feet to the point of beginning.
Area = 130,766 square feet or 3.0020 acres. Subject to existing easements.

PASSED AND APPROVED by the City Commission of the City of Bozeman,
Montana, at a regular session thereof held on the 8th day of December 2014.
